Councilman Glaser seconded the motion~' Upon roll call the motion CARRIED 5-0. , ", PROCLAMATION Mayor Christy read the Proclamation for Enerqy Conservation Week and presented it to the local high school chapter of Future Farmers of America. Mr. Harrell, FFA Advisor of the Senior high school, expressed their apprecia- tion to the Council. CERTIFICATION OF BIDS Deputy City Clerk Blazi read the certification of bids and certified that the City had received two bids, one from Bud Lawrence and one from Higgenbotham. 1. Bud Lawrence Ford 79 model at $5,049.00 2. Bud Lawrence Ford 80 model at $5,282.17 3. Higgenbotham Chevrolet 80 model $5,147.99 + tax and tag The bids were turned over to Mr. Copeland, Mr. Wilcox and Mr. Gibson. Councilman Rotundo seconded the motion. Councilman Ledbetter made a motion to table this. Councilman Glaser seconded the motion. Upon roll call the motion CARRIED 5-0. Deputy City Clerk Blazi read the letter from the Zoning Board concerning Ord. 79-0-37 ,about the DayCare Centers. City Attorney Woods stated that the DayCare Centers were under the jurisdic- tion of the local Health Authorities. The Health Department has strict regulations which they enforce. . Mr. Siciliano explained why the Zoning Board wanted DayCare Centers a special exception with guidelines as specified in R5 and R5-A. Mr. John Gross stated that he felt DayCare Centers should be a special exception. Councilman. Ledbetter made a motion to deny the request and leave the Ordinance as written. The motion died for a lack of a second. Councilman Rotundo made a motion to accept the Zoning Board's recommendation. Councilman Glaser seconded the motion. There was a long discussion between the Council and the Audience. Upon roll call the motion DID NOT CARRY 4-1. Councilman Rotundo voted yes. Councilman Asting made a motion to review and correct the present R5 and R5-A DayCare Centers. Councilman Ledbetter seconded the motion. Upon roll call the motion CARRIED 5-0. Councilman Ledbetter made a motion to grant the license. Councilman Asting seconded the motion. Uoon roll call the motion CARRIED 5-0. Deputy City Clerk Blazi read the request from Don Lament for Carpentry. Mr. Lament said that there would be no storage or business at home. Councilman Rotundo made a motion to grant the license. Councilman Glaser seconded the motion. Upon roll call the motion CARRIED 5-0. Deputy City Clerk Blazi read the letter concerning Sloburn Subdivision. City Attorney 1400ds stated that the Council should accept this recommendation. Councilman Asting made a motion to accept the Citv Attornev's recommendation. Councilman Ledbetter seconded the motion. Upon roll call the motion CARRIED 5-0. Deputy City Clerk read the letter concerning Associated Marketing about the placement of benches. Councilman Asting made a motion to accept this, but not to authorize any more at the oresent time. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 5-0. Deoutv City Clerk Blazi read the letter from Mrs. Mackie concerning her resignation from the Library Board. Councilman Astinq made a motion to accent Mrs. Mackie's resignation and to send her a letter of appreciation. Councilman Rotundo seconded the motion. Upon roll call the motion CARRIED 5-0. - 2 - o o BIDS Mr. Copeland stated that their decision was to accept the bid from Bud Lawrence at $5,049.00 Councilman Ledbetter made a motion to accept the Bud Lawrence bid and to reject the others. Councilman Astinq seconded the motion. Upon roll call the motion CARRIED 5-0. - Deputy City Clerk read the Certification of Funds. Deputy City Clerk B1azi asked to go out for bids on insurance and that they be back at City Hall by January 25th at 4:00 P.M. The Council authorized this. There will be a WjWW Workshop Meeting on January 10th at 7:00 P.M. There was a long discussion at this time concerning contractors starting construction on the site before obtaining a building permit. Councilman Rotundo said to write a letter to the Building Code Board and get their suggestions for a solution to this problem. Citv Attornev Woods said that if the Council was not pleased with the Bui1dinq Off~cia1s wo~k, he should be called before the Council. - Mayor Christy said there should be some kind of a fine for buildings with no permit. Councilman Asting suggested that when a contractor comes in for a building permit the Building Official should go out and check the location to see if there is any construction started, if so, they should be fined. A RESOLUTION APPOINTING CHARLES HARDEE AS THE ASSISTANT CITY ATTORNEY OF THE CITY OF EDGEWATER, FLORIDA; SETTING FORTH UNDER WHAT CONDITIONS HE SHALL SERVE AS THE ASSISTANT CITY ATTORNEY~ PROVIDING FOR REMUNERATION FOR HIS SERVICES~ PROVIDING THAT HE SHALL SERVE AT THE WILL OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. A RESOLUTION AUTHORIZING THE CITY CLERK OF THE CITY OF EDGEWATER, FLORIDA, TO PAY THE SUM OF $1,019.00 AS THE CITYIS SHARE OF THE VOLUSIA COUNCIL OF GOVERE- MENTis CPP-208 GRANT PROGRAM; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. A RESOLUTION APPOINTING TERRY WADSWORTH AS THE EDGEWATER REPRESENTATIVE TO THE AREA WIDE WATER QUALITY ADVISORY COMMITTEE; REPEALING ALL RESOLUTIONS IN 1 CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. AN ORDINANCE AMENDING SECTION 606.02(b) B-3 HIGHvlAY SERVICE BUSINESS DISTRICT, APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY ADDING PET GROOMING AND SALE OF PET SUPPLIES, EXCLUDING OVERNIGHT BOARDING OF ANIMALS, AND EXCLUDING KENNELS: WHOLESALE AND RETAIL SALES OF HONEY PRODUCTS; AND NURSERY SCHOOLS AND DAY CARE CENTERS AS PERMITTED USES IN THE B-3 ZONING DISTRICT OF THE CITY OF EDGEWATER, FLORIDA; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. Councilman Asting made a motion to reject the proposed increase in additional insurance. Councilman Ledbetter seconded the motion. Upon roll call the motion CARRIED 4-1. Mayor Christy voted NO. Deputy City Clerk read the recommendation from the City Clerk on Resolution No. 79-R-86 and 79-R-109 for corrections. City Attorney Woods agreed to correct these resolutions. The Council agreed. Councilman Asting made a motion to recommend William Brogan to serve on the - 4 .,. ,.I o o Industrial Development Board. Councilman Ledbetter seconded the motion. Upon roll call the motion CARRIED 5-0. AUD1ENCE M1SCEllANEOUS Mr. Walter Gross sooke to the Council about the F.E.C. He stated that he had heard that mee~in9s have been held with F.E.C, out of the Sunshine Law. He asked if this was true? Mayor Chri sty sa i d'~, Mr. Gross asked if this was in the best interest of F,E.C, or Edgewater? Mayor Christy said that this was in the best interest of Edgewater. Mr. Siciliano said that this was in the best interest of Edgewater. Mr. Frederick, 1606 S. Riverside, asked if something could be done about the manholes on Riverside Drive, he also asked the status on the Animal Ordinance? He then stated that the lights on the Tennis Court were on at 12:30 P.M. Sunday. Mayor Christy said that a workshop would be held for the Animal Ord. in January. Police Chief Baugh read the letter from D.O.T. concerning the installation of No U-Turn signs for US. 1. Councilman Ledbetter made a motion to adjourn. Councilman Asting seconded the motion.
