Reggie Paulk, 2317 Juniper Drive discussed: Wanting to see council approve agenda item No. 10b involving backyard chickens. A motion was made by Councilman Conroy, second by Councilwoman Power, to grant Mr. Freeburn the variance to put up the structure to protect his investment of the boat. APPROVAL OR CHANGES/MODIFICATIONS TO THE AGENDA City Manager requested that Item 10a be pulled referencing the 311 S. Ridgewood Avenue, the Babcock Building as this project is on the back burner. 6. CITY COUNCIL REPORTS Councilwoman Power reported: Hearing from a local architect about how much of a contrast there is and how user friendly the city of Edgewater is compared to New Smyrna. Councilwoman Power also wanted to inform everyone that she will be absent due to a family vacation for the August 3rd budget workshop and the August 7th council meeting. Councilwoman Vogt reported: Enjoying the Fourth ofJuly Fireworks. Mayor Ignasiak reported: Having the opportunity to attend the Rotary meeting to honor Steve Holmes and give thanks for all the great work that they do in the city. Also he stated hearing great compliments about the building department since the personnel change. 7. Robin wanted to remind everyone of the upcoming CRA meeting at 4:45 on August 3rd followed by a budget workshop at 6 pm. Anderson, P.E., C.G.C. v - , 3 STATE OF FLORIDA WBE - FDOT DBE July 9,2017 John McKinney, Finance Director City of Edgewater 104 North Riverside Drive Edgewater, FL 32132 Subject: ITB 17-ES-008 -Boston Rd and S Riverside Dr. Stormwater Improvements Notice of Recommendation to Award -Protest Dear Mr. McKinney, Given the unfortunate circumstance,it is our pleasure to introduce ourselves,Bone Dry Dewatering, LLC (Bone Dry),to you, the City of Edgewater(City), and Quentin L. Hampton Associates (QLH). As you are aware,we were the lowest qualified bidder on the above referenced project. However, the City has opted to award the project to the second lowest qualified bidder. Pursuant to Florida Administrative Code, Chapter 120,please accept this letter as our formal protest to the Notice of Recommendation to Award. Summary On May 9, 2017,the City issued an Invitation to Bid (ITB 17-ES-008)with the sole purpose and intent of obtaining bids from interested and qualified firms offering services to complete the Boston Road and S. Riverside Drive Stormwater Improvements in accordance with the design plans and specifications prepared by QLH. The bid documents stated that "A certified check or bank draft, payable to the City of Edgewater, Florida, or a satisfactory bid bond executed by the Bidder and an acceptable surety, in an amount equal to five percent(5%) of the bid must accompany each bid submitted " On May 17, 2017 at 10:00 am,the City held a non-mandatory pre-bid meeting, and subsequent project site visit. As is illustrated on Exhibit"A", Michael Anderson from Bone Dry was the only licensed contractor to attend the pre-bid meeting. In addition,he met onsite with City representatives, and the Engineer of Record(EOR) to review and discuss the in-field project details. On June 19, 2017 at 3:00 pm, the City received and opened six qualified and responsive bids. The apparent lowest qualified bidder was Bone Dry, as illustrated by Exhibit"B". The second lowest qualified bidder was Hazen Construction,with a bid amount$13,200 more than Bone Dry's qualified bid amount, which equates to approximately 7.5% of the lowest bid amount. At the time of the bid opening, Bone Dry's bid was determined to be a qualified bid that included all of the required bid documents and 5% bid bond. Page 1 of 3 On June 30, 2017, the City's Purchasing Specialist issued the Notice of Intent to Award the project to the second lowest qualified bidder based on the EOR's recommendation(Exhibit"C"). As was stated in the EOR's Recommendation of Award letter, Mr. Giannini touched on Bone Dry's lack of experience under this corporation, but did briefly mention that Michael Anderson had performed similar projects while employed by previous employers. Unfortunately, Mr. Giannini failed to mention Michael's actual qualifications. Michael Anderson is a State of Florida licensed Professional Engineer and licensed General Contractor, and is well known by the EOR and the City Engineer. The previous employers mentioned in Mr. Giannini's letter are heavy civil construction general contracting companies, Westwind Contracting and Masci General Contractors. While employed by those contractors, Michael performed the duties of Project Manager and Project Engineer, where he was the sole project manager responsible for all aspects of running multi-million dollar projects, often times in excess of$15 million, including major roadway construction projects procured by the Florida Department of Transportation (FDOT). Throughout his career at both heavy civil general contractors,Michael managed many civil construction