81-O-4ORDINANCE NO. AN ORDINANCE AMENDING SECTIONS 14-1, 14-2, & 14-3, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER TO PROVIDE FOR A ZONING AND PLANNING BOARD OF THE CITY, FURTHER PROVIDING SAME AS THE LOCAL GOVERNMENT PLANNING AGENCY, GRANTING SAME AUTHORITY THROUGHOUT THE MUNICIPAL TERRITORIES OF THE CITY, EMPOWERING SAME TO EXERCISE AUTHORITY GRANTED BY STATE LAW AND FUTURE ORDINANCE OR RESOLUTIONS; FURTHER PROVIDING FOR MEMBERSHIP OF THE BOARD, STAGGERING THE TERMS THEREOF, REQUIRING RESIDENCY FOR ITS MEMBERS, AND PROVIDING A MEANS FOR THEIR REMOVAL; FURTHER PROVIDING DUTIES AND PROCEDURES OF SAID BOARD, EMPOWERING SAME TO ADOPT RULES AND REGULATIONS, AND TO APPOINT A CHAIRMAN, VICE CHAIRMAN AND SECRETARY, PROVIDING THAT ALL MEETINGS SHALL BE PUBLIC, REQUIRING DUE PUBLIC NOTICE OF ALL MEETINGS, REQUIRING PUBLIC POSTING OF ALL MINUTES, PROVIDING FOR THE CITY COUNCIL TO GIVE FINANCIAL SUPPORT TO THE BOARD, REQUIRING THE BOARD TO GIVE FREQUENT REPORTS ON ITS BUSINESS TO THE CITY COUNCIL; FURTHER PROVIDING ALL ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH SHALL BE REPEALED; SPECIFICALLY REPEALING ORDINANCE 902, 903, & 947 OF THE CITY OF EDGEWATER, FLORIDA; FURTHER PROVIDING THAT THE PLANNING BOARD AND THE ZONING BOARD OF THE CITY OF EDGEWATER, FLORIDA SHALL HOLD PUBLIC HEARINGS ON THIS ORDINANCE; FURTHER PROVIDING THAT THE CITY CLERK SHALL ADVERTISE THIS ORDINANCE AS PROVIDED BY LAW; FURTHER PROVIDING AN EFFECTIVE DATE. WHEREAS, The Planning Board of the City of Edgewater, Florida has completed its responsibilities under the Local Government Comprehensive Planning Act of 1975, and Ordinance 942 (Section 14-3 Code of Ordinances) of the City of Edgewater, and WHEREAS, the consolidation of the Planning Board and the Zoning Board of the City of Edgewater, Florida is consistent with the Local Government Comprehensive Planning Act of 1975, and the Comprehensive Plan of the City of Edgewater, Florida, and WHEREAS, due public notice of this ordinance has been given, and appropriate public hearings have been held, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Section 14-1 of the Code of Ordinances of the City of Edgewater, Florida is hereby amended to read: Section 14-1 Zoning and Planning Board (a) There is hereby established a Zoning and Planning Board of the City of Edgewater, Florida. Hereinafter it shall be referred to as "the Board." TE® (b) The Board is hereby designated as the local government planning agency for the purposes of compliance with the Local Government Comprehensive Planning Act of 1975. (c) The Board shall oversee and monitor the effectiveness and status of the comprehensive plan, shall make determinations on land use policy consistent with said plan, and shall recommend to the city council changes in said plan. (d) The Board shall exercise its authority granted by the Act throughout all of the incorporated area of the city. (e) The Board shall have all the duties and responsibilities to them pertaining as a zoning commission and local planning agency as set forth and provided for under the constitution and laws of the state and the charter, ordinances, and resolutions of the city. SECTION 2. Section 14-2 of the Code of Ordinances of the City of Edgewater, Florida is hereby amended to read: Section 14-2 Membership of Board (a) There shall be nine members of the Board who shall be appointed by resolution of the city council, and shall serve staggered terms of three years. (b) Upon the adoption of this ordinance, three members shall be appointed for a term of one year; three members shall be appointed for a term of two years; three members shall be appointed for a term of three years. Any vacancy occurring during a term shall be filled only for the remainder of the term. Such vacancies shall be filled within thirty days after the vacancy occurs. (c) Members of the Board shall be residents of the city during the tenure of their term. (d) The city council may remove a member for cause only after written charges and notice followed by a public hearing. SECTION 3. Section 14-3 of the Code of Ordinances of the City of Edgewater, Florida is amended to read: Section 14-3 Duties and Procedures (a) The Board shall adopt and from time to time amend various rules and regulations which shall govern its meetings. (b) The Board shall elect a Chairman and Vice-chairman from among its members. In addition, it shall appoint a staff member as secretary who shall keep a properly indexed record of resolutions, findings, actions, and reports of the Board, which shall be a public record and maintained for inspection at city hall. (c) All meetings of any members of the Board shall be public. Due public notice of all meetings shall be given, and the minutes of each meeting shall be transcribed and posted as soon as practi- cable. (d) The Board shall make frequent reports on its business to the City Council. All resolutions of the Board shall be subject to the approval of the council. (e) The City Council shall appropriate funds for salaries, fees, and necessary expenses for the financial support of the Board. Members shall serve without compensation but may be reimbursed for expenses incurred in the performance of their duties. SECTION 4. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. Ordinance Nos. 902, 903, and 947 of the City of Edgewater, Florida are expressly repealed. SECTION 5. This Ordinance shall be referred to the Planning Board and the Zoning Board of the City of Edgewater, Florida, that same consider same. They shall report their recommendations to the City Council prior to the adoption of the Edgewater Comprehen- sive Plan. SECTION 6 The City Clerk is directed to advertise this Ordinance as provided by law. SECTION 7. This Ordinance shall become effective immediately upon its adoption by the City Council and approval as provided by law; provided however, that the adoption hereof occurs following the adoption of the Edgewater Comprehensive Plan. The firsb reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a Regular meeting of said Council held on the �2 day of February, 1981, and approved as provided by law.
