ORDINANCE NO. 81-0-40 AN ORDINANCE ANNEXING CERTAIN REAL PROPERTY OWNED BY THOMAS J. GRADY AS BISHOP OF THE DIOCESE OF ORLANDO, A CORPORATION SOLE, .INTO THE CITY OF EDGEWATER, FLORIDA, PURSUANT TO 5171.044, FLORIDA STATUTES: REDEFINING THE t� BOUNDARIES OF THE CITY OF EDGEWATER, FLORIDA, BY AMENDING SECTION 1-10 OF THE CODE OF ORDINANCES; PROVIDING THAT A CERTIFIED COPY OF THE ORDINANCE SHALL BE FILED WITH THE CLERK OF THE CIRCUIT COURT IN VOLUSIA COUNTY, FLORIDA, AND WITH THE DEPARTMENT OF STATE FOR THE STATE OF FLORIDA, UPON ADOPTION; PROVIDING FOR PUBLICATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, THOMAS J. GRADY as Bishop of the Diocese of Orlando, a corporation sole, has filed a Petition for Voluntary Annexation, dated October 16, 1981, with the City Clerk of the City of Edgewater, Florida, and WHEREAS, Petitioner owns real property within the unin- corporated area of Volusia County, Florida, which property is contiguous to the City of Edgewater, Florida, and is reasonably compact, and otherwise meets the criteria for voluntary annex- ation pursuant to 5171.044, Florida Statutes, and WHEREAS, The City Council has determined that it would be in the best interest of the City of Edgewater, Florida, to annex said tract of land, that said real property is contiguous to the territorial limits of the City of Edgewater, Florida, and is reasonably compact, NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. The following described real property presently owned by Thomas J. Grady as Bishop of the Diocese of Orlando, lying and situate in the unincorporated territory of Volusia County, Florida, is hereby annexed into the City of Edgewater, Florida, pursuant to §171.044, Florida Statutes, to wit: The Northeast 1/4 of the NE 1/4 of the NW 1/4; The West 1/2 of the NE 1/4 of the NW 1/4; the SE 1/4 of the NE 1/4 of the NW 1/4; and a portion of the NW 1/4 of the NE 1/4, lying Westerly on U.S. Highway No. 1, a 158 foot R/W as now laid out, Section 2, Township 18 South, Range 34 East, said portion of the NW 1/4 of the NE 1/4 being described as follows: Begin at the inter- section of the North line of said Section 2 and the Westerly line of said U.S. Highway No. 1; thence Westerly along the Northerly line of said Section 2, a distance of 210 feet for the Point of Beginning; thence S26041'41" E ko-do . � y and parallel to said Westerly line of U.S. Highway No. 1, a distance of 210 feet; thence Easterly and parallel to the North line of said Section 2, a distance of 210 feet to the said Westerly line of U.S. Highway No. 1; thence S 64012'19" W, a distance of 704.40 feet; thence S 26041'41" E and parallel to the said U.S. Highway No. 1, a distance of 618.4 feet to the Northerly line of Silver Ridge Sub- divisions Units 1 and 2, as recorded in Map Book 25, page 87 and Map Book 27, page 50, respectively; thence S 64012'19" W along the Northerly line of Silver Ridge Subdivision, a distance of 441.30 feet to the Westerly line of the Northwest 1/4 of the Northeast 1/4, said Section 2, thence Northerly along the said Westerly line a distance of 1237 feet more or less to the said North line of Section 2; thence Easterly along the said North line, a distance of 465.9 feet to the Point of Beginning. All containing 50.48 acres more or less, and all of the above land being located in Section 2, Township 18 South, Range 34 East. SECTION 2. That Section 1-10 of the Code of Ordinances of the City of Edgewater, Florida, same being the Boundaries of said City are hereby redefined and upon the effective date of this Ordinance shall stand amended as described in Exhibit A, attached hereto, and incorporated by reference herein. SECTION 3. That upon the effective date of this ordinance, a certified copy shall be filed with the Clerk of the Circuit Court in Volusia County, Florida, and with the Secretary of State of the State of Florida. SECTION 4. That the City Clerk is hereby directed to adver- tise this Ordinance as required by law. SECTION 5. