CALL TO ORDER
Mayor Baugh called the meeting to order at 7:00 P.M. in the Community Center.

There was a salute to the Flag.
Mayor Baugh requested a motion to go from the regular Council meeting to the
Public Hearing. Councilman Prater ao moved. Councilman Rotundo seconded the
motion. Motion CARRIED 4-0.
PUBLIC HEARING - SECOND & FINAL READING & ACTION:
Ord. 87-0-29 Amendment to City Charter to provide for City Manager to be appointed
by City Council, voter performance approval, and residency requirements for City
Manager and Department Heads - City Clerk Martinez read this Ordinance. ORD. 87-0-29
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, CALLING FOR A
SPECIAL ELECTION FOR THE PURPOSE OF AMENDING THE CITY CHARTER BY PROVIDING FOR A
CITY MANAGER TO BE APPOINTED BY THE COUNCIL BY ORDINANCE; BY PROVIDING FOR BIENNIAL
CITY MANAGER VOTER PERFORMANCE APPROVAL; AND BY PROVIDING FOR RESIDENCY REQUIREMENTS
FOR THE CITY MANAGER AND DEPARTMENT HEADS; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH, CONTAINING A REPEALER PROVISION, A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Baugh asked for comments from
the audience and there were none. He then asked for Council comments and there
were none. Mayor Baugh requested a motion to adjourn the Public Hearing and go back
to the regular meeting. Councilman Prater so moved. Councilman Mitchum seconded
the motion. Motion CARRIED 4-0.
Councilman Prater moved they adopt Ordinance 87-0-29. Councilman Mitchum seconded
the motion. Motion CARRIED 3-1. Councilman Rotundo voted NO.
Mayor Baugh recessed. the Council meeting to go back to the Workshop with the
engineers at 7:07 P.M. Mayor Baugh called the regular meeting back to order
at 7:17 P.M. after the completion of the Workshop. He then called a short recess.

APPROVAL OF MINUTES
Regular Meeting of December 7, 1987 - Councilman Mitchum moved they approve the
minutes. Councilman Prater seconded the motion. Motion CARRIED 4-0.
Special Meeting of December 9, 1987 - Councilman Prater moved they approve the
minutes of the Special Meeting of December 9th. Councilman Rotundo seconded the
motion. Motion CARRIED 4-0.
BILLS AND ACCOUNTS
Councilman Rotundo moved they pay these bills. Councilman Prater seconded the
motion. Motion CARRIED 4-0.
Mayor Baugh stated there's a supplemental bill. City Clerk Martinez read her
memo of December 9, 1987, explaining that Dana Smith, Architect, informed her of
the tests on November 18th and she obtained a purchase order for him and then
found on the statement that the work had been ordered November 12th. She added
that Mr. Smith has been informed of the procedure. Councilman Prater moved they
pay the supplementary bill. Councilman Mitchum seconded the motion. Motion
CARRIED 4-0.

