Mayor Christy call the regular meeting of the City Council
of the City of Edgewater., to order December 5, 1977 at 7:30
P.M. in the Community Center.

INVOCATION
SALUTE TO FLAG
APPROVAL OF MINUTES
Mayor' Christy asked for approval of the minutes for the
special meeting NOVEMBER 19, 1977. Councilman Sikes made a
motion that the minutes be approved. Councilman Shell seconded
the motion. Upon roll call the motion CARRIED 4-1. Councilman
Dietz voted NO.
BILLS AND ACCOUNTS
Mayor Christy read the bills in the General Fund for a total of
$1,239.58. Councilman Sikes made a motion that the bills be
approved for payment. Councilman Shell seconded the motion. ~pon
roll call the motion CARRIED 5-0.
Mayor Christy read the bills for Capital Improvements Street
Paving total $1,872.00. Council~an Sikes made a motion that the
bills be approved for payment. Councilman Rot~ndo seconded the
motion. Upon roll call the motion CARRIED 5-0.
Mayor Christy read the bills in the Water and Wastewater account
total $177.00. Councilman Shell made a motion that the bills
be approved for payment. Councilman Dietz seconded the motion.
Upon roll call the motion CARRIED 5-0.
Mayor Christy read the bills for Capital Improvements Water, total
$495.00 Councilman Di~tz made a motion that the bills be approved
for payment. Councilman Shell seconded the motion. Upon roll call
the motion CARRIED 5-0.
COMMUNICATIONS
~
The City Clerk read a report from the Building Inspector and
presented his bill for $1,623.33. Councilman Sikes made a motion
that the Council pay this bill. Councilman Shell seconded the
motion. Upon roll call the motion CARRIED 5-0.
The City Clerk read a letter from Briley Wild and Associates,
regarding operator requirements for the Sewaae Treatment Plant
and the Water Treatment Plant. There was no-action by the Council

The City Clerk read a letter from the Edgewater Public Library
regarding more unsatisfactory items that need to be fixed
at the library by the contractors and subcontractors.
Mayor Christy read a,letter from the City Attorney to the
contractors stating that if numerous repairs were not completed
by December 5, 1977 they will be considered in default of their
contract and the City will hire other contractors to do the
work and,deduct the amount ,from the balance due the original
contractor.
The City Attorney said that the contractor Mr. Harris and
the architect were not concerned with fixing these unsatisfactory
items and that in the future if Mr. Harris should again be a
low bidder for a building contract for the City we should take
his past record into account.

Councilman Shell made a motion that the City get a contractor
to fix the library immediately and deduct the amount from the
balance due Mr. Harris. Councilman Rotundo seconded the motion

Councilman Sikes read a letter addressed TO WHOM IT MAY CONCERN
and signed by him, regarding pressure put on his employer
because of personal decisions or actions that he takes as a
Councilman. If the citizens are unhappy with the decisions
he makes as City Councilman then they may, under the provisions
of the Edgewater Charter, institute a recall petition. He
requested that this letter be made part of the record for this
Council Meeting.
The City Attorney said that apparently some people in the City
have taken it upon themselves to call the bank where Mr. Sikes
works to spea,k to his employer, they have even called the corporate
offices in Miami. This action constitutes harassment of Mr. Sikes
and there are laws against this. He definately has cause for
a libel suit according to certain statements that the Attorney
has heard.
AUDIENCE MISCELLANEOUS
Mrs. Rich spoke about water meters and also water leaking
near a hydrant on the Dixi~ Highway.
Councilman Rotundo said Mrs. Rich had called him and that the
hydrant had been fixed.
Police Chief Baugh said that the Police had reported this to the
Water Department.
Mr. Opal spoke about the reappointment of Mr. Dietz. He feels
Councilman Dietz is to blame for the water problems in the City
because he is the sole coordinator the water department has had
for the past 3 or 4 years. He questioned why the resumes of all
the people who had applied for the position of Councilman for
Zone 4 had not been read before anyone was appointed.
Mrs. Woodard asked what had happened to the water last week
in Edgewater.
Mayor Christy explained that one of the lines broke and it drained
one of the'tanks. When the water went back into the tank from the
top it stirred up all the sediment on the bottom which was the
cause of the bad water we had. The Water Department worke~ around

the Council and the Water department to discuss this ~roblem
and to take steps to assure it does not happen again. The
minutes of that meeting when approved by the Council will be
posted for the public. He reminded the audience that in
1975 when the second reading of an ordinance approving a new
water system for Edgewater 3 members of that Council voted against
at that time and that meant that no new system was started at
that time and that included repairing the tanks already in use.

