DESCRIPTION:
Novenski Jon R is the owners of the property located at 3103 Needle Palm Palm
Drive in Edgewater, Florida. It has been found in violation of Section 10-182
(Emergency Repairs) of the City of Edgewater's Code of Ordinances.
BACKGROUND:
On May 29, 2017, The Edgewater Fire Department responded to 3103 Needle
Palm Dr for a structure fire to a vacant residence. Once on scene it was evident
the north side of the residence was fully engulfed with flames shooting out of the
roof. With the assistance of New Smyrna Beach Fire Department the fire was
extinguished. Due to window and door damage caused from the fire and Fire
Department members entering the residence to extinguish the flames within the
interior it was determined Emergency Repairs were necessary to secure the
residence from outside influences.
A $75.00 citation (#6068)/notice of hearing was issued and an email sent to Jack
Derosier of Leisure Services to conduct emergency repairs to the residence by
securing the windows and doors that were damaged.
A copy was placed at City Hall and it was mailed certified.
All notices and provisions of Chapter 10 Article XXVIII have been complied with.
STAFF RECOMMENDATION:
Staff recommends the Board find Novenski Jon R in violation of Section 10-182
(Emergency Repairs) of the Code of Ordinances and assess the citation fine of
$75.00 ,and for a lien to be placed on the property if not satisfied by June 14,
2017.

• Sec. 10-141.-Emergency powers.
The city manager,building official, fire chief,or code enforcement officer shall have the power to
promptly cause a building, structure or portion thereof to be made safe or cause its removal in cases of
emergency which have been determined to involve imminent danger to human life or health. For this
purpose such structure or land on which such structure stands or abutting land or structures may be entered
by such official with such assistance and at such cost as the official may deem necessary. The official may
order the vacation of adjacent structures and may protect the public by appropriate fencing or such other
means as may be necessary and for this purpose may close a public or private way.All costs incurred by the
city pursuant to this section shall be assessed and enforced as stated in s«tiom 111-344 and other controlling
provisions of the city's codes and ordinances
• Sec. 10-182.-Emergency repairs.
For the purposes of this section. the code official shall request the city manager to authorize the
necessary labor and materials to perform the required work as expeditiously as possible.

THIS CAUSE came before the City of Edgewater Code Enforcement
Board (the "Board's on June 8 2017 after due notice of noncompliance to the
Respondent. The Board, after having heard testimony under oath, received
evidence and heard arguments of counsel (if any), the Petitioner _ being_x not
being present, there upon finds as follows:

75.00 and for a lien to be placed on the property if not satisfied by
June 14, 2017. Leisure Services was contacted to make emergency
repairs to the vacant residence by boarding up the windows/doors and
the cost of those repairs for material and manpower totaled $525.00. A
lien should include the amount for the repairs if it is not paid by June
14, 2017.

Volusia County, Florida, and shall constitute a lien against the above

costs associated with recording the lien.
