Mayor Baugh called the meeting to order at 7:00 P.M. in the Community Center.

INVOCATION, SALUTE TO THE FLAG
Rev. Sal Siano, Edgewater Alliance Church, delivered the invocation. There was
a salute to the Flag.
Mayor Baugh requested a motion to go from the regular meeting into the public
hearing. Councilman Prater so moved. Councilman Mitchum seconded the motion.

PUBLIC HEARING - SECOND & FINAL READING & ACTION:
Ord. 87-0-20 Amending Chapter 19, Utilities & Services, water and sewer rates -
City Attorney Alvarez read this Ordinance. ORD. 87-0-20 - AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 19, UTILITIES AND
SERVICES, ARTICLE II, WATER, SECTION 19-10(f); SECTION 19-14(a); SECTION 19-15(a)
AND (c)(l); ARTICLE III, SEWERS, SECTION 19-30(f) AND SECTION 19-35, AND ARTICLE
VII, WATER SHORTAGE CONDITIONS, SECTION 19-82 (4),a,b,&c; BY PROVIDING FOR AN
INCREASE IN THE WATER RATES TO A MINIMUM OF $4.00 FOR THE FIRST 2000 GALLONS OF
WATER AND $1.25 FOR EACH ADDITIONAL 1000 GALLONS; THAT THE MULTIPLE MINIMUM CHARGE
WILL BE INCREASED TO $4.00 FOR THE FIRST UNIT AND $3.50 FOR EACH ADDITIONAL UNIT;
THAT THE SEWER MONTHLY CHARGES WILL BE BASED ON 100% OF THE MONTHLY WATER CHARGES;
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE. He stated this is second and final reading before adoption. Mayor
Baugh asked for comments from the audience.
Mel Wargo, 2 Pines Edge Court, said in 1984 they were told there was a 40% under-
ground intrusion in the sewer system and the sewer was at 60% capacity. He said
if they increased the connection $700., that will be a 10% increase. He asked how
they justify an increase in water and sewer rates. He said he read in the papers
that the department head stated they were just putting chlorine in the water and
did not filter it. Mayor Baugh noted that they're out for bids now for the sewer
rehabilitation and they will be opened October 12th to redo the lines and seal
them so they don't have that intrusion.
Mayor Baugh asked for a motion to close the public hearing and go back into the
regular meeting. Councilman Asting so moved. Councilman Rotundo seconded the
motion. Motion CARRIED 5-0.
Ord. 87-0-20 - Councilman Asting moved to adopt the ordinance. Councilman Rotundo
seconded the motion. Motion CARRIED 5-0.
APPROVAL OF MINUTES
Regular Meeting of September 21, 1987 - Councilman Asting moved they adopt the
minutes of September 21st. Councilman Prater seconded and questioned who made
the motion on the last paragraph of page 4. Mayor Baugh replied it will be
researched and she can make the correction. Councilman Asting included that in
his motion. Councilman Rotundo agreed to accept that as his second. Motion
CARRIED 5-0.
Special Meeting of September 24, 1987 - Councilman Prater moved they adopt the
minutes of September 24, 1987. Councilman Rotundo seconded the motion. Motion
CARRIED 5-0.
Special Meeting of September 28, 1987 - Councilman Asting moved they adopt the
minutes. Councilman Prater seconded the motion. Motion CARRIED 5-0.

BILLS AND ACCOUNTS
Councilman Rotundo moved to pay these bills. Councilman Prater seconded the
motion. Motion CARRIED 5-0.
MISCELLANEOUS
Freeman Newell, South Ridgewood, asked what happened about the road that he
brought up two weeks ago. Mayor Baugh replied the letter was signed tonight
and it will be going to Dr. Smith of the School Board, and it is as the motion
was made, demanding it be removed. Mayor Baugh added that he'd received a call
from Mr. Nadal that evening and he knows the letter is coming and they'll have
some word back.
Tom Sheridan, Florida Shores, said two weeks ago a letter was directed to be
written to Ron Austin rejecting his resignation. He asked if there's been a
response to that letter. Mayor Baugh replied the letter was mailed out. Mr.
