MINUTES
CALL TO ORDER
Mayor Baugh called the meeting to order at 7:00 P.M. in the Community Center.

INVOCATION, SALUTE TO THE FLAG
Reverend Steve Odom, Edgewater Baptist Church, delivered the invocation. There
was a salute to the Flag.
APPROVAL OF MINUTES
Regular Meeting of May 18, 1987 - Councilman Mitchum moved to approve the minutes.
Councilman Prater seconded the motion. Motion CARRIED 4-0.
BILLS AND ACCOUNTS
Councilman Prater moved to pay the bills and accounts. Councilman Rotundo seconded
the motion. Motion CARRIED 4-0.
City Clerk Martinez stated there's a supplemental bill from the Department of
Elections. She explained that she'd ordered voter registration lists and didn't
realize there's a charge so didn't get a purchase order. She noted that the
total is $60.18. Councilman Mitchum moved to pay it. Councilman Prater seconded
the motion. Motion CARRIED 4-0.
MISCELLANEOUS
Charles Brummett, Commander of American Legion Post 285 and a resident of Needle
Palm, presented a Certificate of Appreciation in recognition of outstanding service
from the City to contribute to the American Legion program. He then presented a
new flag for the Community Center and asked to retire the old one. Mayor Baugh
thanked him. Mr. Brummett then requested a retirement, or flag burning, ceremony
for Saturday, June 13th, at Menard Park. Mayor Baugh asked if it's been adver-
tised for other people to bring in the flags and Mr. Brummett replied that it
will be in the paper next week.
City Attorney Alvarez arrived at the meeting at this time, 7:06 P.M.
Mayor Baugh requested a motion to have the flag burning on Saturday, June 13th.
Councilman Rotundo so moved. Councilman Prater seconded the motion. Motion
CARRIED 4-0.
Bob McIntosh, Sabal Palm, gave a brief report on the status of the Beach Trust
Commission. He pointed out some of the traffic free barriers have been removed
from Daytona Beach and the Shores as a result of their recommendation. He said
they're looking at rules and regulations and mobility of traffic on the beaches,
and they're making steady progress. He added that they'll hold public hearings
on what will be adopted around August and September. Mayor Baugh stated that he's
doing a great job.

City Clerk Reports - City Clerk Martinez stated they have a memo from Karen
Rickelman regarding returned checks. She suggested they turn it over to the
City Attorney to adopt State Statutes 166.257 and include in the same reso-
lution, or perhaps an ordinance, if the City Attorney desires. City Attorney
Alvarez noted this resolution is from way back and it will have to be reviewed.
City Clerk Martinez said she'd like to include authority for the City not to
accept any more checks from a person who's given them an insufficient funds
check. Mayor Baugh pointed out there have been situations where an individual
may have insufficient funds one time and there could be a problem with the bank.
City Clerk Martinez noted that if they bring a letter from the bank, they
don't count it. There was discussion about flagging the accounts and pro-
visions for first time offenders and for repeaters. Councilman Prater suggested
they go along with the Attorney to bring back to them. Councilman Rotundo
seconded the motion. Motion CARRIED 4-0.
Councilman Rotundo stated that he's been getting calls on the water in Florida
Shores. There was a discussion among the Council members about the problems
about two weeks ago. Mayor Baugh suggested they invite Terry Wadsworth for the
next Council meeting. Councilman Mitchum stated he'd had complaints about
pressure and discoloration, and he has a test in his possession that was unsat-
isfactory, but the tests were not under ideal situations. Mayor Baugh suggested
that Terry Wadsworth bring a report on these items. Councilman Prater noted
that last week he had some water that was more like beer from a tap.
Councilman Rotundo stated that on Indian River Boulevard the grass wasn't cut
and the children were walking on the road with bicycles. He suggested they
pursue a bike path along Indian River Boulevard. He said they worked on it
before and there was a problem with easements. Councilman Mitchum pointed out
they talked before about cutting grass along Indian River Boulevard and Council
decided not to mow, but to call the State. Mayor Baugh noted that they've cut
it once. Mr. Ron Austin, Public Works Superintendent, said the City cuts it on
the east end of Indian River Boulevard. There was further discussion about
the looks of the median strip. Mayor Baugh asked Mr. Austin to call again to
see when they'll be here to mow.
Recreation Director/Buildings & Grounds Maintenance Superintendent's request to
go out for bids for new floor for Community Center, kitchen, and restrooms -
City Clerk Martinez read the May 26th memo from Mr. David Garrett. She stated
that $3,600 was budgeted for this item and the floor is pulling up and it's
a safety problem. Councilman Rotundo moved to grant this request. Councilman
Prater seconded the motion. Motion CARRIED 4-0.
Public Works Superintendent's recommendation on bids for hydraulic lift and
3-reel heavy duty lube system with pump - City Clerk Martinez read the May
26th memo from Mr. Ron Austin recommending the lowest bid from Counts Supply
for an adjusted amount of $8,000. She noted that the initial bid was changed
with an increase in the trade in allowance. Mayor Baugh pointed out there was
an error on the part of the bidder. Councilman Prater moved to grant him this
request. Councilman Rotundo seconded the motion. Councilman Mitchum asked if
there was only one bid and Mr. Austin verified that was the only bid received.
Councilman Mitchum asked the procedure for mailing bids and Mayor Baugh explained
it for him. Mr. Austin said there was a list of about 15 different bidders.
Motion CARRIED 4-0.
Public Works Superintendent's recommendation on bids for additional bathrooms
and shower - City Clerk Martinez read the May 26th memo from Mr. Ron Austin
which recommended the lowest bid from John Griswald for a total cost of $5,000.
She noted that the original bid was for $5,800., which was over the budgeted
amount, but Mr. Griswald agreed to allow the Public Works Department to
demolish the partitions and will bring it down to $5,000., the budgeted amount.
Councilman Rotundo asked if that's in writing and Mr. Austin replied yes.
Councilman Rotundo moved to grant this request. Councilman Prater seconded the
motion. Motion CARRIED 4-0.