RESOLUTIONS
Councilman Sikes made a motion to accept the insurance bid
for the insurance for the City of Edgewater as advertised by
the Caton Insurance. Councilman Dietz seconded the motion.
Upon roll call the motion CARRIED 5-0.
The City Attorney read Resolution No. 755
A RESOLUTION ACCEPTING THE BID OF CATON INSURANCE AGENCY, INC.,
OF PORT ORANGE, FLORIDA TO PROVIDE INSURANCE COVERAGE FOR THE
CITY OF EDGEWATER'S REQUIREMENTS FOR WORKMENS' COMPENSATION,
PUBLIC LIABILITY AND PROPERTY INSURANCE; REPEALING ALL RESOLUTIONS
IN CONFLICT HEREWITH AND PROVID,ING AN EFFECTIVE DATE.
Councilman Sikes made a motion that the Council adopt this
Resolution. Councilman Rotundo seconded the motion. Upon
roll call the motion CARRIED 5-0.
ORDINANCES
Ordinance 995
AN ORDINANCE AMENDING ORDINANCE 880 OF THE CODE OF ORDINANCES
OF EDGEWATER, FLOBIDA TO ADD AN ADDITIONAL CLASSIFICATION TO
THE PERMITTED USES IN THE I-I LIGHT INDUSTRIAL DISTRICT, IN
THE CITY OF EDGEWATER; FLORIDA; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
Councilman Shell made a motion that the Council adopt the first
reading of this Ordinance. Councilman Sikes seconded the motion.
Upon roll call the motion CARRIED 5-0.
Ordinance 996
AN ORDINANCE VACATING AN OLD PLAT IN THE CITY OF EDGEWATER,
VOLUSIA COUNTY, FLORIDA ON PROPERTY PRESENTLY OWNED BY FRANK
HALL AND MARY HALL, HIS WIFE: REPEALI-NG ALL-ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
Councilman Sikes made a motion that the Council adopt the first
reading of this Ordinance. Councilman Shell seconded the motion.
Upon roll call the motion CARRIED 5-0.
OLD BUSINESS
Dog Catcher: The Police Chief spoke about making an Ordinance
that'the City could work with.
Councilman Sikes asked about training and special equipment to
protect the Dog Catcher.

The Chief said he was checking with New Smyrna to find out what
they had done about this problem.
Councilman Sikes made a motion that the Council authorize the
Police Chief to get started on making the arrangements necessary
prior to hiring a Dog Catcher. Councilman Rotundo seconded
the motion. Upon roll call the motion CARRIED 5-0.
The Chief said he would report next week to the Council.

Dr. Hollingshead presented a Resolution to the Council for
their approval concerning the public benefit of the Ponce de
Leon Port Authority's proposed port and marina complex.
He explained the plan for building this marina. He asked
for the approval of the City of Edgewater for this.
There were questions from the Council concerning this project.
Councilman Dietz made a motion that the. Council endorse
this resolution. Councilman Rotundo seco~ded the ~otion.
Upon rollcall the motion CARRIED 5-0.
Culverts: Councilman Shell said that he.wanted to propose
an ordinance that the City would buy culverts and the builders
would have to get a permit for that culvert when he gets a
permit for his building. He would like to make a motion that
the attorney draw up the proper ordinance. Councilman Dietz
seconded the motion.