MISCELLANEOUS
Frank Roe, 2732 Juniper, asked how long it's been since the City had a City
Manager and Mayor Baugh replied since 1982. Mr. Roe stated they moved the
election from March 4th to February 2nd and it costs $57 a day to rush it for
30 days. He asked if it makes that much difference to save $2,000. He said
he's a taxpayer and he hates to see money wasted. He suggested Council reverse
itself and go back to the date they had to save the money.
Harold Hardester, 817 Egret Court, asked if a verbal contract is valid in this
City. Mayor, Baugh asked for more information. Mr. Hardester stated it's per-
taining to Pelican Cove West, and they were told by the developer that in the
event a roadway of ingress or egress was turned down on Belmont Plaza at Falcon
Avenue that the builder would extend Falcon at an angle to go to Rt. 1 to
divert any commercial traffic to the residential area. Mayor Baugh pointed out
this question is not for Council but would be between the developer and residents.
Mr. Hardester read a letter to Luis Geil that was presented at the Planning and
Zoning Board. He added that the man made a verbal agreement and the Board decided
to permit ingress and egress on Falcon despite the hazard to adults and to children
who have to take their bikes to U.S. 1 to catch the school bus. He noted that
Planning and Zoning Board, with the exception of two members, did not listen too
well, and he wonders if Council has authority to put a stop on that until they can
hear all the details. Mayor Baugh stated that Council has the right to override
the Planning and Zoning Board. Mr. Hardester stated that this developer seems to
be able to do anything he wants to at any time, and referred to another incident
regarding cutting down 25 trees in the Belmont Plaza area without a permit. He
added they still don't have a permit, and a permit for one tree or any number of
trees is $25., and he asked why they can't change the Code.
Councilman Prater asked why this doesn't go to the Building Inspector and Mr.
Hardester replied he talked with him about it and got nowhere. Councilman Prater
noted that he's heard that a lot. Mayor Baugh stated he'll check with the Building
Official the next day.
Mr. Hardester stated Planning and Zoning approved the specifications for Belmont
Plaza and he's not opposed to the Plaza, but to the roadway there because there's
only one road going in and about 100 families and the curve is a right angle and
streets are only 20 foot wide. Mayor Baugh asked when this was approved and City
Clerk Martinez replied last Thursday. Mr. Hardester stated the meeting was Thursday
and it was passed with two objections and four for it, and he assumes he was able
to get permits. Councilman Mitchum asked if that's the case and Mayor Baugh and
City Clerk Martinez replied they don't know. Councilman Mitchum asked if they can
put a hold on that until they look into it and Mayor Baugh replied they could if
permits haven't been issued until they get a ruling from the Attorney and find out
about the letter he just read that was signed by J. C. Carder. Mr. Hardester
submitted the letter for the record. Mayor Baugh requested a motion.
Councilman Mitchum moved they hold this decision up until such time as they look
into it and decide just exactly what way they need to go. Mayor Baugh asked if
it's to stop permitting and Councilman Mitchum replied to stop permitting.
Councilman Prater asked if the Attorney is in this and Councilman Mitchum replied
yes, and a meeting if they have to. Councilman Prater seconded the motion. Mayor
Baugh stated the motion is to stop it and get a meeting with the Attorney on this
document to see where they stand. Mr. Hardester asked if they can have represen-
tatives from Pelican Cove West and Mayor Baugh replied he doesn't see any objection
to a spokesman. Motion CARRIED 4-0. Mayor Baugh stated it will be stopped until
they get the input from the Attorney.
Jake Lodico spoke at length regarding the prior special election pertaining to
the City Manager. Mayor Baugh clarified a few points. Mr. Lodico stated that
when the Mayor was Police Chief, he was against a City Manager. Mayor Baugh
explained that with the growth of the City, they will need a City Manager.
Mr. Lodico spoke in more detail about electing a City Manager and the Mayor's
losing of powers when a City Manager is hired. Mr. Lodico referred to nepotism.
Mayor Baugh explained Council will hire a City Manager if the people vote for it,
and he suggested Mr. Lodico come into City Hall and review when it was removed
from the Charter.