Sheridan asked why it takes so long. Mayor Baugh replied it was drafted in
City Hall and he didn't like the way it was drafted and he met with the City
Attorney and wrote up another letter to Mr. Austin.
Mr. Sheridan stated that recently a Police cruiser was involved in an accident.
Mayor Baugh said he has an accident report on it and he found out about it in
the insurance committee meeting. Mr. Sheridan asked why this wasn't made public.
Mayor Baugh replied that he doesn't know. Mr. Sheridan stated that someone should
have told them about it. Mayor Baugh noted that Port Orange wrote it up. Mr.
Sheridan stated that taxpayers are buying the equipment and when something happens
to it, they should know about it. Mr. Sheridan asked who makes the determination
when a vehicle has to be traded on a new one. Mayor Baugh replied that the
Department Head makes the decision. Mr. Sheridan asked if they're qualified to
make the determination. Mayor Baugh replied that it should be the Department Head
along with people who do the service work on it. Mr. Sheridan asked if there's a
record of mileage and Mayor Baugh replied yes, at the City barn.
Bob McIntosh, Beach Trust Commission representative, requested that Council hold
a public hearing on the adoption of the draft of the Unified Beach Code that the
Trust Commission has worked on for six months. He noted that they're under a time
restraint to get it back to the County Council. He said they're holding a meeting
this Thursday evening and at that time the draft will be changed. He added he'd
get a copy available sometime Friday for Council to look over. He pointed out
that the public hearing is not a requirement for Council to make a determination
but is open to the public for comments. Mayor Baugh noted all cities are holding
these and Mr. McIntosh agreed. Mayor Baugh asked if he can get a copy on Friday
as Council should have a chance to look at it and see the wording. He asked
Council to check on Friday to see if it's here. There was discussion about
available dates next week and Mayor Baugh expressed his concern that they have
enough time to review it. He stated he'd call a special meeting for Monday night
and if they don't get the paper work or the draft, they'll cancel it for Monday.
Harold Hardester, 817 Egre t Court, asked if they'd changed.the organizational chart
for the City employees. Mayor Baugh replied not that he knows about. Mr.
Hardester reviewed the chart, and asked if Code Enforcement is on the bottom of
the list. Mayor Baugh replied all departments are equal regarding where they stand.
City Clerk Martinez pointed out that the paper isn't wide enough to spread that
many departments across it, and it was listed that way by the auditing firm. She
noted that none of the departments are in charge of the department on the bottom.
Mr. Hardester asked if Code Enforcement is over Planning and Zoning and Mayor Baugh
replied no. Mr. Hardester asked if Code Enforcement is over the Planning and Zoning
Department, and City Clerk Martinez replied function-wise yes, but budgetarily no.
Mr. Hardester referred to an article in the paper regarding Dennis Fischer being
the supervisor of Lynne Plaskett. City Clerk Martinez agreed that was true when
she was initially hired. Mr. Hardester asked about when she was terminated and
City Clerk Martinez replied she was the immediate superior.
Mr. Hardester stated that local newspaper headlines the past several weeks indicate
serious internal personnel problems and the employees are definitely afraid of
losing their positions if they make any comments on the Ron Austin or Lynne Plaskett
case. He urged Council to bring in a group of efficiency experts to deal specif-
ically with the problems they're faced with.

MISCELLANEOUS (Continued)
Frank Opal, Florida Shores, referred to communication between the Planning
and Zoning Board and Council. He said Council adopted an ordinance last
year to overturn any decision made by the Board. He said they don't need a
Planning Board or Board of Adjustment or Merit Board. He said the Merit Board
is operated by the City Clerk, and they should get rid of her. Mayor Baugh
pointed out that the City Clerk is not even a member of that Board. Mr. Opal
said he attended a lot of the meetings and she ran them. and she probably still
does.
Mr. Opal referred to a man in back of him who was draining the lake to water his
lawn, and the first thing they asked him for was to sign a complaint. He showed
a book to City Attorney Alvarez of "How to Sue and Win". He advised the Mayor
to get rid of the Planning and Zoning Board and start from scratch.
