90-R-28RESOLUTION NO. 90-R-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGE - WATER, FLORIDA, ADOPTING PROCEDURES FOR PUBLIC PARTICIPATION IN THE PLANNING PROCESS INCLUDING CONSIDERATION OF AMENDMENTS TO THE COMPREHENSIVE PLAN. WHEREAS, the State of Florida has mandated the prepara- tion, adoption and implementation of local comprehensive plans through the passage of the Local Government Comprehensive Plann- ing and Land Development Regulation Act, Chapter 163, Florida Statutes, and, WHEREAS, the Minimum Criteria for Review of Local Govern- ment Comprehensive Plans and Determination of Compliance, Chapter 9J-5, Florida Administratice Code, requires the adoption of proce- dures which provide for public participation in the planning pro- cess, and WHEREAS, the City of Edgewater, Florida, is desirous of the greatest possible public participation in all aspects of the planning process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the following public participation proce- dures outlined in this resolution are hereby adopted: 1. In order to inform each real property owner affected by official actions and the general public, the City of Edgewater, Florida shall advertise in a newspaper of general circulation in the areas in accordance with and pursuant to the provisions of Chapter 163, Florida Statutes, and give notice of official ac- tions to be taken, which result from the creation or implementa- tion of the adopted Edgewater Comprehensive Plan element, or plan amendment, and 2. Information contained in said advertisement shall be distributed in a timely manner sufficient to allow property owners or the general public the opportunity to provide written comments regarding the proposed comprehensive plan, plan element, or plan amendment, and 3. The propsed comprehensive plan, plan element, or plan amendment shall be made available for inspection by the news 1 media, general public and each affected real property owner at the Edgewater Planning and Zoning Department, the Edgewater City Clerk's Office, and the Edgewater Public Library, and 4. The City of Edgewater, Florida, shall hold at least two advertised public hearings on the proposed comprehensive plan, plan element, or plan amendment in accordance with and pursuant to the provisions of Chapter 163, Florida Statutes, and 5. The City of Edgewater, Florida, shall provide opportuni- ties at the public hearings to consider and respond to comments from propoerty owners and the general public regarding the adopt- ed comprehensive plan, plan element, or plan amendment. SECTION 2. That all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed. SECTION 3. That this resolution shall take effect immedi- ately upon its adoption by the City Council of the City of Edge- water, Florida, and approval as provided by law. This Resolution was introduced and sponsored by Councilman Hatfield , and was read and passed by a vote of the City Coun- cil of the City of Edgewater, Florida, at a Regular meet- ing of said Council held on the 7th day of May , 1990, and approved as provided by law.