MISCELLANEOUS (Continued) -
Lynne Plaskett, 412 South Myrtle, New Smyrna Beach, read a letter that City
Clerk Martinez sent to the Division of Arbitration Federal Mediation and
Concilation Services in Washington, D.C. that her firing is not a grievable
matter. She said after three months of waiting, she comes to Council to ask
they join with her to save taxpayers of Edgewater thousands of dollars in
court costs and attorneys fees by holding a public hearing regarding her case.
She said she's willing to. go to court but she doesn't think it's fair to the
people of Edgewater, herself, and to Council to do that. She asked that it
be done as soon as possible and said she wasn't prepared to go into details
at this time about her case. She said she wants Council to decide if her firing
is justified after they've heard all the facts. Mayor Baugh asked what she's
requesting and Ms. Plaskett replied she's requesting a public hearing on her
case. Mayor Baugh said he has no problem with that.
Councilman Prater moved they have a public hearing on her case on the next
meeting, January 4th. Mayor Baugh asked if they want it prior to the Council
meeting, and suggested it could be at 6:00. Councilman Prater included that
in his motion. Councilman Mitchum seconded the motion. Motion CARRIED 4-0.
COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES
City Council Reports - Councilman Rotundo wished all the people of Edgewater
a Merry Christmas and Happy New Year.
Councilman Prater joined him and wished all a Merry Christmas and a Happy New
Year.
Councilman Mitchum wished a Merry Christmas and a Happy New Year to everyone.
Jake Lodico referred to a previous incident which ended with "Keep it simple,
stupid."
Mayor Baugh wished everyone a joyous and happy Christmas.
Mayor Baugh displayed the certificate of appreciation received from the group
with "Wheels Across Florida". He stated he issued a proclamation for them
and met the lady and gentleman who went from Jacksonville to Miami. He gave
the certificate to City Clerk Martinez to display in City Hall.
Mayor Baugh stated he was advised by Mr. Ascherl, the agent for retirement,
that there have been some changes and the pension committee met for general
employees and they accepted Plan 2 which would be an increase, and they
recommended Council accept Plan 2 which gives an earlier retirement and an
accumulation of three years for retirement rather than ten years. He added
that he fully supports Plan 2. Councilman Rotundo asked about the increase and
Mayor Baugh replied they budgeted this year $135,000 in the retirement plan and
this plan only calls for $113,000, so they're overbudgeted. Councilman Rotundo
moved they accept this recommendation. Councilman Prater seconded the motion.
Motion CARRIED 4-0.
Mayor Baugh noted the Police Department did not get with the employees so they'll
get back to Council on the plan they feel best suits them.
Mayor Baugh referred to a personnel action for Larry Jarkovsky who was promoted
to Sergeant. He said he discussed it with the City At torney who was to give them
an opinion, but since he's not present, he'd like Council to table this until
they get an opinion and leave him at the same pay he's receiving now. Councilman
Mitchum requested more information. Mayor Baugh explained Larry Jarkovsky was
an Acting Sergeant, and his pay from Acting Sergeant to permanent Sergeant actually
decreased. He reviewed the figures, and said he asked the City Attorney if the
temporary position he was filling was his current pay step, or if it was his
regular patrol salary, since Acting Sergeant was a temporary position. He pointed
out it's not defined in the Merit Plan. Councilman Mitchum asked where he is
now and Mayor Baugh replied at $9.12 an hour and he's suggesting they leave him
at that until they hear from the Attorney. He requested a motion to TABLE this
until the Attorney gives him an opinion on it. Councilman Mitchum so moved.

