"h :lI ;11 '1fD~.' f1 iYkaf/: ~ ), CITY OF EDGEWATER CITY COUNCIL SPECIAL MEETING February 23, 1979 Pursuant to Charter Regulations (Ordinance No. 994, Section 2) Mayor Christy called a Special Meeting of the City Council for the purpose of discussing the emergency purchase of a garbage truck. Mayor Christy called the Special Meeting to order at 1:00 P.M. in the Mayor1s Office at Edgewater City Hall. ROLL CALL Mayor Robert H. Christy Councilman Louis J. Rotundo Councilman David C. Rickelman substituted) Mayor Christy said that the City has been having serious mechanical problems with one of the garbage trucks. It is obviously not possible to continue the present garbage pickup with a truck that is constantly breaking down and is costing the City a great deal of money in repairs. At the present time, the truck cannot even be run in reverse and the Supervisor of the Street Department has said that they cannot get the necessary parts to make repairs. Councilman Ledbetter said that he would recommend that the Council authorize the purchase of a new garbage truck. We are just throwing good money away trying to keep this truck operable. If the problem continues, he will have to have the Street Dept. cut back on the garbage pickups or- raise the rates. Councilman Sikes questioned why the truck could not be repaired. Earl Copeland, Supv. St. Dept., said that they had checked allover and could not find parts for this truck. Even if we could get the transmission fixed there are still other things wrong with the truck and it appears as if we will have to continue to make costly repairs. Mr. Cole and Mr. Tuten, representatives of Truxmore, presented the Council members with a proposal for a new truck with walk through cab and automatic transmission and power steering. The cost would be $34,000. Councilman Rotundo asked the City Clerk if there were funds available? Mr. Wharton said that we had a surplus of $42,000. in the garbage fund, but he hesitated to commit so much of this at one time and leave the fund without a backlog. There was more discussion about the type of trucks, cost, and the amount of money the City receives from the garbage collection. Councilman Sikes said that we should have a letter telling the Council that the truck was not repairable. Councilman Asting said that he felt we had to take the advice of the supervisors and mechanics in the St. Dept. Councilman Sikes asked if we should go out for bids? Councilman Ledbetter said that there was not time for bids that this was an emergency situation. If we do not have a replacement soon we will have to cut back on the number of pickups. Q u r i ! \ .. .~ .. Mayor Christy said that the walk-through cab was more expensive but it provided additional safety features. This would mean the City would pay less for insurance. Councilman Rotundo said that we should have the attorney present to advise the Council on whether they can purchase this truck on an emergency basis without going out for bids. Mayor Christy put in a call to the City Attorney's office and was advised that the Attorney was on his way to the meeting. Mr. Cole said that his company would be willing to make arrangements for payments. One third would be paid, on delivery, one third in thirty days and the balance withing sixty days. Mr. Wharton said that from a financial standpoint, this would be more satisfactory. Councilman Ledbetter made a motion that the City accept the proposal of Truxmore subject to the approval of the City Attorney, without going out for bids according to the purchase ordinance (No. 981). Payment would be made as stated: 1/3 at delivery, 1/3 in thirty days and the balance within sixty days. The truck is a 1979 Ford F 700 23 cu. yd. handload Truxmore. The City will trade a 1971 GMC truck. Councilman Asting seconded the motion. Upon roll call the motion CARRIED 4-1. Councilman Sikes voted NO. Councilman Ledbetter made a motion to adjourn the meeting. Councilman Asting seconded the motion. The meeting was adjourned. (City Attorney Judson Woods arrived at City Hall after the meeting. He stated that, according to Ord. 981, Section 7.a purchase may be negotiated without formal advertising if the public exigency will not admit of the delay .incident to advertising.