Mel Wargo, Pines Edge Court, stated that there was an ordinance stipulating that
storage barns could only be used as storage barns and asked if it's still in
effect. Mayor Baugh replied as far as he knows. Mr. Wargo said there are still
problems with storage barns and yesterday they got an airplane builder there, and
they've had spray painting, people living there, and wild parties with garbage
thrown allover. He said they need to start enforcing the laws, and the same
thing is happening in some of the other places. He added they've had gambling
joints in some of these storage places. He said a man has 3 pit bulls and he
called the Animal Control Officer and she advised him she can't do anything
because he was issued a kennel license. He asked how they can have a kennel in a
storage barn. Mayor Baugh asked who issued it and Mr. Wargo replied that the
Deputy City Clerk issues the permits. Mr. Wargo said they've had an ongoing
garage sale for three months.
Mr. Wargo said he was told the signs out front are trailer signs and there's a
three-month permit for trailers and you can only have two permits a year. He
said he counted 54 of these signs throughout the downtown area and everyone who
opens a business does it. He spoke on the potential dangers of these signs.
Mr. Wargo said he called the Police Chief when he came into office about the lot
clearing outfits going along Park Avenue with no cover and no mud flaps, and he
told him it would be taken care of, but it's gotten worse and not better. He
stated that our City truck does not have mud flaps on it and the law in this state
requires it. He said he was told in the Code Enforcement Department that they
have to come down and sign a complaint, and he understood when they hired Code
Enforcement, he would go around town and do these jobs, and not throw it on the
citizens. He said it's time to enforce the laws and codes and ordinances in this
town.
John Scherz, 905 Egret Court, stated that people have to buy water at Eckerd's
and now the City is going to charge higher rates when the water isn't fit to drink.
He said they should closely watch the lift stations that will be needed with the
developments.
Mr. Scherz stated that the City Charter has Planning and Development and he was
told Code Enforcement is in that deparmtent as well as the Building Inspection.
He referred to a recent conversation with Dennis Fischer when he advised he didn't
know any more than Mr. Scherz did about the Lynne Plaskett incident. He referred
to a recent incident regarding the requirement for portalets.
Mr. Scherz stated they're interested in the government but they have
issues to get cleared up before they talk about 22 million dollars.

Mr. Scherz referred to the status of Pelican Cove roads, as he was told they
were taken over by the City but he can't find any paperwork on it. He said they
repair the roads when they aren't picking up garbage on Wednesdays, and the
builder repaired the roads also. He said it was a crime the way situations
were handled recently.

MISCELLANEOUS (Continued) -
Bill Klein, 2910 Needle Palm, presented a list of questions and asked the Mayor
or Council to respond. He added that some have legal points. He thanked the
people who came to this meeting, and noted that there is approximately only 40%
of the people who live here who are registered voters.
Mr. Klein read the following questions: Where did the title of City Clerk/
Administrator come from? Who gave the City Clerk/Administrator the powers she
has? Is Mrs. Martinez the City Clerk, and if so, why is Sue Koser sitting in
the back taking notes? Why does she not perform the duties of the City Clerk?
Is the City Clerk also the Finance Director? If she is Finance Director, then
what is Karen Rickelman, as it seems she does all the work on the budget?
Is the City Clerk/Administrator also the Personnel Officer of this City? If she
is the Personnel Officer, then why does she go to Merit Board meetings? What
kind of government do they have, and who really runs this City? Why do the
Mayor and Council allow the City Clerk/Administrator to run the entire City
without any supervision from the Mayor or the elected officials of the City?
He said they get into it some, but he's asked everyone at some time and they
said they don't know anything about it, and it's poor communications. He asked
if the Mayor had been told about the wreck in Port Orange and Mayor Baugh
replied no, but he found out about it when he went to an insurance meeting.
Mr. Klein then asked for an interpretation if it's legal according to the Charter
to have the City Clerk/Administrator? He added that it's not personal. He
asked how one person has 4 or 5 titles when there's no provision in the Charter
for this to be? He said about 4 years ago they voted not to have a City Manager
but do they have one now in disguise? He asked that the City Attorney and Mrs.
