08-21-1978 - Public Hearing/Regular .- u o .. .. CITY OF EDGEWATER CITY COUNCIL PUBLIC HEARING August 21, 1978 Mayor Christy called the Public Hearing to order at 6:30 P.M. in the Community Center. The purpose of the public hearing was to discuss the rezoning of lots 7, 8 and 9 Block 2 Riveredge Acres from B-4 to R-4. ROLL CALL Mayor Robert H. Christy Councilman Louis J. Dietz City Attorney Judson Woods City Clerk Sue Blackwell Police Chief Earl Baugh Present Present Present Present Present Excused Present Present Mayor Christy asked first to hear from anyone in the audience who is opposed to this rezoning. Mr. Sam Gross who said he was speaking as a representative of the residents of the neighborhood, told the Council that the residents were opposed to any kind of commercial building in the area but would accept multi-family, duplexes or small apartment houses. Mayor Christy read from Ordinance 880 the specifications for building under B-4 and also under R-4. Mr. Gross said that the residents were interested in protecting their own property and hoped they could do this without causing a lot of trouble for any individual property owners. Councilman Sikes pointed out the difference between the B-4 and R-4 zoning. The R-4 zoning would be an upgrading of the property. Mrs. Matthews asked if this property would face on Riverside Drive. Mayor Christy pointed out that part;of the property to be rezoned does face on Riverside Driye. It is on the northwest corner of Boston Rd. and Riverside. There were no further comments from the audience. SALUTE TO FLAG APPROVAL OF MINUTES Councilman Sikes made a motion that the Council accept the minutes of the regular Council meeting on August 14, 1978. Councilman Shell seconded the motion. Upon roll call the motion CARRIED 5-0. BILLS AND ACCOUNTS Councilman Shell made a motion that the Council approve the bills for payment. Councilman Dietz seconded the motion. Upon roll call the motion CARRIED 5-0. COMMUNICATION The City Clerk read a letter from the Friends of the Library requesting $250 to help defray the expense of the Folk Art Festival. Councilman Dietz made a motion to instruct the City Clerk to find out if this money has been budgeted for this year or next year and advise the Council. Councilman Sikes seconded the motion. Upon roll call the motion CARRIED 5-0. The City Clerk read a letter from the Building Official requesting permission to allow contractors to use alternate materials in building septic tanks until the material specified in the new Ordinance can be obtained. Councilman Dietz made a motion that the Council grant Mr. Murphy permission to use alternate pipe until the other pipe is available. Councilman Shell seconded the motion. Councilman Sikes said that he had received a call from a dealer stating that there were better materials for septic tank installation than had been mentioned in the ordinance. He recommended to this dealer that the Building Official be contacted. The Building Official could refer this to the Council. Mr. Murphy said this dealer had called him and would come into the office to show different types of material. Councilman Dietz said that the ordinance read that the Building Official has the authority to issue a variance without having to come to the Council. He doesn't have to come to the Council on this he can issue the variance. He is supposed to use his better 2 ~ o judgement. Mr. Dietz added that he personally did not know the difference in pipe material and he assumed that the Building Official has the ability to judge this. We may have to bring in the engineers which would be costly. The ordinance stated that Mr. Murphy will have the sole prerogative to issue a variance in case of a hardship. It is up to him to make that decision. All he has to do is to send a letter to the Council telling us what he is doing, we do not need a motion to give him permission to do it, the ordinance gives him that permission. Upon roll call, the motion to give the Building Official permission to authorize substitute pipe material CARRIED 5-0. COORDINATORS REPORTS Councilman Rotundo read a letter expressing appreciation for the excellent assistance a resident had received from one of the Edgewater police officers. Councilman Shell did not have a report. Councilman Sikes recommended the appointment of William Glasser to the Board of Adjustments. He also recommended Irene Negedly be appointed to the Board of Governors but added that he had been unable to reach Mrs. Negedly to find out if she would accept this appointment. He asked the City Clerk to notify the City Attorney so that resolutions could be drawn up for these appointments. Councilman Dietz said that the City will order the electric surge equipment that was requested by DER. This equipment will also be installed in City Hall, the Library, and other City buildings to protect the electrical equipment and reduce cost. Mayor Christy called the Council's attention to a seminar on city planning that he felt would be worthwhile for our City Planner to attend. He would like the Council to consider it and discuss it next week. He also would like the Council to consider purchasing zoning law books for use by the City and the Zoning Board. Councilman Rotundo asked about a letter from the Fire Marshall regarding fire hydrants. The City Clerk read the letter which contained specifications for installation of fire hydrants, underground water mains, tanks and pumps and sprinkler heads in trash chutes and trash rooms. Any person providing the services as listed will be required to be certified by the State Fire Marshall's office. A copy of this letter will be sent to the Building Official and Fire Chief. The City Clerk said that the Council needed to authorize the acceptance of the library so that we could get $7800 from the State. Councilman Sikes made a motion that the Council authorize the ~ity Clerk to consult with the attorney to do whatever is acceptable by the State so far as accepting the library is concerned. Councilman Shell seconded the motion. Upon roll call the motion CARRIED 5-0. Mayor Christy said that the Council still needed to appoint another member to the Merit Board. 3 o o RESOLUTIONS None ORDINANCES None OLD BUSINESS The City Clerk said that a date should be set for PBA negotiations. Councilman Shell made a motion that the Council meet on August 30, 1978 at 6:30 P.M. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 5-0. The Council had tabled the letter from Sue Rollins, Coordinator Women1s Center on a local commission on the status of women, presented at last week's meeting. This subject was brought up again for discussion. The Council decided that they would need more information on this commission before making an endorsement. Mayor Christy asked the Council if they wished to make a decision on the rezoning of the lots in Riveredge Acres. Councilman Sikes made a motion that the Council authorize the City Attorney to draw up an ordinance rezoning lots 7, 8 and 9 Block 2, Riveredge Acres from B-4 to R-4. Councilman Dietz seconded the motion. Upon roll call the motion CARRIED 5-0. Councilman Sikes said that he would not be able to make the meeting with the Planning Board on Wednesday, August 23rd. He will be out of town. Councilman Shell made a motion to adjourn the meeting. Councilman Sikes seconded the motion. The meeting was adjourned.
