81-O-6ORDINANCE NO. 81-0-6 AN ORDINANCE AMENDING SECTION SECTION 1000.05, 1001.04, AND 1103.00 OF APPENDIX A -ZONING ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, TO MANDATE ADDITIONAL REQUIREMENTS TO DUE PUBLIC NOTICE FOR PUBLIC HEARINGS OF THE BOARD OF ADJUSTMENTS AND ZONING BOARD OF THE CITY OF EDGEWATER BY REQUIRING POSTING OF EFFECTED PROPERTY WITH AN OFFICIAL NOTICE AND NOTIFICATION TO ADJOINING PROPERTY OWNERS BY CERTIFIED MAIL, AND PUBLICATION OF NOTICE IN NEWS- PAPERS OF GENERAL CIRCULATION; REPEALING ALL ORD- INANCES AND RESOLUTIONS IN CONFLICT HEREWITH; DIRECTING PUBLIC HEARINGS THEREON, REFERING SAME TO THE ZONING AND PLANNING BOARDS, AND PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Section 1000.05 of the Zoning Ordinance - Appendix A of the City of Edgewater, Florida, shall be amended to read: 1000.05 Public Hearing: The chairman of the board of adjustment shall schedule a public hearing within forty (40) days from the receipt of the appeal. Public notice of the hearing shall be published in a local newspaper of general circulation within the community and all abutting property owners notified by certified mail at least ten (10) days prior to the public hearing. The enforcement official shall supply the appellant with an official notice sign which shall be posted by the appellant on the property involved at a location from which it may be clearly seen by ayoining property owners and the public. The notice shall be posted for a period of one week preceeding the public hearing and shall contain information concerning the kind of appeal, and the date, time, and location of the public hearing, and that interested persons may appear and be heard. Before a public hearing may commence, the board must determine that the aforementioned public notice requirements have been met. SECTION 2. That Section 1001.04 of the Zoning Ordinance - Appendix A of the City of Edgewater, Florida shall be amended to read: 1001.04 Public Hearing: The chairman of the board of adjustment shall schedule a public hearing within forty (40) days from the receipt of the application. Before a public hearing may commence, the board must determine that the afore- mentioned public notice requirements have been met. SECTION 3. That Section 1103.00 of the Zoning Ordinance - Appendix A of the City of Edgewater, Florida, shall be amended to read: Section 1103.00 Notice of public hearing. No amendment shall be adopted by the city council until after public notice and hearing. Notice of public hearing shall be published in a newspaper of general circulation within Edgewater at least fifteen(15) days prior to the hearing. Notice of the hearing shall also be posted in the lobby of the city hall. In addition thereto, amendments which re -zone a single parcel of private real property shall not beenacted until the following due public notice requirements are met. The enforcement official shall supply the owner of the parcel with an official notice sign which shall be posted by the owner on the property involved at a location from which it may be clearly seen by adjoining property owners and the public. The notice shall be posted for a period of one week preceding the public hearing and shall contain information concerning the proposed re -zoning, and the date, time and location of the public hearing, and that interested persons may appear and be heard. Before a public hearing may commence, the council must determine that the aforementioned public notice requirements have been met. SECTION 4. That all ordinances or parts of ordinances and all resolutions or parts or resolutions in conflict herewith, be and same are hereby repealed. SECTION 5. That the City Clerk is directed to advertise this Ordinance as required by law, and that public hearings shall beheldon that day of at 7.yo��o'clock 7 M at the Edgewater Community Center and that interested persons are invited to attend and be heard. SECTION 6. That this Ordinance is hereby referred to the Planning and Zoning Board, that they shall consider same and make recommendations thereon. SECTION 7. That this Ordinance shall take effect immediately upon its adoption by the City Council and approval as provided by law. The first reading of the above ordinance was read in full and passed by a vote of the City Council of the City of Edgewater, Florida at the regular meeting of said council held on the z day of February, 1981, and approved as provided by law. The second reading of the above ordinance was read in full and passed by a vote of the City Council of the City of Edgewater 9 Florida at a regular meeting of said council held on the ay of 1981, and approved as provi d by law.