Martinez furnish to the Councilmen and Mayor a written answer to these questions
for the next City Council meeting.
Mr. Klein stated that many people have passed a petition for a City Manager to
be reinstated. He said the budget is over 6 million and there will be 14 to 20
million spent on the capital improvement program, and he thinks it's time they
make a change in this City. He noted that it's not his petition, but one from
the people, and he'd like to be put on the agenda for the next Council meeting
in two weeks. Mayor Baugh replied he will be.
Mr. Klein referred to a newspaper report that Mrs. Martinez said a degreed person
would cost the City $30,000. He asked her salary. Mayor Baugh replied it's
$28,000. Mr. Klein said people think she's making $14,000 or $15,000 and he
asked if the $28,000 includes the $2,000 for the insurance committee. Mayor
Baugh replied it's plus that. Mr. Klein said he'd like that printed in the paper
because people think they'll have to spend a lot of money for a degreed person
and her salary is already $30,000.
Mr. Klein stated he read in the newspaper that the City Clerk accepted $80 in
payment of City tires. He asked who authorized her to sell City property.
Mr. Klein then asked to be allowed to speak under item 6.E. when it comes up.
Mayor Baugh advised Mr. Klein that the City Attorney will have the answers for
the next Council meeting. Mr. Klein asked if they'll be from Mrs. Martinez also
and City Clerk Martinez replied yes.
James Hatfield, 236 Old County Road, stated that 3 or 4 years ago four of the
Council doubled their salaries and he asked what they're giving back to the City
for the doubled salaries. He said they also voted themselves an insurance policy
and asked what difference Council is from him. He then referred to the newspaper
article about a City Manager costing a lot of money to replace her, or whatever
job he's assigned to, and he reviewed how the budget has increased since this
Council took office. He said they spend money for the Library, for recreation,
and for Police, and it isn't the priorities he thinks it should be. He asked
if Council is worth more than he is to warrant doubling their salaries and
increasing their life insurance.

MISCELLANEOUS (Continued) -
JoAnne Sikes, 125 East Palm Way, stated she's been a City employee for almost
22 years and has worked under Mrs. Martinez for many years. She said she's
watching this be "Fry Connie Martinez Night" and those who work under her don't
say she doesn't make mistakes and she's not perfect, but the only perfect person
was crucified, which is what they're doing to her tonight. She said the area
is growing and there will be a time when they'll need more administrative help
but all they do is fuss and complain and they've never tried to work in her shoes.
She said for many years she was ashamed to say she lived in Edgewater, and worse
was to say she worked for the City of Edgewater, but for about 3 years she was
very proud that this Council worked together and pulled together under the
direction of those working in the office. She stated these men couldn't function
without people like Karen Rickelman, Connie Martinez, Sue Koser, and Debbie Sigler.
She read the inscriptions from the plaques hanging in the City Clerk's office
which were received for awards the last 4 years for financial reporting achievement.
She noted that the budgets have kept growing but it has been handled, and that
can be checked with the auditors. She said she's not afraid or ashamed to speak
as an employee and she doesn't know anyone else who will be. She said she's
making these statements in support of Connie Martinez from the City employees.
COUNCIL/OFFICERS REPORTS, BOARDS AND COMMITTEES
City Council Reports - Councilman Rotundo stated that he gave Council a copy of the
figures presented by David Garrett for a bike path on 442, Indian River Boulevard.
He asked Council's authority to go ahead with the Attorney to procure rights of
way and he made that a motion. Councilman Asting seconded the motion. Councilman
Mitchum asked if this is just a cost estimate prepared by David Garrett and
Councilman Rotundo replied yes. Councilman Mitchum asked if they'll go out for
bids and Councilman Rotundo replied yes. Councilman Asting said they have funds
in the recreation fund, and that money can only be spent for recreational purposes.
Motion CARRIED 5-0.
Councilman Prater stated that until something is settled with the petition, he
moved that the City Clerk obtain the Mayor's approval for all decisions and the
Mayor to report to the City Council on the same. Councilman Mitchum seconded the
motion. Motion CARRIED 4-1. Councilman Asting voted NO.
