(.J (,) CITY OF EDGEWATER CITY COUNCIL SPECIAL MEETING July 19, 1979 CALL TO ORDER Mayor Christy called the special meeting of the City Council to order at 1:00 P.M. in the Mayor's Office in City Hall. Bill Rickelman - Police Present Present - Late Excused Present Excused Present Present Excused Present Mayor Christy said they would hold the meeting for a few minutes waiting for Councilman Rotundo. Mayor Christy called the meeting back to order at 1 :12 P.M. Let the records show that Councilman Rotundo is present. We now have a quorum. Mayor Christy said the first item was the Layne Atlantic Bill in the amount of $1,880. What is the Council's pleasure on this bill. Councilman Sikes asked if the item we paid before in the amount of approximately $400, was the same thing. Mayor Christy said NO, it is an entirely different thing. Councilman Sikes made a motion to pay the bill to Layne Atlantic, in the amount of $1,880 for the work done on well #1. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 3-0. Mayor Christy said the next item for discussion would be the Permit Number 2367. He read the letter from the Building Code Board requesting a special meeting. He asked for xerox copies of the front and back of the building permit, due to the fact that we cannot get this information from the Building Official's Office. Mayor Christy asked for a roll call for the Building Code Board. BUILDING CODE BOARD ROLL CALL Mr. Griffith Mr. Harris Mr. Cole Mr. Troutner Mr. Loeffler Present Present Present Present Present Mr. Mackie, Chairman of the Zoning Board, and Mr. Siciliano, Chairman of the Industrial Development Board are also present at this meeting. Mayor Christy said that the xerox copies would go to the Council first and then to the audience. Mr. Tobin has made three previous inspections on this. Councilman Rotundo asked if the footer was in violation and what the violations were? ( c.; o Mr. Griffith passed out photographic evidence. The Code as stated in two places on the Southern Standard Building Code of the 1976 edition for the 1977 amendments, there are two parts of the Code you have to put together to get the size of the footing and the depth, Section 1302.1. All footing shall extend at least 12" below the finished grade. Section 1702.7 specifies a clearance of 6". So as \ve combine those two you have a total of 18". If you look at the photographs, you wi 11 see that there is not 18" in that building at the present time. Mr. Tobin said that Mr. Murphy gave verbal notice to have the construction stopped. Mayor Christy called for a recess until Mr. Tobin could get the permit record book. The Board was called back to order. Mayor Christy said, in November of 78, Paul Crouch, 2111 Queen Palm, built a house. Mr. Woods asked what the Board wanted done about the violation. Mr. Griffith said that the Board was not aware that Mr. Murphy had issued a stop work order to the owner. There is a possibility that the building is actually unsafe. There was a discussion about the permit and it was suggested that Mr. Tobin and Detective Rickelman should go out to the site and stop the construction. Mayor Christy said at the Monday night Council meeting he wanted it on the Agenda that they would discuss owner/builder and more than one house per year. Mayor Christy said the next item on the agenda is the discussion on the licensing of the inspectors. Mr. Griffith said they didn't have anything on Mr. Tobins background. Mr. Tobin said he started construction about 52 years ago and he has done electrical work for approximately 40 years. He is licensed in two states and he belongs to the Southern Builders Code. Mr. Loeffler said that if Mr. Tobin had his license that the Board would like to see them on display. Councilman Sikes questioned how the inspection was done? He went on to say that Mr. Tobin, is an employee of the Building Official and according to our contract that office is responsible for any inspection errors. Mr. Woods said that the City hires the Building Official and could be held responsible for inspection errors. Councilman Sikes made a motion that we refer to the Building Code Board, that if they haven't reviewed Mr. Tobins qualifications and would refer his license and for inspectors to come back and make recommendation as to whether or not he should continue on as a building inspector. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 3-0. Councilman Sikes made a motion that the Council recommend, effective immediately, that all owner/builder permits must be issued in the name of the owner of the property. - 2 - -~ o o Mr. Woods said we should draw up a affidavit requesting the warranty deed. An affidavit, if necessary, would be more effective in a court case. We could change the Ordinance, Section 8 Paragraph 1. We could have this ready for Monday night. Councilman Sikes withdrew his motion and made another motion authorizing, on an emergency basis, the attorney to prepare an Ordinance requiring that on all permits issued for owner/builders, that they show proof of ownership to the Building Official and an affidavit must be signed stating such ownership and also that they would occupy the building for 6 months within the calendar year from the date that certification on occupancy is issued. Councilman Rotundo seconded the motion. There was some discussion about the State laws concerning owner/builder. Mr. Cameron asked how the City could compel someone to live in the house they built. Mr. Woods said the intent was to allow someone to build their own residence. Mr. Siciliano asked for clarification whether or not owner/builder could rent his house. The Board discussed this. Upon roll call the motion for the changing of the Ordinance CARRIED 3-0. Councilman Sikes made a motion that the Building Official make a cross reference, in alphabetical order, on owner/builder permits, indicating on the index card, the date of the permit, the permit number and the date of occupancy. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 3-0. Councilman Sikes made a motion that the Building Official provide to the City Council and the Building Code Board, a list of the licensed contractor~ Mr. Griffith said that we already have that. Councilman Sikes withdrew his motion. Councilman Rotundo reminded the Council of the motion he made at the last Council meeting to call a meeting of all the contractors to discuss the Building regulations. Mr. Loeffler said he took pictures at the owners request. Mr. Tobin and Detective Rickelman will go out after the meeting to formally stop work on construction. Councilman Rotundo spoke again about the motion to have a meeting with the contractors. He also requested that the Building Code Board be present.: Mr. Griffith said he felt this should be handled by the Building Code Board and if there were any questions, contractors could come before the Board. Councilman Sikes made a motion to adjourn. Councilman Rotundo seconded the motion.
