90-R-41C, J RESOLUTION NO. 90-R-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS OF THE CITY OF EDGE - WATER, FLORIDA, TO EXECUTE THE "INTERLOCAL AGREEMENT" FOR REPAIRS TO BOAT RAMPS AT GEORGE KENNEDY MEMORIAL PARK WITH THE COUNTY OF VOLUSIA, ACTING AS THE PONCE DE LEON PORT AUTHORITY; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA! SECTION 1: That the City Council of the City of Edgewater, Florida, authorizes the appropriate officials of the City of Edgewater, Florida to execute the "Interlocal Agreement" for repairs to the boat ramps at George Kennedy Memorial Park between the County of Volusia, acting as the Ponce De Leon Port Authority, and the City of Edgewater. SECTION 2: A copy of said "Interlocal Agreement" is attached to this Resolution and by reference incorporated herein as if fully set forth and marked "Exhibit A". SECTION 3: That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4: That this resolution shall take effect immedi- ately upon its adoption by the City Council of the City of Edge- water, Florida, at a Reeuiar meeting of said Council held on the 16 day of July ,199 0 , and approved as provided by law. This resolution was introduced and sponsored by Councilman Gold and was read and passed by a vote of the City Council of the City of Edgewater, Florida, at a Regular meeting of said Council held on the 16 day of July 199 0, and authenticated as provided by law. ROLL CALL VOTE ON RESOLUTION NO. 90-R-41 AS FOLLOWS: EXCUSED '.OUNCILMAN - ZONE FOUR of Jul 2 ,1990 MAYOR Approv d o �f ��0 4EY -2- Res. 90-R-41 INTF.RLOCAL AGREEMENT WHEREAS, the PONCE DE LEON PORT AUTHORITY, had budgeted certain funds for water related recreation improvements within the District boundaries and located specifically in the CITY OF EDGEWATER, FLORIDA, and WHEREAS, the County Council, acting as the PONCE DE LEON PORT AUTHORITY, has determined that Project No. BSPAWRRP-4 , a project for the CITY OF EDGEWATER, should be funded in the fiscal year 1990-91, and, WHEREAS, the PONCE DE LEON PORT AUTHORITY and the CITY OF EDGEWATER, FLORIDA, find the proposed project to be in the public interest of the citizens of the District, - AGREEMENT The PONCE DE LEON PORT AUTHORITY, a dependent taxing district of the County of Volusia, created under the Laws of Florida (hereinafter referred to as "Port Authority"), and the CITY OF EDGEWATER, a Florida Municipal Corporation (hereinafter referred to as "City") agree as follows: 1. By the _day of , 1990, the Port Authority will expend up to DOLLARS ($ ), for the construction of Project No.88PAWRRP-4 according to the plans and specifications attached hereto as Exhibit A. This commitment is subject to obtaining the necessary permits, etc. 1 2. The City of Edgewater hereby agrees to the construction of the project according to the plans and specifications (Exhibit A) provided by the Port Authority. 7. Deviations and/or changes from the plans and specifications described in Exhibit A shall be at the sole discretion of the Port Authority. 4. It is understood by and between the parties that this agreement does not obligate the Port Authority to provide additional funds for said project or to otherwise be responsible for the maintenance of the project subsequent to completion. 5. The City of Edgewater will provide all additional monies necessary to maintain the project according to the plans and specifications.' 6. The City of Edgewater agrees to hold the Port Authority harmless from and assume the defense of any and all claims, liabilities, rights, obligations arising out of the construction or operation of the project as described in Exhibit A. 7. The City of Edgewater will place a temporary sign no less than 4' x 4' on the project site indicating Port Authority assistance.