Councilman Asting stated for the record that during the period July 27th to about
August 15, 1987, a number of misuses of City materials and labor occurred on a
private vehicle owned by a City supervisor. He said the misuses of City materials
and labor were a direct violation of the City Employees' Code of Conduct, which
calls for the immediate discharge of the person involved. He stated that when
the violations were reported to the City Clerk/Administrator, all Council members
were notified and his reply to her was that a resignation would be acceptable to
him, and he understood that other Council members went along with this. He added
that resignation was submitted August 17, 1987, two days later. He said on
September 2nd the resignation came before the Council and on a move by Councilman
Mitchum, the matter was tabled, and it came before Council again on September
21st, when he moved that the resignation be accepted. He pointed out that motion
was defeated 3-2. He added that Councilman Mitchum moved not to accept the
resignation and his motion carried 4-1, and he also directed that a letter be
prepared stating that the employee would always be welcome to work for the City.
He said this was a man who misused City materials and labor. City Attorney Alvarez
clarified this was allegedly, and Councilman Asting agreed it was allegedly.
Councilman Asting added that the vote not to accept the resignation condones
wrong doing by the Council and leaves the door open for his reappointment.
Councilman Mitchum stated that during the past week he was aware of one rumor
that's been going around and the rumor was attributed to him and it was going
around City Hall that he was going to make a motion tonight to fire Connie Martinez.
He said that he doesn't know where that notion came from and he's appalled that
it would get started. He said he's more appalled that it could interrupt things
at City Hall and such a frivolous rumor could spread to such wide proportions.
He stated that if they want to know something, they should go to the source.
He apologized to anyone who took that wrong because he never made such a state-
ment and he doesn't like being used in that type of situation. He said he's
made no bones about being for a City Manager form of gover~nt, but he won't be

for it at the crucifixion of someone or will he have rumors attributed:to him that he
has nothing to do with. He cautioned those City employees who spread that same
rumor and stirred this thing up to keep a lid on it and find out what's going on
and it shouldn't happen again about something that doesn't even exist.

City Council Reports (Continued) - Mayor Baugh stated that Council has asked
him to check in City Hall and he'll make more time available to being in City
Hall and he'll be requesting certain things be done. He said there were certain
things he didn't know about but he'll find out about them. He advised the
audience he'll make more time available in City Hall and he hopes he can keep
the Council informed by memo.
City Attorney Reports - City Attorney Alvarez had no report at this time.
City Clerk Reports - City Clerk Martinez read her September 30th memo requesting
approval to request the maximum funds available through the Community Develop-
ment Block Grant programs for the next three years. Councilman Asting so moved.
Councilman Mitchum seconded the motion. Motion CARRIED 5-0.
City Clerk Martinez stated that the City Clerks' Institute is going to be held
November 11-13 in Jacksonville and she's requesting Council authorization to
attend. She read her September 30th memo which had itemized the" expenses.
Councilman Rotundo moved they grant this request. Councilman Asting seconded
the motion. Motion CARRIED 5-0.
Police Chief's Request to enter into agreement with Halifax Humane Society of
Volusia County, Inc. - City Clerk Martinez read the September 28th memo from
Chief Lawrence Schumaker and noted they have a copy of the agreement. She
said this is the same contract language as they adopted last fiscal year except
the dollar amount has changed. Mayor Baugh asked the contract amount last year
and Chief Schumaker replied it was $26. Mayor Baugh noted it's $32. this year.
Councilman Asting moved they enter into the agreement with Halifax Humane Society.
Councilman Rotundo seconded the motion. Councilman Mitchum asked why they don't
have an agreement with the New Smyrna Beach Humane Society. Chief Schumaker
said about l~ years ago they met with them and certain provisions were put to the
City at that time that the City did not feel they could accept. He added that
they were being billed for animals they didn't take to the facility, and the City
was told to meet their demands or find somplace else. He said they were paying
upward of $14,000 for New Smyrna Beach and it's about $10,000 with Halifax,
and he's talked with Mr. Buck who has indicated the increase was due to capital
improvements and he didn't expect this type of increase next year, so they can
probably enter into the same one next year. Councilman Mitchum asked if we
checked New Smyrna Beach this year and Chief Schumaker replied no. Motion
CARRIED 5-0.
