81-O-29ORDINANCE NO. 81-0-29 AN ORDINANCE DESIGNATING THE CITY MANAGER TO BE THE CHIEF ADMINISTRATIVE OFFICER OF THE CITYOF EDGEWATER, FLORIDA; PROVIDING THAT THE CITY MAN- AGER SHALL FAITHFULLY PERFORM ALL ADMINISTRATIVE DUTIES IMPOSED UPON HIM BY THE CHARTER AND ORDIN- ANCES OF THE CITY; FURTHER PROVIDING THAT THE CITY MANAGER MAY DESIGNATE AN ACTING CITY MANAGER ;';�,^� ♦ TO ASSUME SAID RESPONSIBILITIES IN THE ABSENCE OF THE CITY MANAGER; FURTHER PROVIDING CONDITIONS THEREOF; REPEALING ALL ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH; DIRECTING THE CITY CLERK TO ADVERTISE THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The Charter of the City of Edgewater, Florida, provides that the City Council may prescribe by ordinance the powers and responsibilities of a City Manager, and WHEREAS, The Code of Ordinances for the City provides that the City Manager shall be responsible for the proper administration of all affairs of the City, and WHEREAS, It is desirous to designate an Acting City Manager in the event that a temporary vacancy would occur in the office of the City Manager: NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER: FLORIDA: SECTION 1. Section 2-5A of the Code of Ordinances of the City of Edgewater, Florida is hereby created to read: The City manager shall be the chief administrative officer of municipal government and shall faithfully perform all administrative duties as imposed upon him by the City Council and as otherwise required by law. In the event that there is a temporary vacancy in the office of city manager or supervisor of a municipal department, due to incapacity or official leave, the city manager may designate an acting city manager or acting department supervisor for a period not to exceed thirty days. Thereafter, the City Council may appoint an acting city manager until the return of the city manager. All appointments or designation hereunder shall be subject to the approval of the City Council. SECTION 2. That all ordinances or parts of ordinances and re- solutions or parts of resolutions in conflict herewith and be and same are hereby repealed. SECTION 3. That the City Clerk is hereby directed to advertise this Ordinance as required by law. SECTION 4.
