"- Mayor Baugh suggested they move item 3, proclamation, up to this point on the agenda and no Council member expressed an objection. PROCLAMATION - RETIREMENT OF EVERETT WILCOX - Mr. Wilcox came forward and Mayor Baugh read the proclamation and presented it to him. Mayor Baugh noted that Mr. Wilcox retired last Thursday and that he had worked with him for 10 of his 14 years with the City. He referred to all the help given him by Mr. Wilcox and wished him the best. Mayor Baugh asked for a motion to go out of the Council meeting and go into the Public Hearing. Councilman Asting so moved. Councilman Inman seconded the motion. Motion CARRIED 5-0. City Clerk Martinez stated there's a memo from Earl Copeland, Public Works Superintendent, stating the reason for the supplementary bill, which involved two cylinders repaired instead of just one. She noted he's asking for approval of $1,485. to Central Hydraulics. Councilman Asting moved to pay the bill. Councilman Prater seconded the motion. Motion CARRIED 5-0. MISCELLANEOUS John Scherz, 905 Egret Court, spoke on a permit for construction of a carport at 1013 Egret at a home owned by Helen Hann. He pointed out it was one of the first homes built in Phase 1. He said this was approved and then later denied at Planning Assistant Lynne Plaskett's recommendation. He noted that he thought it was covered by a blanket agreement made in January or February and this was one of about 20 homes involved. He said that Lynne Plaskett was not employed by the City then, and the error was made in setbacks and it wasn't the fault of the homeowners. He said they're asking that the permit be granted on the agreement and they aren't asking it to be done allover the City, just in the agreement area. He added the homeowners are still in agree- ment with Phase II being checked and controlled by the City regarding the buildings and patios and setbacks. -2- Council Regular Meeting Minutes September 15, 1986 (;) o MISCELLANEOUS (Continued) John Scherz (Continued) - City Attorney Alvarez said this is a complex matter and perhaps with new personnel, and history, and present developments, it has to be adjusted. He reviewed that when the situation originally developed on the concrete slabs, it was because it went to the Board of Adjustments for a variance and they can't grant a variance unless the hardship is of no fault of the applicant, plus other criteria. He continued that it came to Council and the Building Official and it was the subject of a meeting with Planning and Zoning and it was decided to apply a zoning setback classification only to Phase I of Pelican Cove West. He said there were 20 or so homes involved in the settlement agreement so they need to look at it from that perspective. He noted the Board of Adjustments did what they had to do but if it belonged to the other classification, then they need to look at it and he needs to talk to the Assistant Planner and bring her up to date. Mr. Scherz asked if he'll review it and get back to them because one house has a carport, and they only want to keep to the agreement, and they're all temporary structures. City Attorney Alvarez stated he'll talk to the Building Official and see what his records show on the concrete slab. Mayor Baugh advised Mr. Scherz that the City Attorney will get back to him or the Council. Alice Murphy, from the audience, asked if she could speak on this as a member of the Board of Adjustments, and City Attorney Alvarez suggested she wait until he talked with the Planning Assistant. Alice Murphy, 230 North Riverside Drive, showed an official map of the City and it was passed by a former Council. She said there is 25 foot of her property shown as an alley and she has an abstract from 1916 where the land was purchased from Hubbell for $150. She noted it's been a part of her property for 70 years and been on the tax rolls. She said this map has been redrawn and they took the word "vacated" off. She asked who tampered with it since it's been a part of her property for 70 years and was paid for. She said the person who wrote it up had streets washed off and she asked who could do that without a public hearing. She said the new map doesn't show the new houses. She referred to a house on the river being built and she was told it's being researched. She stated that she was told the property in front of the homes on Riverside Drive belonged to the State. She asked who checks abstracts if the owners don't borrow money for the banks to check it. Mayor Baugh said this was turned over to the individuals doing the map and they researched the ordinances and City records. Mrs. Murphy replied that the City records are not accurate, and she again referred to the word "vacated" being taken off. Mayor Baugh asked City Attorney Alvarez to check this out, and City Attorney Alvarez said he'd like to look at the old map again. Mrs. Murphy brought it forward for City Attorney Alvarez to see. Mayor Baugh asked if she'd talked to anybody in the City before they put out the map. Mrs. Murphy said she was told they were getting ready to accept the map and they'd wiped it out and she asked Lynne Plaskett to look into it and she said she'd help her. John Scherz, 905 Egret Court, said his neighbors want to know when to expect an answer as before they had to go through about eight meetings. City Attorney Alvarez replied that the work has been done and the question is if