City Attorney Reports - City Attorney Alvarez was not present at this meeting.
City Clerk Reports - City Clerk Martinez stated they have a bill from Dyer,
Riddle, Mills & Precourt that had to be paid by November 30th to qualify under
the DCA Grant for reimbursement. Mayor Baugh pointed out he'd approved the
payment to save the money. Councilman Prater moved they approve it. Councilman
Rotundo seconded the motion. Motion CARRIED 4-0.
Parks & Recreation Department's request to give Florida Power & Light Co. 10 ft.
easement for servicing Roberts Rd. Park (From Dec. 7, 1987 meeting) - City Clerk
Martinez read the December 16th memo from David Garrett, Recreation Director/
Buildings & Grounds Maintenance Superintendent. Mayor Baugh asked Mr. Garrett
if Florida Power & Light will maintain it and Mr. Garrett replied he believes
they'll maintain it and they reserve the right to cut and add to the easement.
Councilman Prater asked if the right of way would be better on 30th than on the
east end. Mr. Garrett replied it's a lot closer to the facilities on the east
end and it's already cleared with the swale and makes a straight line. He
added that the western boundary is in a low swampy area. Councilman Mitchum
asked if the swale is on the easement and Mr. Garrett replied yes, 7 foot wide
and about 12" deep, so there's no hazard with being in that swale area.
Councilman Mitchum asked if the Attorney cleared the legal and City Clerk Martinez
replied Dan Cory reviewed it, but it has to go to the Attorney for execution.
Councilman Rotundo moved they accept this request and send the necessary information
to our Attorney to proceed with this. Councilman Prater seconded the motion.
Motion CARRIED 4-0.
Fire Department's recommendation on bids for bunker gear - City Clerk Martinez
read the December 15th memo from Lt. Mike Cunningham, Equipment Officer for the
Fire Department. Councilman Rotundo asked what was wrong with the lowest bid and
Lt. Cunningham replied it did not meet specifications and didn't include suspenders.
Councilman Mitchum asked where the company is and Lt. Cunningham replied Orlando.
Councilman Mitchum asked about the one from New York and Lt. Cunningham replied
that's LaFrance. Councilman Mitchum asked about Biscayne and Lt. Cunningham
replied it's from Miami and there are shipping charges and delays if something
doesn't fit as they'll have to send them back and pay shipping charge and send
it to be altered, and with Orlando they don't have to pay shipping and they'll
deliver them. Councilman Mitchum asked if this is budgeted and City Clerk
Martinez replied no. Councilman Prater pointed out the difference is about
$439 between the bid he's requesting and the lowest bid. Councilman Mitchum
pointed out they can rule out the lowest bid because it doesn't meet spec's,
and he agrees with Lt. Cunningham's idea about serviceability and it's a lot
closer. Mayor Baugh stated that if the Miami bid meets spec's, he doesn't know
if they can use transportation to accept a higher bid. He added that he doesn't
want Council to be put in a position to defend something, and he requested they
table this to get the Attorney's opinion if they can accept their recommendation.
Councilman Rotundo moved they accept their recommendation as he's sure they talked
it over with the whole department. Mayor Baugh said he doesn't know if they can
accept it if a lower bid meets spec's. Councilman Mitchum noted that one meets
spec's but is in New York. Mayor Baugh suggested they get a ruling from the
Attorney about the lower bid being accepted as he wants to be on solid legal ground.
Councilman Rotundo withdrew his motion. Councilman Prater moved they TABLE this
for the Attorney's advice on this. Councilman Mitchum seconded the motion.
Mayor Baugh stated this can be for the next Council meeting. Motion CARRIED 4-0.
Mayor Baugh asked how long the bids are good for and City Clerk Martinez replied
each company varies. Mayor Baugh said they should be all right time-wise, and
they'll have an answer at the next Council meeting.
Industrial Development Board request to amend By-Laws - City Clerk Martinez read
the December 4th memo from Chairman Florence Baker requesting a change in the
annual election date of Chairperson and Vice Chairperson from May to January.
Mayor Baugh recommended they accept this and send it to the Attorney to make the
changes. City Clerk Martinez pointed out the By-Laws are the forming resolution
so they need a new resolution. Mrs. Baker stated they want their Board to conform
to other boards of the City. Councilman Prater moved they grant them permission
to do so and the Attorney to draw up the legal papers. Councilman Rotundo seconded
the motion. Motion CARRIED 4-0.

