APPROVAL OF MINUTES a.Regular Meeting - August 10, 2016 A motion was made by Mr. McIntosh, second by Mr. Kennedy, to adopt the minutes of August 10, 2016. The MOTION was APPROVED by the following vote: Yes:George Kennedy, Robert McIntosh, Pat Card, Robert Andrejkovics, David Tyree, and Michael Eichhorn 6 - Excused:Paul Wright1 - 4. OLD BUSINESS-PUBLIC HEARING None at this time. 5. NEW BUSINESS - PUBLIC HEARING a.VA-1611 - Christina Noyes, owner, requesting variances from Section 21-36.02(h) and (j) and Section 21-50.02 of the Land Development Code for property located at 1902 Orange Tree Drive Mr. Lear provided background information and staff's recommendation. Chairman Card opened the public hearing. Russ Noyes, 1902 Orange Tree Drive, owner, stated the structure was to cover their boat. Mr. Andrejkovics asked if the structure would be the same height as the garage. Mr. Noyes stated it would be at the peak of the roof. There being no further comment of discussion Chairman Card closed the public hearing. A motion was made by Mr. Andrejkovics, second by Mr. Tyree, to approve the variance Page 1City of Edgewater Printed on 10/5/2016 September 14, 2016Planning and Zoning Board Meeting Minutes from Section 12-50.02 and 21-36.02 (h) to allow a front setback of 24-feet and Section 21-36.02 (j) to allow a third accessory structure for the construction of a carport at 1902 Orange Tree Drive. Mr. McIntosh clarified that it was Section 21, not 12. The MOTION was APPROVED by the following vote: Yes:George Kennedy, Robert McIntosh, Pat Card, Robert Andrejkovics, David Tyree, and Michael Eichhorn 6 - Absent:Paul Wright1 - b.VA-1612 - Dominick and Jill Micolupo, owners, requesting a variance from Section 21-50.02 of the Land Development Code for property located at 300 S. Riverside Drive. Mr. Lear provided background information, he stated that adjacent property owners were notified of the request and staff has received opposition. Mr. Lear stated staff recommended approval with conditions that the driveway on East Palm Way be utilitzed for the parcel to the north and only one driveway be permitted on Riverside Drive for the parcel to the south; construction of each residence meet the stormwater requirements of Article V and one additional sewer lateral be required to be constructed for the new parcel at the owners expense. Chairman Card acknowledged a letter received from Pete Maman, 316 S. Riverside Drive opposing the variance request. Chairman Card opened the public hearing. Dominick Micolupo, 300 S. Riverside Drive, owner, stated the original plan was to renovate the property, however it was determined the renovation would be too costly. They felt it would be more cost effective to try and split the lot. Mr. Andrejkovics asked if they would be building two houses. Mr. Micolupo stated one now, and a second possibly in the future. He stated the property to the south would most likely be built first. Mr. Andrejkovics asked why they did not propose to split the parcel evenly. Mr. Micolupo stated to get the square footage equal. Mr. Kennedy asked how long they owned the property and if there were plans for the residences. Mr. Micolupo stated since April and they did not have plans at this time, as they did not know what the lot size would be. Mr. McIntosh asked if they eliminated the possibility of building one structure. Mr. Micolupo stated they have not eliminated that option, but it was a large piece of property and is costly, the taxes would also be high. The issue is not only aesthetic, but financial. Mr. McIntosh asked why they did not consider splitting the lot north/south. Mr. Micolupo felt it would be more attractive this way. The following individuals spoke in opposition of the variance request: Barbara Halme, 306 S. Riverside Drive Roger Bushnell, 310 S. Riverside Drive Don Kramer, 123 N. Riverside Drive Larry Westfall, Ocean Avenue Jean Haughwout, 200 N. Riverside Drive Les Haughwout, 200 N. Riverside Drive Sandy Bushnell, 310 S. Riverside Drive Mr. McIntosh asked about the dock rights. Mr. Lear did not think a second dock would be permitted. Board members discussed the pros and cons of this variance request. Mr. Micolupo stated there were smaller lots all over Riverside Drive with beautiful homes on them and he felt he was not creating something new in the area. Mr. McIntosh stated those lots were not split, Mr. Micolupo was requesting to split the lot. There being no further discussion Chairman Card closed the public hearing and entertained a motion. A motion was made by Mr. McIntosh, second by Mr. Andrejkovics, to deny the variance allowing the creation of a 73.3 foot wide lot and a 68.3 foot wide lot for property located at 300 S. Riverside Drive . The MOTION was APPROVED by the following vote: Yes:Robert McIntosh, Pat Card, Robert Andrejkovics, David Tyree, and Michael Eichhorn5 - No:George Kennedy1 - Absent:Paul Wright1 - 6. OTHER BUSINESS a.Recommendation to City Council for appointment due to the expired term of Pat Card, who is seeing reappointment A motion was made by Mr. McIntosh, second by Mr. Andrejkovics, to send a favorable recommendation to City Council for the reappointment of Pat Card. The MOTION was APPROVED by the following vote: Yes:George Kennedy, Robert McIntosh, Pat Card, Robert Andrejkovics, David Tyree, and Michael Eichhorn 6 - Absent:Paul Wright1 - 7. DISCUSSION ITEMS a. Development Services Director’s Report Mr. Lear had nothing to report at this time. b. Chairman's Report Chairman Card had nothing to report at this time. Agency Members’ Report Chairman Card discussed the previous quarterly report that was provided to the Board. He asked how the projects west of I-95 were moving. Mr. Lear stated Restoration was waiting on their Army Corps permit; Deering Park was still moving forward and there was a lot of interest in it. He added that the Parktowne Boulevard extension would be complete soon as well as the Lineman's College. Mr. Andrejkovics stated they plan to open on November 28. Mr. Lear further commented on the status of Jiffy Lube and Florida Roadhouse. Chairman Card thanked Mr. Lear for the information and complemented him on the ease of getting additional information regarding agenda items. Mr. Andrejkovics stated the Dougherty company was taking over the Corondo Paint facility. He added that he was impressed that Edgewater has the largest industrial acreage in the County. 8. I have lived at this address for 35 years. Please excuse my absence this evening as my elderly mother was admitted to Florida Hospital New Smyrna this morning in intensive care. I am opposed to dividing the lot in question into two smaller lots. This would be inconsistent with the surrounding neighborhood. Changing the established minimum lot size would set a precedent that would be detrimental to surrounding homeowners. At the present time there is no driveway on Riverside Drive for this address. The driveway is on East Palm Way. If the lot is allowed to be divided there would be no access to the southern lot without adding a driveway on Riverside Drive. There is an existing dock at the address. Riparian rights and dock permitting is also in question. Thank you for taking these concerns into consideration. Sent from my iPhone