Public Works Superintendent's recommendation on bids for addition to building -
City Clerk Martinez read the May 26th memo from Mr. Ron Austin recommending the
bid on the new office building go to the lowest bidder, Art Lloyd, at a price
of $29,800. Mayor Baugh asked the budgeted amount and Mr. Austin replied it's
$32,000. Mayor Baugh commented on the difference in the bids. Councilman Prater
moved to grant Mr. Austin his request. Councilman Rotundo seconded the motion.
Councilman Rotundo asked if this man is local and Mr. Austin replied yes. Motion
CARRIED 4-0.
Public Works Superintendent's request to purchase two bush hog mowers -City
Clerk Martinez read the May 27th memo from Mr. Ron Austin requesting permission
to purchase two bush hog mowers at a cost of $2,800. from the Federal Revenue
Sharing. She pointed out it's over $2,000. but under the $3,000. for the bid
requirements. Mayor Baugh asked if these will fit the equipment and Mr. Austin
replied yes. Councilman Mitchum asked if it will fit Dave Garrett's tractor
and Mayor Baugh replied these are too big for the other tractors. Councilman
Mitchum asked what they'll be used for and City Clerk Martinez replied to cut
the grass along the side of the road. Councilman Rotundo moved to grant the
request. Councilman Prater seconded the motion. Motion CARRIED 4-0. Mayor
Baugh asked if it's in Federal Revenue money and City Clerk Martinez replied yes.
Utilities Superintendent re: emergency repairs to Florida Shores elevated water
storage tank - City Clerk Martinez read a portion of the May 26th memo from
Mr. Terry Wadsworth. She noted she'd discussed this repair with Mr. Wadsworth
and due to the emergency, they decided to do it. Mayor Baugh pointed out that
she'd contacted the other Council members except him, and he was out of town.
Councilman Rotundo moved to pay this bill. Councilman Prater seconded the motion.
Motion CARRIED 4-0. Mayor Baugh suggested the refilling could be a part of the
other problems and Councilman Prater agreed he'd thought of that.
COMMUNICATIONS
Volusia County P.E.A. and S.P.E.A. and Coastal Florida P.B.A. request to begin
labor negotiations - City Clerk Martinez stated they have requests from the
Associations requesting the beginning of negotiations for General Employees,
Supervisors, and the Police Association for the labor agreements. She pointed
out this is for the new contracts and a negotiator has to be named to handle
the negotiations, or a negotiating team. Councilman Rotundo said he called Jim
Inman, who was the negotiator previously, and he'd like to do it again. Councilman
Mitchum asked how soon this has to be done and City Clerk Martinez replied the
letter states as soon as possible. Councilman Rotundo made that in the form of
a motion. Councilman Prater seconded the motion. Mayor Baugh asked if more
people should be on it. Councilman Rotundo amended his motion to include the
City Attorney and Councilman Prater agreed to the amendment as the second to the
motion. Amended motion CARRIED 4-0. City Clerk Martinez asked if there
would be a charge for his negotiating services and Councilman Rotundo
replied whatever expenses, such as if they have to go out of town, they'll get
mileage. Mayor Baugh asked that he be contacted to see if there's a fee and
bring it back at the next meeting. Motion CARRIED 4-0. City Attorney Alvarez
asked for clarification of members of the team and Mayor Baugh replied it's
just the two, and the City Clerk could sit in, but not as a negotiator, just to
record or to clarify, and the two will be the negotiators. Councilman Rotundo
agreed.
ORDINANCES AND RESOLUTIONS
Ord. 87-0-13 Amending residential and commercial permit, electrical permit,
mechanical permit, plumbing permit, zoning application, special exception and
variance, and subdivision preliminary plat fees - City Attorney Alvarez read this
Ordinance. ORD. 87-0-13 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA, AMENDING CHAPTER 7, ARTICLE II, SECTION 107.4(a) and (b)(1),(2),(3),and (4);
ARTICLE III, SECTION 7-65; ARTICLE VI, SECTION 7-154; ARTICLE VII, SECTION 7-236;
APPENDIX A, ZONING, SECTIONS 715.05, 1000.01,1001.01,1002.01 AND APPENDIX B, SUB-
DIVISIONS, ARTICLE VII, E(2) OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER,
FLORIDA, BY INCREASING MINIMUM FEES FOR RESIDENTIAL AND COMMERCIAL PERMITS IN
ACCORDANCE WITH VOLUSIA COUNTY FEE SCHEDULE AND THE SOUTHERN BUILDING COMMERCIAL
SCHEDULE; BY INCREASING THE ELECTRICAL PERMIT FEES; MECHANICAL PERMIT FEES;
PLUMBING PERMIT FEES; ZONING APPLICATION FEES; SPECIAL EXCEPTION AND VARIANCE FEES
AND SUBDIVISION PRELIMINARY PLAT FEES; CONTAINING A REPEALER PROVISION, A SEVERA-
BILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. He stated this is first reading.
Councilman Prater moved to adopt Ordinance 87-0-13. Councilman Rotundo seconded
the motion. Motion CARRIED 4-0.