Police Chief's Request to purchase three (3) non-pursuit vehicles under County
bid - City Clerk Martinez read the September 30th memo from Chief Schumaker.
Councilman Asting moved to grant the request. Councilman Prater seconded the
motion. Councilman Asting asked if these will be used by the Detective division
and Chief Schumaker replied yes and an administrative car. Motion CARRIED 5-0.
Assistant Recreation Director/Buildings & Grounds Maintenance Superintendent's
recommendation on bids for four (4) racquetball courts for Roberts Road Park -
City Clerk Martinez read the September 30th memo from Jack Corder which
recommended accepting the lowest bid received and which meets all specifications
from New Smyrna Beach Construction Company in the amount of $32,957. Mayor
Baugh asked how they arrived at that figure and Mr. Corder replied that there
was included an additional $460 for paint, and the original figure was $30,397.
with $2,100. added. Councilman Asting asked if this is a reliable firm and
Mr. Corder replied yes, and they built racquetball courts at the New Smyrna Beach
Middle School.
Mr. Bill Klein came forward and said he wasn't opposed to the equipment but he'd
like clarification of when they appointed an Assistant Superintendent for
Recreation. Mayor Baugh replied it was February of this year at the Merit
Board's recommendation. Mr. Klein asked how many work in that department
and Mr. Corder replied 8. Mr. Klein stated they have a director and an assistant
to supervise 6 people. Mayor Baugh noted that Mr. Corder takes over in Dave
Garrett's absence. Mr. Klein stated that they're asking for a secretary in the
new budget also.

Assistant Recreation Director/Buildings & Grounds Maintenance Superintendent's
recommendation on bids for four (4) racquetball courts for Roberts Road Park
(Continued) - Councilman Rotundo said that Jack Corder's duties come after
working hours and that's why they need an assistant as Dave Garrett can't spend
24 hours a day, and Jack goes out there for the different sports.
Tom Sheridan stated he was athletic director for 3 years with a school of 1,600
and he had two assistants and did an adequate job. He said this overloading is
what is creating a 6 million dollar budget. He added that this department is
mowing grass with a front end loader. He asked why they don't cut the budget and
cut the excessive spending, as they can't continue to pay taxes with raised taxes
every year. He said it's ridiculous to have two men supervising six.
Councilman Asting moved they award the bid to the lowest bidder. Councilman
Mitchum seconded the motion. Motion CARRIED 5-0.
Assistant Recreation Director/Buildings & Grounds Maintenance Superintendent's
recommendation on bids for restroom facility for Roberts Road park - City Clerk
Martinez read the September 30th memo from Mr. Jack Corder recommending they
accept the bid from the lowest bidder, Christine F. Simmons Building Contractor,
in the amount of $26,950. Mayor Baugh asked about this contractor and Mr. Corder
replied that they have several houses throughout Florida Shores and have the
required licenses. Councilman Asting moved they grant the request. Councilman
Prater seconded the motion. Motion CARRIED 5-0.
Finance Officer's Request to pay certain vendors on monthly basis - City Clerk
Martinez read the September 24th memo from Finance Officer Karen Rickelman
requesting authorization to pay the following vendors on a monthly basis for
the upcoming fiscal year: Florida Power & Light; Southern Bell; A T & T; South
Florida Natural Gas; City of Edgewater; Pitney Bowes; and City Attorney's retainer.
Councilman Rotundo moved they grant this request. Councilman Prater seconded the
motion. Motion CARRIED 5-0.
Finance Officer's request to continue purchase of gasoline from R. E. Morris &
Sons - City Clerk Martinez read the September 24th memo from Finance Officer Karen
Rickelman requesting authorization to continue purchasing gasoline from R. E.
Morris & Sons under the present arrangements at State bid prices with a dis-
count from the company. She added that the purchases are made regularly and in
excess of $2,000. Councilman Prater moved they grant her the request. Councilman
Rotundo seconded the motion. Motion CARRIED 5-0.