Industrial Development Board request to consider Capital Improvement Program
funds for City-owned Industrial park - City Clerk Martinez read the December
14th memo signed by Chairman Florence Baker. Mayor Baugh stated that he'll
take this request to the people on the C.I.P. Mrs. Baker stated they feel
an industrial park in a fast growing city is necessary and essential to bring
in new business and for expansion of existing businesses. Mayor Baugh stated
he'll discuss it with the City Attorney and people involved with C.I.P.
because he feels it's a worthwhile project.
Parks & Recreation Board's request to hold contest to name Roberts Road park -
City Clerk Martinez read the December 4th memo signed by Harry Montgomery,
Chairman of the Board. Councilman Prater asked what's wrong with Roberts Road
Park because it seems like a good name. Mr. Montgomery replied to win $50,
you have to put it in and they felt they can get the City involved, and the
$50 will come out of the Parks and Recreation budget for promotional activities.
Mayor Baugh agreed it could come from that or from Council promotional. Mayor
Baugh asked if it's school children or City-wide and Mr. Montgomery replied
it's open to everybody. Councilman Rotundo moved they accept the recommendation
from the Parks and Recreation Board. Councilman Mitchum seconded the motion.
Motion CARRIED 4-0.
COMMUNICATIONS
Department of Community Affairs re: funding assistance for certain elements of
Comprehensive Plan - City Clerk Martinez read her December 16th memo and noted
they need to accept or reject the offer of funds because they applied for the
grant. Mayor Baugh noted it's $21,240. Councilman Rotundo asked who would be
qualified to administer it. Mayor Baugh asked if the Planner would be. City
Clerk Martinez replied she's currently administrator of one they have. Mayor
Baugh noted they need to accept it and name the person. City Clerk Martinez
noted they have to authorize the City Attorney to draw up the resolution.
Councilman Rotundo so moved. Mayor Baugh stated it would be to accept it and
name City Clerk Martinez as she is now and have the City Attorney draw up the
resolution. Councilman Prater seconded the motion. Motion CARRIED 4-0.
Rudolph Almeida re: condition of West Turgot - City Clerk Martinez read the
December 12th letter. Mayor Baugh noted they've talked about this street for
a long time. Mr. Almeida said he saw in the paper it was to be paved and it's
a short street and there over 300 cars going by each day. He added that he
doesn't live on the street and doesn't care if the one he lives on is ever paved.
He referred to previous requests to Council regarding this street. He suggested
they could put a curb in or take the road down about 6". Mr. Almeida asked why
it was listed in the paper and Mayor Baugh explained on the projected list of
streets to be paved, they decided it would be on a priority, but paving is being
put on hold until the water and sewer programs are implemented. Councilman
Rotundo asked if Mr. Almeida would be willing to pay 1/3 of the paving and Mr.
Almeida replied he doesn't care as they can't put a price on a child's life,
and he'll pay his share. Councilman Rotundo noted they were waiting for the
School Board to give a hand but they never had a response. Mayor Baugh stated
he's meeting with School Board representatives the next day and he may be able
to bring this up then. Councilman Prater noted this was brought up before.
Mr. Almeida said he was thinking of putting some sand down.
Mayor Baugh requested they get figures from Mike Tenney to pave it and a price
from a contractor. He added there was nothing budgeted and it will have to
be an amendment.
Florida League of Cities re: 27th Annual Legislative Conference February 4 & 5,
1988, Tallahassee - Mayor Baugh stated he intends to go and asked if anyone
else wants to attend. Councilmen Prater and Rotundo replied they'll think about
it and Councilman Mitchum replied no. Mayor Baugh requested a motion to authorize
those wishing to attend to be able to go. Councilman Prater so moved. Councilman
Mitchum seconded the motion. Motion CARRIED 4-0.

COMMUNICATIONS (Continued) -
Mrs. Anthony Veschusio re: notice of holiday garbage collection - City Clerk
Martinez read the letter received December 4th. Mayor Baugh reviewed the
holiday schedules and noted a lot of people put their Christmas wrapping and
papers out to the street Friday morning and they stay there until Monday
morning and she's asking they tell people not to do it.
Robert Pfanner, Royal Palm, said Council is very lenient with time off to City
employees for holidays and trash collection is being delayed because Council
awards extra days off in addition to the holidays. He said he doesn't know any
other government or business that gives that much time off to the employees.
He asked how much it costs the taxpayers for the extra days off, over and above
the regular holidays. Mayor Baugh replied it's available at City Hall. City
Clerk Martinez pointed out the day after Thanksgiving is a legal holiday in the
union contracts. Mr. Pfanner asked why Council had to approve that Friday off
if it's a legal holiday and City Clerk Martinez replied they approve it when
they ratify the contract. Mr. pfanner asked how many holidays the employees
receive and City Clerk Martinez replied she thinks it's 10. She added that the
4 hours granted for Christmas Eve was the only time Council approved it. Mayor
Baugh said he doesn't remember approving the Friday after Thanksgiving at a
Council meeting but he'll check it. Mr. pfanner said he made four requests
to have holes repaired on Royal Palm because of the damage to the contents of
his motor home, and he was wondering why it takes so long to get something done.
Councilman Prater asked if it's black top and Mr. Pfanner replied no, and he
talked to them about four times and threatened the man he was coming to Council.
Mr. Pfanner stated they have too many employees or aren't getting the work out
of them. Mayor Baugh stated he'll check why it wasn't filled in sooner and
also the day after Thanksgiving.
Mayor Baugh and City Clerk Martinez reviewed the pick up schedule for Christmas
week.
Tom Sheridan, Florida Shores, said he's heard a lot of complaints and asked
who supervises the supervisors, and who has the responsibility for that action.
Mayor Baugh replied the City Clerk and him, since Council took the action.
Mr. Sheridan asked why the job isn't done and these things continue. Mayor
Baugh replied there may be an end to it when they get a City Manager. Mr.
Sheridan stated that's why the petition was circulated.
Shangri-La Homeowners Association re: sprinkler system for entrance - City
Clerk Martinez read her December 16th memo. She noted she sent this to the
City Attorney and he suggested it be sent to Council for their input. She
noted he probably should have input as to liability. Mayor Baugh questioned
where the well will be.
Dom Fazzone, 302 Paradise Lane, said they came to Council because Mr. Coleman
had been maintaining the entrance and shrubbery and grass and about nine months
ago he sold the last home and turned everything over to the City and since
that time, no one has been taking care of it except the home owners. He noted
that about 4 to 6 weeks ago the lights of the big sign were turned off and the
home owners are paying the bills of having to turn it back on. He stated the
shrubs and grass have deteriorated and he doesn't know where the City owned
property is, and he wants to put it on City property because they can't put it
on Coleman's lots as they belong to him. Mayor Baugh said he doesn't know where
they'll put the well and what the City's liability will be for putting a well on
City property. He pointed out the City is self-insured and asked who they'd sue
if someone hit the well, or who would have to replace it. He noted City water
is there now and asked why the Association doesn't use what Mr. Coleman used.
Mr. Fazzone replied someone would have to use it with a hose. Mr. Fazzone
briefly reviewed their plans for the sprinkler system. Mayor Baugh asked if the
lines would be under the road and Mr. Fazzone replied yes. Councilman Prater
asked about electricity to run the pump and Mr. Fazzone said he didn't check it
yet. Councilman Prater questioned where they'd get it from.