ORDINANCES AND RESOLUTIONS (Continued)
Res. 87-R-29 Reappointing Delores Cucanich and Paul Biggerstaff to Citizen
Code Enforcement Board - City Attorney Alvarez read this Resolution. RES.87-R-29-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, REAPPOINTING
DELORES CUCANICH AND PAUL BIGGERSTAFF TO THE CITIZEN CODE ENFORCEMENT BOARD OF
THE CITY OF EDGEWATERj PROVIDING FOR TERMS OF OFFICE; PROVIDING FOR POWERS, DUTIES
AND RESPONSIBILITIES; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING
AN EFFECTIVE DATE. He read the terms are to expire May 8, 1990. Councilman
Rotundo moved to adopt Resolution 87-R-29. Councilman Mitchum seconded the
motion. Motion CARRIED 4-0.
Res. 87-R-30 Amending Agreement with Consulting Engineers - City Attorney Alvarez
suggested this be tabled so he can prepare some more documents with the other
attorney. Mayor Baugh suggested a motion to TABLE this until further notice.
Councilman Mitchum so moved. Councilman Prater seconded the motion. Motion CARRIED 4-0.
UNFINISHED BUSINESS
Vacating alley between Hibiscus and India Palm - Attorney Jim Morris represented
Huntley-Jiffy. He reviewed the previously agreed upon items. He stated they
researched the radius and it's as good as what's currently there. He noted that
landscaping will be provided along the front and concrete barrier poles will be
installed at the end of the landscaping. He said they'll grade the western lot
and place shell there to prevent water ponding. He expressed concern with the
term of paving to present City standards. He said it will be stabilized and it
will be a 4" slab such as is on the eastern end of the property. Councilman
Rotundo pointed out a 4" slab won't carry a truck if it's not stabilized and it
will crack and be of no use to the City or anyone else. Attorney Morris stated
the driveway at the east end is only that. There was a discussion about the pro-
cedures used for driveways and for City streets. Councilman Rotundo suggested
this be graded and shelled and then a 5" slab. Attorney Morris said he doesn't
have a problem with that and the foundation and ground underneath will be graded
out, wire will be put down, and formed. Councilman Rotundo asked Mr. Austin if
that will be sufficient and Mr. Austin replied 5" will be more than sufficient
and wire won't hurt it. Councilman Mitchum explained his motion was "to present
City standards for parking lots and roads'~ and if traffic will be on it, it will
break up when something runs over it. Attorney Morris said the lime base put under
an asphalt roadway requires a lot of different materials but concrete is simpler
and will have wire to support it. Councilman Mitchum asked what support we use for
roads and Mr. Austin replied it's a compacted base material such as shell.
Councilman Mitchum asked if will be compacted shell with a 5" base and Attorney
Morris replied yes. Councilman Prater pointed out the east end is concrete and
it wil be compatible. Councilman Mitchum moved to accept. Councilman Prater
seconded the motion. Attorney Morris called a point of order regarding the reso-
lution. City Attorney Alvarez replied that based on information supplied to his
office that day, the resolution and ordinance will be prepared and they'll be
together for first reading of the ordinance and one time reading of the resolution.
He noted the public hearing will be at the second reading. Councilman Rotundo
stipulated that when they install it, the City's Superintendent should be there to
supervise and see that it's done correctly. Attorney Morris stated they need a
building permit. Motion CARRIED 4-0.

Councilman Prater seconded the motion. Meeting adjourned at 7:50 P.M.
