88-R-28RESOLUTION NO. 88-R-28 WHEREAS, the City Council of the City of Edgewater, Florida, is desirous of providing a swimming area for the public; and WHEREAS, the designated swimming at Menard-May Park is compatible with the surrounding land uses. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That the City Council of the City of Edgewater, Florida, does hereby request the Board of Trustees of the Internal Improvement Trust Fund to provide the necessary permits to establish a designated public swimming area at Menard-May Park on soverein land and City -owned uplands, lying and being in Volusia County, Florida, and described as: Parcel A Re -described as follows: A parcel of submerged, semi_submerged and filled land lyin4 Easterly from Lots 236 to 241, excepting therefrom the Southerly 25 feet of said Lot 241, Hawk's Park Company Subdivision as recorded In Map Book 1, page 156 of the Public Records of Volusia County, Florida, described as follows: Beginning at a point where the Easterly prolongation of the Southerly R/W line of Ocean Avenue intersects the Easterly R/W line of Riverside Drive, said point being S 32'18'45"E and a distance of 310.69 feet from the Northeast corner of Section 33, Township 17 South, Range 34 East; thence N 64°10'49"E, along the Easterly prolongation of said Southerly R/W line of Ocean Avenue, a distance to the intersection the Northerly line o 241, said Hawks Park S 64'10'49"W, a dist described line to th Riverside Drive; the Easterly R/W line, a Point of Beginning, ce s I'L"11'1b"t, a distance of 18055'54"W, a distance of 180 '54"W, a distance of 144.11 feet of the Easterly prolongation of f the Southerly 25 feet of Lot Company Subdivision; thence once of 195.65 feet along the last said Easterly R/W line of ice N 32°46'57"W, along said distance of 253,62 feet to the Containing 2.42 acres more or less, c� o Parcel B Re -described as follows: Submerged, semi - submerged and filled land lying Easterly from Lots 201, 202 and 203. Hawk's Park Company Subdivision as shown on map in Map Book 1, page 156 of the Public Records of Volusia County, Florida, being more particu- larly described as follows: Beginning at the intersection of the Easterly prolongation of the North line of Lot 201 and the Easterly R/W of Riverside Drive as shown on said Hawk's Park Company Subdivision; said point being S 37°13'54"E and a distance of 122.85 feet from the Northeast corner of Section 33, Township 17 South, Range 34 East; thence N 64010'49"E along the Easterly prolongation of the Northerly line of said Lot 201, a distance of 616.42 feet to the Westerly R/W line of the Intracoastal Waterway, a 500 foot R/W; thence S 26006'43"E along said Waterway R/W line, a distance of 138.29 feet to the intersection of the Easterly Prolongation of the Northerly line of Ocean Avenue, a 50 foot R/W as shown on said Hawk's Park Company Subdivision; thence S 64°10149" W along the last described line, a distance of 609,38 feet to the said Easterly R/W of South Riverside Drive; thence N 29°01'21" W along said R/W, a distance of 138.50 feet to the Point of Beginning. Containing 1.95 acres more or less. SECTION 2: That the City of Edgewater shall be responsible for the placement, maintenance, and removal of buoys at the direction of the Department of Natural Resources and shall provide necessary buoys and delineation of areas. SECTION 3: That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4: That this Resolution shall take effect immedi- ately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