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and same are hereby repealed. SECTION 6. That this Ordinance shall take effect immediately upon its final passage and authentication as provided by law. GRADY as Bishop of the Diocese of Orlando, a corporation sole, has filed a Petition for Voluntary Annexation, dated October 16, 1981, with the City Clerk of the City of Edgewater, Florida, and WHEREAS, Petitioner owns real property within the unincorp- orated area of Volusia County, Florida, which property is contig- uous to the City of Edgewater, Florida, and is reasonably com- pact, and.`-atherwise-meets the criteriafor voluntary annexation pursuant to 5171.044, Florida Statutes, and WHEREAS, The City Council has determined that it would be in the best interest of the City of Edgewater, Florida, to annex said tract of land, that said real property is contiguous to the territorial limits of the City of Edgewater, Florida, and is reasonably compact, e NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. The following described real property presently owned by Thomas J. Grady as Bishop of the Diocese of Orlando, lying and situate in the unincorporated territory of Volusia County, Florida, is hereby annexed into the City of Edgewater, Florida, pursuant to §171.044, Florida Statutes, to wit: The Northeast 1/4 of the NE 1/4 of the NW 1/4; The West 1/2 of the NE 1/4 of the NW 1/4; the SE 114 of the NE 1/4 of the NW 1/4; and a portion of the NW 1/4 of the NE 1/4, lying Westerly on U.S. Highway No. 1, a 158 foot R/W as now laid out, Section 2, Township 18 South, Range 34 East, said portion of the NW 1/4 of the NE 1/4 being described as follows: Begin at the intersection of the North line\of said Section 2 and the Westerly line of said U.S.Highway No. 1; thence Westerly along. the North- erly line of said Section 2, a distance of 210 feet for the Point of Beginning; thence S26°41'41" E and parallel to said Westerly line of U.S.Highway No. 1, a dis- tance of 210 feet; thence Easterly and parallel to the North line of said Section 2, a distance of 210 feet to the said Westerly line of U. S.Highway No. 1; thence S 64012119" W, a distance of 704.40 feet; thence S 26041'41" E and parallel to the said U.S.Highway No. 1, a distance of 618.4 feet to the Northerly line of Silver Ridge Subdivisions Units 1 and 2, as recorded in Map Book 25, paae 87 and Map Book 27, page 50, respectively; thence S 64012'19" W along the Northerly line of Silver Ridge Subdivi- sion, a distance of 441.30 feet to the Westerly line of the Northwest 1/4 of the Northeast 1/4, said Section 2, thence Northerly along the said Westerly line a distance of 1237 feet more or less to the said North line of Section 2; thence Easterly along the said North line, a distance of 465.9 feet to the Point of Beginning. All containing 50.48 acres more or less, and all of the above land being located in Section 2, Township 18 South, Range 34 East. SECTION 2. That Section 1-10 of the Code of Ordinances of the City of Edgewater, Florida, same being the Boundaries of said City are hereby redefined and upon the effective date of this Ordinance shall stand amended as described in Exhibit A, attached hereto, and incorporated by reference herein. SECTION 3. That the above described real property shall upon the effective date of this ordinance shall be zoned R-4 and shall be governed by the district regulations of that zone as per Section 603.01 of the Zoning Ordinance of the City of Edgewater, Florida, said zoning is not an increase or decrease in density from its present zoning classification under the ordinances of Volusia County, Florida. r. SECTION 4. That upon the effective date of this ordinance, a certified copy shall be filed with the Clerk of the Circuit Court in Volusia County, Florida, and with the Secretary of State of the State of Florida. SECTION 5. That the City Clerk is hereby directed to adver- tise this Ordinance as required by law. V, SECTION 6. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and same are hereby repealed. SECTION 7. That this Ordinance shall take effect immediately upon its final passage and authentication as provided by law.
