ORDINANCE NO. 81-0-11
AN ORDINANCE AMENDING SECTION 606.02 OF APPENDIX A,
THE ZONING ORDINANCE OF THE CITY OF EDGEWATER, FLOR-
IDA, TO ALLOW FLEA MARKETS AS A SPECIAL EXCEPTION
WITHIN THE B-3 ZONING DISTRICT; FURTHER PROVIDING
SPECIAL CONDITIONS TO BE IMPOSED ON FLEA MARKETS
PRIOR TO GRANTING A SPECIAL EXECEPTIM FURTHER
AMENDING SECTION 11-8 OF THE CODE OF ORDINANCES OF
THE CITY OF EDGEWATER, FLORIDA, TO IMPOSE AN OCCUP-
ATIONAL LICENSE TAX UPON OWNERS OF FLEA MARKETS,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
" SECTION 1. Section 606.02 of Appendix A, the Zoning Ordinance
of the City of Edgewater, Florida, is amended in "paragraph (d)"
thereof to include an additional paragraph "(2)" to include flea
markets as a special exception within the B-3 Zoning District as
follows:
"(2) Flea markets may be authorized within the district
so long as the following conditions are imposed:
(a) They operate only on Fridays, Saturdays, Sundays,
and legal holidays, from the hours of 7:00 A.M. to
5:00 P.M.
(b) Adequate refuse containers are provided.
(cj The area is completely clear of litter and other
refuse after each day of operation
(d) The minimum lot size shall be one acre.
(e) They contain at least three off-street parking
spaces, ten feet by twenty feet in size, for each
rental space or structure; all parking areas to have
a hard stabilized, but not necessarily paved surface.
(f) They do not offer for sale: automobiles, motorcycles,
watercraft, or any type of personal services, or
any item which is prohibited by local, state or
federal law.
(g) All merchandise displayed or offered for sale shall
be removed from the premises at the end of each day.
(h) They provide no more than one permanent advertising
sign, and no more than two removable advertising
signs displayed during actual operation. (signs must
comply with the Edgewater Sign Ordinance)
(i) A sketch plan demostrating compliance with these
requirements is submitted at the time of compliance.
(j) A letter stating compliance with the applicable
Health Department regulations is submitted at the
time of application."
SECTION 2. There is hereby imposed upon each owner or manager
of a flea market within the City of Edgewater, Florida, an occupational
license tax in the amount of $500 dollars, payable to the City Clerk
prior to engaging in or managing any flea market operation within the
City.
SECTION 3. The occupational license taxes imposed by section
2 of this ordinance, shall be inserted within the Schedule of occupa-
tional license taxes codified at Section 11-8 of the Code of Ordinances
as follows:
"FLEA MARKETS
(a) owners or managers . . . . . . $500
(b) individual dealers . . . . . . $ 0 "
SECTION 4. That all ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith, be and same
are hereby repealed.
SECTION 5. That this Ordinance shall take effect immediately
upon its final passage and approval as provided by law.
The Ordiance was introduced by Mr. Ledbetter.
The first reading of the above ordinance was read in full and
passed by vote of the City Council of the City of Edgewater, Florida,
at regular meeting of said Council held on the 23rd day of March,
1981, and approved as provided by law.
The second reading of the above ordinance was read in full
and at a regukr meeting of the City Council after appropriate public
hearing following due public notice held on the day of
1981, and passed by a majority vote of the City Council and approved
as provided by law.