the property in included in that group and the Building Official should be able to answer that this week. Jill Keeping, 226 Wildwood Drive, and owner of Downtown Edgewater's Just a Deli, presented a petition from some citizens in full support of Chief Schumaker's efforts to update and increase the Police Department and raising of pay. She said they need to get enough pay for the officers so they won't look to other cities and the Sheriff's Department or Dade County and leave here after they're trained. -3- Council Regular Meeting Minutes September 15, 1986 Q o MISCELLANEOUS (Continued) Mr. C. E. Clark, 1818 Evergreen Drive, asked Council to put more teeth into the code enforcement for repeated violators. He noted that certain people get in compliance before having to go to the board for a citation and then they repeat the offense. Mayor Baugh noted that he'd discussed this with the Code Enforcement Officer and he'll be checking on it. Leo Nelson, 115 West Turgot, spoke on the dust problem at West Turgot and Marilyn. Mayor Baugh pointed out it's on the 1987 list which starts October 1st, and that we've talked to the School Board to see if there are funds avilable from them for paving. Councilman Asting noted that the road is used a lot by parents of the school children. Mayor Baugh stated they're doing the 1986 construction now and there's a lot of paperwork involved. Mr. Nelson asked if it will be done by the first of the year, and he pointed out his tax rate keeps going up. Mr. Nelson asked if they'll put in side- walks and Mayor Baugh replied there were no sidewalks considered there. Councilman Asting noted the money available will only permit so much paving a year. Mayor Baugh noted some roads, such as Hibiscus in Florida Shores, are also in bad shape. Rita Schwark, 2 Marilyn Drive, stated that none is as bad as Marilyn and she's lived in Florida Shores. Mayor Baugh said they were waiting for the School Board to get something from them as we can take care of it from U.S.l to the corner of the school property. COUNCIL/OFFICERS' REPORTS, BOARDS AND COMMITTEES City Council Reports - Councilman Inman congratulated the Police Department on their actions taken that resulted in the apprehension of the accused bank robber. He reviewed the methods used, by both on and off duty personnel. He gave special recognition to Detective BuckyMcEver and Detective Frazee for all they did in following up on the leads they received. He moved to have a letter written to each member of the Police Department involved in the operation and placed in their personnel file. Councilman Asting seconded the motion, and added that he'd like to compliment the Police Department on the positive manner in which they're conducting Police affairs as short-handed as they are now. Motion CARRIED 5-0. Mayor Baugh called a five-minute recess at 7:55 P.M. He called the meeting back to order at 8:04 P.M. Mayor Baugh stated he'd gone to a meeting regarding road impact fees and there are about six cities not happy with the County's ordinance which charges about $700 per house to build in the City to benefit County roads. He said he asked what Edgewater would get and he was told nothing because the only County road is Park Avenue. He asked if Council feels any different about this, as the County didn't compromise except what they had said about a month ago. Councilman Rotundo asked if the other cities remained the same and Mayor Baugh replied yes, and they'll go to court before they'll impose it because their city doesn't get any of the benefit. He added that he won't support it until they see what the City will get as they'll get about $500,000 a year from Edgewater. He noted that he's talked to Jack Ascherl and isn't convinced the City will benefit. Councilman Asting pointed out they'll expect the City to collect the money from construction fees and they'll spend it elsewhere in the County and he thinks they should retain their position of opting out of any agreement with the County of any impact fee being collected. Mayor Baugh stated that at the last meeting they said the County will collect the fees but they'll be paid by the people building in Edgewater. City Attorney Alvarez said they need to be alert to see what the rest of the municipalities do who have chosen not to agree with it. Mayor Baugh said 2 or 3 were considering it after the meeting last week. Mayor Baugh asked how much time they have yet and City Attorney Alvarez replied it's 90 days and they should have about 60 days left. Mayor Baugh asked if they want to continue with the ordinance the next 60 days and there was unanimous agreement they still want to go with it. Mayor Baugh advised the City Attorney to make their wishes known if he's approached about it. -4- Council Regular Meeting Minutes September 15, 1986 ~ o COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES (Continued) City Attorney Reports - City Attorney Alvarez stated that regarding the amendment to the Comprehensive Land Use Plan, if there's need for an additional public hearing at the Council level before an amendment goes to Tallahassee, that hearing will be held on September 25th at 7:00 P.M. Attorney Glenn Storch, in the audience, said he doesn't think there's a need for one. City Clerk Reports - City Clerk Martinez stated that Dan Cory completed the official zoning map and per Section 501.04 of the Code, a Council motion is necessary