RESOLUTION NO. 88-R-30
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, APPROVING AN INTERLOCAL
AGREEMENT FOR DISTRIBUTION OF PROCEEDS OF
LOCAL OPTION GAS TAX; REPEALING ALL RESOLUTIONS
IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE,
WHEREAS, State law provides for the distribution of
Local Option Gas Tax Funds pursuant to an interlocal agree-
ment between the County of Volusia and municipalities within
the County: and
WHEREAS, the County of Volusia has requested that the
municipalities within the County enter into such an inter -
local agreement as attached hereto, and the City Council of
the City of Edgewater deems it advisable and in the best
interests of the City of Edgewater and its citizens to enter
into such agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA:
SECTION 1: The Interlocal Agreement for Distribution
of Proceeds of Local Option Gas Tax, a copy of which is attached
hereto as Exhibit "A", is hereby approved and the Mayor and
Acting City Clerk are authorized to execute the agreement on
behalf of the City of Edgewater.
SECTION 2: That all resolutions or parts of resolutions
in conflict herewith be and the same are hereby repealed.
SECTION 3: That this Resolution shall become effective
Immediately upon its adoption by the City Council of the City
of Edgewater, Florida, at a regular meeting of said
Council held on the 2Oth day of June 198 8 , and
approved as provided by law,
This Resolution was introduced and sponsored by Councilman
Prater and was read and passed by a vote of the City
Council of the City of Edgewater, Florida, at a regular
meeting of said Council held on the 20th day of June
198 8 , and authenticated as provided by law.

EXHIBIT "A"
INTERLOCAL AGREEMENT
F((IR DISTRIBUTION OF PROCEEDS OF
LOCAL OPTION GAS TAX
THIS AGREEMENT, between the COUNTY OF VOLUSIA, a
political subdivision of the State of Florida, and the
municipalities by which it is executed, providing for the
distribution of the proceeds of the local option gas tax imposed
by the County of Volusia under the authority of Section 336.025,
Florida Statutes (1987), is as follows:
1. The first four (4) cents of any gas tax imposed upon
the sale of motor fuel and special fuel within the County under
the authority of the statute referred to above shall be divided
in the following percentages:

2. Only those municipalities eligible for participation
in the distribution of monies under Parts II and VI of Chapter
218, Florida Statutes, are eligible to receive any portion of the
proceeds of the first four (4) cents of the local option gas tax
imposed by the County. Any funds otherwise undistributed because
of ineligibility shall be distributed to eligible governments
within the County in the proportions set forth above.
3. The County's entire share of the proceeds of the first
four (4) cents of the local option gas tax may, but need not
necessarily, be expended on local unincorporated area roads, any
general law to the contrary notwithstanding.
4. The County shall be entitled to receive all proceeds
of the 5th and 6th cents of local option gas tax authorized under
Section 336.025, Florida Statutes. The County shall be obligated
to expend, within the meaning of the statute, those proceeds of
the 5th and 6th cent local option gas tax which it may receive by
virtue of this Agreement on roads classified as collector, minor
arterial, or arterial within the functional classification of
roads provided for by Section 335.04, Florida Statues (1987).
5. This Agreement shall apply to all proceeds of the

local option gas tax levied on motor and special fuels sold
between 12:01 a.m., September 1, 1988, and midnight, August 31,
2013, whether or not those proceeds are actually collected or
received within that period.
6. This Agreement shall become effective if prior to June
1, 1988, it shall have been executed by the County, and by
municipalities representing a majority of the population of the
incorporated area of the County. It may be executed by signature
affixed below or on a separate sheet attaching a copy of the
Agreement. The original Agreement with all original signatures
shall be maintained on file in the office of the County Manager.
If it shall not be executed by the County and by the requisite
number of municipalities prior to the date set forth above, it
shall be of no effect, and any local option gas tax imposed under
the statute referred to above shall be divided as otherwise
provided by law.
IN WITNESS WHEREOF, the parties hereto have caused the
execution hereof by their duly authorized officials on the dates
indicated below.