Councilman Rotundo asked what the cost would be.
Councilman Shell said that the cost would vary depending on
the size. But the City Street department would put them in
correctly and the City would be reimbursed by the builders.
Councilman Sikes asked when culverts would be required and
when they would not be required. There are many places that
might not need a culvert.
Councilman Shell said the City would have to inspect the area
to see if a culvert was needed.
The Council ask~d quest10ns of Mr. Leoffler, Building Inspector,
concerning the necessity of culverts in various areas.
Councilman Dietz said there was an original law that covered
drainage. but it has not been enforced. If we ever get heavy
rains or a hurricane we will be faced with serious flooding
problems.
There was discussion from the audience.
Councilman Dietz suggested that the ordinance read: it was
unlawful to restrict the flow of drainage in the City. This
would cover old as well as new houses.
The City Attorney said he was sure there was a law similiar to
this already on the books.
Councilman Dietz than suggested that Councilman Shell, Mr. Leoffler
and the City Attorney should get together and draw up an ordinance
that the City could live with.

The City Attorney was authorized to draw up an ordinance with
the help of Councilman Shell and the Building Inspector by a
Council vote of 5-0.

Fire District:
The Mayor announced that December 15, 1977 is the last meeting
to discuss with the County the question of extending Fire and
Rescue Service into the County, concerning also a combined
Fire District.
Fire Chief Foster said that the Fire Dept. had submitted to
the County a budget covering.the co~t of extra service.
Councilman Dietz said that the last meeting the Edgewater
Council had attended with the County they were not prepared
for the propositions the County made including the addition
of a rescue district.
The Fire Chief said that even if the County passed an ordinance
they would have to submit a contract to the City of Edgewater
for revi'ewby the Fire Department and approval of the City Council.
There was further discussion between the Council members,
representatives of the Fire Department.
Councilman Dietz suggested that they have a meeting with the
Fire Department and also have the County Fire Marshall and Mr.
Hetrick.. .
The Council decided to meet Thursday at 7~30 P.M. December 8, 1977.
to continue discussion of the proposed .Fire District plan.

Coordinator system.
The Council selected the Coordinators for the various departments.

& Recreation - Mayor Christy.
Councilman Dietz made a motion that the Council accept these
coordinators. The motion was seconded by Councilman Rotundo.
Upon roll the motion passed. 5-0.
The City Attorney read Resolution No. 757
A RESOLUTION APPOINTING MEMBERS OF THE CITY COUNCIL AS CO-ORDINATORS
FOR THE VARIOUS DEPARTMENTS OF THE CITY OF EDGEWATER. FLORIDA:
REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
Councilman Dietz made a motion that the Council a~cept this
Resolution. Councilman Rotundo seconded the motion. Upon roll
call the Resolution was ACCEPTED 5-0.
The Mayor spoke about the sound system in the Community Center
and the need for an improved system.
Councilman Dietz made a motion that the City get the best
sound system they can get with a recording system built right in.
Councilman Shell seconded the motion. Upon roll call the motion
CARRIED 5-0.
NEW BUSINESS
Antirecession money.
The Mayor asked the Council to approve a $100.00 Christmas bonus
for each City employee.
The City Clerk said we have a total of $7.756. It has to be
obligated before the end of this year.

The Mayor suggested that we use some of this money for Christmas
bonus.
Councilman Dietz made a motion to authorize the Citv Clerk
to advertise a Public Hearing for the use of the remainder
of the Anit-Recession money. Councilman Shell seconded the
motion. Upon roll call the motion CARRIED.
Holiday Meetings:
Councilman Dietz made a motion that the Council will not
meet on December 26 or January 2. Councilman Rotundo seconded
the motion. Upon roll call the motion CARRIED 5-0.
Pagers:
Councilman Dietz made a motion that this be tabled until a later
date. Councilman Sikes seconded the motion. Upon roll call the
motion CARRIED 5-0.
Radios:
Councilman Sikes made a motion to table this, then withdrew the
motion.
Police Chief Baugh spoke about the problems the Police are having
with one-channel radios in their cars. The Police need two channel
radios.

Councilman Rotundo made a motion that the City purchase the radios.
Councilman Sikes seconded the motion. Upon roll call the motion
CARRIED 5-0.
MISCELLANEOUS

The Chief reported on a truck route to bypass some of the areas
of the City. A cul~ert is needed at one point and it will
be necessary to check with the Mosquito Control to find out what
they require.

The Mayor announced that the City Council will meet with PBA
representatives on Wednesday, December 7, 1977 at 7:30 P.M. in
City Hall.

Councilman Dietz made a motion that the Council recess until
Thursday at 7:30 P.M. Councilman Rotundo seconded the motion.