Shangri-La Homeowners Association re: sprinkler system for entrance (Continued) -
Mayor Baugh again stressed his concern for liability on the City's part. Mr.
Fazzone stated the Association will assume the responsiblitiy of putting the
well in. Mayor Baugh again asked about an accident as he thinks the City could
be responsible. He said if Coleman gave them permission to put it on his
property and run the lines across the City property, he wouldn't have a problem
with that. Mr. Fazzone stated they have two big signs in the front of the property
and most developers make the provision that the land is deeded to the homeowners
but with Shangri-La he made the entrance with two signs and part of it belongs to
the State and part of it is the City's. Mayor Baugh again said he wants to find
out the liability on the City's part and Mr. Fazzone agreed that's fair. Mayor
Baugh stated he'll get with the City Attorney to see where they stand on it.
William Ihrig, 408 Village Court, stated they need to do something about access
for people who come to the back because the retention pond is there and a car
was stuck there and they're using it for a bike trail. He noted it's School
property and their liability. Mayor Baugh stated he'll bring it up in his
meeting with the School Board representatives.
ORDINANCES AND RESOLUTIONS
Res. 87-R-54 Objection to oil drilling and exploration off Florida Coast - City
Clerk Martinez read this Resolution. RES. 87-R-54 - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, OBJECTING TO OIL DRILLING AND EXPLOR-
ATION OFF THE COAST OF FLORIDA AND THE FLORIDA KEYS WITHOUT A THIRTY-MILE BUFFER
ZONE; REQUESTING THE UNITED STATES CONGRESS TO OPPOSE PLANS FOR ANY SUCH DRILLING
AND EXPLORATION; AUTHORIZING DISTRIBUTION; CONTAINING A REPEALER PROVISION AND
PROVIDING FOR AN EFFECTIVE DATE. Councilman Prater moved they adopt Resolution
87-R-54. Councilman Rotundo seconded the motion. Motion CARRIED 4-0.

Councilman Prater seconded the motion. Motion
Selection of screening committee for recommendations on advisory board and
committee candidates (From Dec. 7, 1987 meeting)- Councilman Rotundo nominated
Dom Fazzone for this committee. Mayor Baugh nominated Wally Trickey. Mayor
Baugh requested a motion to add these two gentlemen and have the Attorney draw
up the necessary resolution. Councilman Prater so moved. Councilman Rotundo
seconded the motion. Members of the audience asked for information on this subject
and Mayor Baugh briefly explained action at a prior meeting. Motion CARRIED 4-0.

There was no New Business brought up at this meeting.

Mayor Baugh requested a motion to adjourn. Councilman Mitchum so moved.
Councilman Prater seconded the motion. Meeting was adjourned at 8:55 P.M.