to authorize the Mayor and City Clerk to sign this map. Mayor Baugh questioned if changes can be made as necessary. City Attorney Alvarez replied it's a document with a series of ordinances listed and there may be scrivener's errors in the map and as routine corrections and changes such as zonings and rezonings take place, they'll come to Council and log it on the map. He pointed out it doesn't jeopardize Alice Murphy or anyone else. Mrs. Murphy asked if her street can be vacated again and City Attorney Alvarez replied that if it was vacated by the City, it should have been done according to Section 112 with a resolution of intent and an ordinance. Mrs. Murphy stated it was 70 years ago and City Attorney Alvarez expressed his hopes that the records are available for that time. Mayor Baugh asked Mrs. Murphy to bring the information in and Mrs. Murphy said she did and nothing was done by the City Clerk. Mrs. Murphy again asked how Rhode Island was deliberately deleted, and said she'd brought it in 4 years ago and again to Lynne Plaskett. She noted they're accepting the map with her alley on it and Mayor Baugh pointed out it will be changed if there's an error. Councilman Inman moved to TABLE this until the next meeting due to the fact of what Mrs. Murphy said as he'd like to get this straightened out. Councilman Asting seconded the motion. City Attorney Alvarez pointed out that Alice Murphy is talking about a designation of an alley way and whether it's vacated or not is a matter of public record, but this is zoning classifications throughout the City, and if there's no objection to the zoning classification, then the errors on names misspelled, etc., will be changed. He added they're just adopting zoning districts and new City boundaries pursuant to the last few annexations. Mayor Baugh agreed it's just for zoning purposes. City Attorney Alvarez again noted they're justing saying if it's in the proper zoning classification. Motion DID NOT CARRY 2-3. Mayor Baugh, Councilman Rotundo, and Councilman Prater voted NO. Mayor Baugh then asked for a motion to accept or reject the map for zoning classifications only and street names, etc., can be changed. Councilman Rotundo moved to accept this. Councilman Prater seconded the motion. Motion CARRIED 3-2. Councilman Inman and Councilman Asting voted NO. City Clerk Martinez pointed out that the second paragraph stated the copies will be available to the public at a cost of $5.00 for the 36 by 72 and $3.50 for the 18 by 36 and that's the City's costs. City Clerk Martinez stated they've reviewed various fee schedules for occu- pational licenses and found current language reads 10% penalties for delinquencies even if it's 11 or 12 months. She said she's recommending a change of 10% for the first month and 5% for each additional month, up to a maximum of 25%. She pointed out it's delinquent fees only. Councilman Asting asked if it's after they're notified and they don't pick up the license and City Martinez agreed. Mayor Baugh asked about it being non- existent and City Clerk Martinez said it's not a problem because there's nobody in that business and they wouldn't apply a penalty. Councilman Asting asked how they'd know it's non-existent and City Clerk Martinez replied the mail comes back or they notify the City. Councilman Inman moved to adopt this license penalty fee amendment. Councilman Asting seconded the motion. Motion CARRIED 5-0. City Clerk Martinez noted it will be necessary for the City Attorney to draw up an amendment to that ordinance. Mayor Baugh asked for a motion to that effect. Councilman Prater so moved. Motion CARRIED 5-0. -5- Council Regular Meeting Minutes September 15, 1986 ~ o COUNCIL OFFICERS REPORTS, BOARDS AND COMMITTEES (Continued) City Clerk Reports (Continued) City Clerk Martinez stated the next two items need more staff research and they'll be returned to Council when the staff completes their research. Councilman Asting moved to permit the City Clerk to withdraw the next two items (Pet License Fees and Expiration Dates, also Recommended Increases in Building Valuations and Fees and Planning Fees). Councilman Inman seconded the motion. Motion CARRIED 5-0. City Clerk Martinez stated that the Certificate of Achievement was awarded to the City for the third year plus an additional award was presented to the City Clerk as the primary person responsible. She thanked her entire staff in City Hall who assisted in obtaining this award, noting that without their assitance, it could not have happened. Councilman Asting stated that recognition should be given to City Clerk Martinez because she supervises the City Hall staff and she's doing a very good job to receive the award. Mayor Baugh requested a motion that a letter be given in her personnel file for this achievement. Councilman Asting so moved. Councilman Inman seconded the motion. Councilman Rotundo suggested it be a letter to all people involved. Mayor Baugh pointed out she's the supervisor and she can write a personal note for their personnel file but this has to come from Council. Councilman Rotundo agreed. Motion CARRIED 5-0. Fire Department - request to waive charge for lights when using softball field - City Clerk Martinez explained that they practice on Friday nights for about two hours and again on Saturday nights for about two hours and the current fee schedule for those renting this is $10 per hour. She noted