projects of greater magnitude and scope than the referenced project. As a matter of fact, QLH has direct knowledge of Michael's qualifications and ability to manage projects in similar nature as they were the EOR for two of the projects listed on Bone Dry's previous experience submittal, and they have performed as the Construction Engineering Inspection agency for other projects. Margaret Tomlinson, the other principal owner of Bone Dry, is a State of Florida registered Landscape Architect who is employed by the City of Port Orange as the Community Development Construction & Engineering Manager. Margaret has over 28 years of experience in design and construction related disciplines in both the private and public sector. She has performed the duties of Project Manager and Project Administrator for the City of Port Orange's Local Agency Program (LAP)projects with the FDOT for the past six years. Margaret is currently the Project Manager for Riverwalk Park, a 4.4- million-dollar project, the City of Port Orange's hallmark project and largest park investment in recent years. As a Capital Improvement Project Manager and Division Manager for the City of Port Orange, Margaret is experienced in municipal budgeting and procurement and understands the importance of responsible use of taxpayer dollars. In Mr. Giannini's letter, he stated "The City may consider this experience not applicable to Bone Dry. "; however,he did not state that it shall not be considered, which should have led the City to investigate into Bone Dry further to provide a more thorough basis of review utilizing the bidder's qualification Section 00 10 00,paragraph 1.05. As stated in Exhibit"C", the City is provided the option to request the following documentation as desired in order to further review the bidder's qualifications. 1. A sworn statement showing the equipment definitely controlled by the Bidder and available to him for performing the work; 2. A sworn statement of his/her experience in performing work of the character for which his bid is submitted; and, 3. A sworn statement showing his/her current assets and liabilities as of a date not more than ninety (90) days prior to the date of submission. Unfortunately, Bone Dry was not contacted by anyone at the City or the EOR requesting any of these additional documents and the City subsequently issued the Notice of Recommendation to Award to the second lowest qualified bidder without any further investigation into Bone Dry's qualifications. Page 2 of 3 Basis of Protest Bone Dry Dewatering, LLC wishes to protest the Notice of Recommendation to award this project to the second lowest bidder based on the following facts. • Bone Dry Dewatering, LLC is a legal and viable small emerging business recognized by the State of Florida and the Federal Government which has issued a Federal Identification Number. • Bone Dry is licensed, insured, and bonded by a reputable surety company, which satisfies the City's qualification requirements for this project. • One of the principals of Bone Dry, Michael Anderson, who is also a State of Florida Professional Engineer, is a State of Florida General Contractor license holder and is known by the City's Engineer,the Engineer of Record, and other professionals within the community. Having a licensed Professional Engineer with design and construction experience as the Contractor should provide additional confidence to the City in Bone Dry's abilities to solve problems in the field quickly as they arise. • Michael Anderson was the only qualified contractor to attend the pre-bid meeting and subsequent site visit to discuss the project details with City Staff and the EOR. • Bone Dry provided the lowest qualified bid,which included the mandatory 5% bid bond. • Bone Dry's lowest qualified bid was approximately $13,200 lower than the second-place bid. • Regardless of where employed, based on their previous project experience, both principals are exceptionally qualified to manage and complete the project scope. • The City did not exercise the right to further investigate Bone Dry as per Section 00 10 00, paragraph 1.05. In conclusion, although Bone Dry Dewatering, LLC does not have an extensive project resume completed under the Bone Dry entity name, they are a corporation legally established to perform business in the State of Florida; they are licensed, insured, and bonded; they provided the lowest qualified bid which included a 5% bid bond; based on previous professional experience, both of the principals of the company are highly qualified to manage and perform this project; and they were not afforded an opportunity to provide additional information to the City. In addition, Bone Dry is a small emerging business which can focus 100%of their resources to performing this project, which is an advantage over larger companies that have multiple active projects scattered throughout the region.