Finance Officer's request re: rental of City Hall and donations to Edgewater
Volunteer Fire Department - City Clerk Martinez read the September 29th memo
from Finance Officer Karen Rickelman requesting something in writing regarding
the fee for rental of City Hall offices to the Water and Wastewater and Refuse
Collection fund. She also suggested an amendment to section 13-56 of the Code
to reflect the increased amount to $150. per quarter as the donation to the fire
department. Councilman Rotundo moved they grant this request. Mayor Baugh asked
if it's to instruct the Attorney to draw up the necessary papers and Councilman
Rotundo replied yes. Councilman Asting seconded the motion. City Attorney
Alvarez clarified that he'll check to see if it's necessary. Motion CARRIED 5-0.
Merit Board's recommendation to extend merit scale through alphabet, and to
award increase to those off scale if evaluation warranted it - City Clerk
Martinez read the September 24th memo from the Merit Board. Mayor Baugh asked
how far it goes now and City Clerk Martinez replied it's step J.
Jack Spencer, 2604 Victory Palm, stated that he was involved when this Merit
Plan was set up and the merit increase to a limit of J was the intent at the
time, and merit increases were to be awarded to those employees who improved
their job performance and it was not intended to be an automatic increase. He
said the top limit was for a particular job and the top level was intended to
be competitive in this area. He said it sounds like they're requesting an
extension through the alphabet so an employee who has done very well will be able
to have farther increases on top of any cost of living increase the City authorizes.
He stated that he doesn't think that's right and there needs to be a top limit and
if an employee gets to that level and stays there, then that's the top rate for that
job and if the skills improve, he should be able to move to a different job with
higher pay. He requested Council not to extend the merit increase.

Chuck Chamberlin, Public Works, asked what a man will do if there is no other
job to go to. He said he's entitled to go farther than a J.
Mel Wargo said they got 6% this year plus a 4% merit and they have a 30% fringe
benefit over and above all that.
Councilman Asting moved they TABLE this for further study. Councilman Mitchum
seconded the motion. Councilman Rotundo asked how many people are involved
in this and City Clerk Martinez replied there are 5 currently off the scale.
Mayor Baugh said he's aware of a couple of them and he's not for going through
the alphabet but for giving them an increase.
Jack Corder stated the reason for this is they have people who have been with
the City for 10 years and in 10 years they'll reach step J if they have the
evaluation each year, and then they have no 4%. He added that if Council should
decide on no cost of living they would get nothing and it's not right for a
person who's been here that long to be punished. Mayor Baugh stated he's not
against going up but he is against going up the alphabet.
Motion to TABLE CARRIED 4-1. Councilman Rotundo voted NO. Mayor Baugh asked
for more information to be brought up at the next meeting.
COMMUNICATIONS
Coronado Paint Company re: resurfacing with concrete part of Old County Road -
City Clerk Martinez read the September 18th letter from Mr. David Dill, Operations
Manager, advising they would contribute $15,000. toward the estimated cost of
$27,548 to resurface with concrete approximately 21,375 square feet of Old
County Road. Councilman Rotundo stated this is in zone 1 and he understands the
proposal is they're willing to pave just in front of their company and not from
Park to Ocean. He pointed out they use it every day with those big trucks and
he thinks they should pay for the whole road. He added that he realizes they
have no money budgeted for this. Mayor Baugh agreed because they have the big
trucks using it. Councilman Rotundo moved to TABLE this for further study.
Councilman Prater seconded the motion. Motion CARRIED 5-0.
Mayor Baugh stated he'll call David Dill and see if he can meet with him and the
attorney to talk about this and explain our side of it and then he'll report back
to Council. Councilman Rotundo agreed. Councilman Asting asked that they be
told there's no money budgeted. Councilman Prater suggested it could be like
the County did with Mango Tree and going 50/50 all the way.

A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
He stated this is the recommendation from the last meeting of the Planning and
Zoning Board. Councilman Prater moved they adopt Ordinance 87-0-22. Councilman
Mitchum seconded the motion. Motion CARRIED 5-0.
