AN ORDINANCE AMENDING ORDINANCE NO. 7%-0-10 OF THE
CITY OF EDGEWATER, FLORIDA, TO PROVIDE THAT NO
BUILDING PERMIT SHALL BE ISSUED UNTIL THE PAYMENT
OF A FEE OF $1.00 PER $1,000.00 VALUATION OF THE
BUILDING TO BE CONSTRUCTED, PROVIDING THAT FUNDS
COLLECTED MAY BE USED FOR THE IMPROVEMENT, MAIN-
TENANCE, AND OPERATION OF THE STREET LIGHTING
SYSTEM OF THE CITY OF EDGEWATER, PROVIDING THAT
THE CITY MANAGER AS THE FINANCIAL OFFICER OF THE
CITY SHALL BE RESPONSIBLE FOR THE MAINTENANCE FOR
SEPARATE STREET LIGHT ACCOUNT; PROVIDING THAT THE
CITY COUNCIL SHALL BE THE SOLE AUTHORITY REGARDING
THE UTILIZATION OF FUNDS IN SAID ACCOUNT, UPON THE
RECOMMENDATION FROM THE CITY MANAGER AND STAFF.
NOW THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. PURPOSE. It is the purpose of this Ordinance to
provide a more adequate street lighting system for the safety and
welfare of the citizens of the City of Edgewater, Florida.
SECTION 2. STREET LIGHT FEES. No building permit shall be
issued for any new residence or new commercial building in the City
of Edgewater, Florida, until the building official shall have collected
a street light fee in addition to the building permit fee. The street
light fee shall be assessed against the new residence or commercial
building in an amount of $1.00 per $1,000.00 valuation as it is deter-
mined by the building official on the application for building permit.
SECTION 3. ESTABLISHMENT OF A SEPARATE ACCOUNT FOR THE DEPOSIT
OF ALL FEES COLLECTED. The City Manager shall set up a separate
interest -bearing account in a financial institution to be designated
by the City Council and shall deposit all fees collected as set forth
in Section 2 above in said account. No other monies collected by the
City shall be co -mingled with the funds in this account. This account
shall be designated as the "Street Light Improvement Account." The
monies so deposited in this account shall be used solely for the im-
provement, maintenance and operation of the street lighting system in
the City of Edgewater, Florida.
SECTION 4. The City Manager shall periodically recommend to
the City Council of the City of Edgewater the best utilization of the
available funds in the Street Light Improvement Account. This recom-

mendation shall be based on staff advice as to the need for more
adequate street lighting in a particular district in the City of
Edgewater. The City Manager, in his recommendation, shall certify
that the necessary funds are available in the Street Light Improve-
ment Account for the contemplated improvement. After receiving any
recommendation from the City Manager, the City Council shall act on
said recommendation, taking into account staff advice. The City
Council shall be the sole authority regarding the utilization of funds
in the Street Light Improvement Account.
SECTION 5. That all ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith be and the
same are hereby repealed.
SECTION 6. This Ordinance shall take effect immediately upon
its adoption by the City Council and approval as provided by law.
SECTION 7. The City Clerk is hereby directed to advertise this
Ordinance as required by law.
The first reading of the above Ordinance is read in full and
passed by vote of the City Council of the City of Edgewater, Florida,
at a regular meeting of said Council held on the !.In�day of GtCCtneKr
1981, and approved as provided by law.