it's strictly for the light bill for the ballfield. Councilman Asting moved to grant the Fire Department their request to waive the fees. Councilman Rotundo seconded the motion. Councilman Inman asked who will have the responsi- bility of turning the lights off when they're through and Mr. Patsy DiLeva, from the audience, stated they'll handle it. Motion CARRIED 5-0. Planning and Zoning Board requests: Amending Section 606.02(d)(1), Special Exceptions, B-3 - City Clerk Martinez read the August 21st memo from the Planning and Zoning Board, signed by Lynne Plaskett, Planning Assistant. The suggested new wording for that section was: "Outdoor display or sale of merchandise, equipment or materials that, in the interest of safety are hazardous in nature, shall be encompassed by a six (6) foot high fence not readily climable by small children. Operative automobiles, mobile homes and boats for sale shall be exempt from this requirement." Councilman Asting moved to accept the recommendation of the Planning and Zoning Board to amend the ordinance as indicated in their letter, and to direct the City Attorney to draw up the necessary papers. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. Planning and Zoning Board requests: Deleting 701.01(c) Prohibited signs and sign lights - City Clerk Martinez read the August 21st memo from the Planning and Zoning Board and signed by Lynne Plaskett, Planning Assistant. She explained that currently the sign ordinance states where they should be and it's a definition that's misplaced. Councilman Rotundo moved to accept this request. Councilman Asting seconded the motion. Mayor Baugh asked if they want to include in the motion that the City Attorney is to draw up the necessary papers and Councilman Rotundo and Councilman Asting agreed. Motion CARRIED 5-0. -6- Council Regular Meeting Minutes September 15, 1986 o o COMMUNICATIONS Christina Keifer re: Treatment and Public Works and Refuse Plant - City Clerk Martinez read the September 5th letter from Ms. Keifer. Ms. Keifer, 410 West Ocean Avenue, presented a signed petition to Council regarding smoke and foul odors from the plants. She noted that she'd spoken to Councilman Prater about these problems. She stated the smoking incinerator causes health hazards and the smoke has caused smokes alarms to go off in the houses. She asked that some corrective action be taken because they're concerned more refuse and sewage will be handled in the plants. She then submitted dates and times of these problems, noting the problems at the sewer plant are after business hours, as it closes at 3 PM and isn't open on Saturdays. She said the greatest problems were when nobody was attending the plant. She said she didn't know how they'd handle the smoking incinerator problem, but it's a serious health problem. Councilman Asting moved that this matter be referred to the City Engineer and his recommendation be made to the Council. Ms. Keifer stated that the City Engineer already paid heravisit, along with the Public Works Supervisor, and they agreed there is a problem with the smoke and the odor. Councilman Asting suggested an employee be on duty after hours. There was a discussion about the smoke problems around 7 AM and Ms. Keifer stated that's when they go to work and when they fire it up when there's a terrible black smoke filling the area which sets off her fire alarm three houses from the plant. She added that another woman a block away from her had an alarm set off also. Councilman Rotundo seconded the motion. Mayor Baugh stated they'll get a report from the City Engineer and the Public Works Superintendent. Councilman Asting suggested the Utilities Superintendent be involved also and Mayor Baugh agreed. Esther Vaughn, 401 West Ocean, said she heard there was also a petition 5 or 6 years ago when the sewer plant had a problem. There was a discussion about the wet days being involved in the excessive odors or smoke. Ms. Keifer said her smoke alarm went off at 3 in the morning and her kitchen was full of smoke. Mayor Baugh asked that he be called to come and look at it when there's a problem. Councilman Prater suggested an industrial engineer be involved. Mayor Baugh noted the City has the permits. ORDINANCES AND RESOLUTIONS Ord. 86-0-28 Amending Chapter 19, Art. 1, Sec. 19-1 and 19-13, establishing transfer fee and increasing time for termination of service for non-payment of utility bill - City Attorney Alvarez read this Ordinance. ORD. 86-0-28 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 19, ARTICLE I, SECTION 19-1 AND 19-13 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY INCREASING THE TIME FOR TERMINATION OF SERVICE FROM THIRTY TO THIRTY-FIVE DAYS; ESTABLISHING A TRANSFER FEE OF FIVE C$5.00)DOLLARS; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. Ord. 86-0-29 Rezoning Fong property from R-l to B-3 - City Attorney Alvarez read this Ordinance. ORD. 86-0-29 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, CHANGING THE ZONING CLASSIFICATION OF A PORTION OF U.S. LOT 7, SECTION 2, TOWNSHIP 18 SOUTH, RANGE 34 EAST, LYING EASTERLY OF AND ADJACENT TO U.S. HIGHWAY NO.1, WITHIN THE CITY LIMITS OF THE CITY OF EDGEWATER, FROM ITS PRESENT ZONING CLASSIFICATION OF R-l TO B-3, PROVIDED THAT THE OFFICIAL ZONING MAP OF THE CITY OF EDGEWATER, FLORIDA, SHALL BE AMENDED TO REFLECT THIS CHANGE IN ZONING; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
