83-R-41RESOLUTION NO. 83-R-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, PUR- SUANT TO SECTIONS 13 AND 135 OF THE CITY CHARTER OF THE CITY OF EDGEWA- TER, FLORIDA, PROCLAIMING AND CALLING FOR A SPECIAL ELECTION AND A SPECIAL PRIMARY ELECTION, IF NECESSARY, TO BE HELD FOR THE ELECTION OF A NEW COUNCIL- MAN IN ZONE ONE IN THE CITY OF EDGEWA- TER, AND DESIGNATING THE LOCATION AND PERTINENT DATES OF SAID ELECTION; RE- PEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the office of Mayor of the City of Edgewater became vacant on April 22, 1983, due to the resignation of Mayor Richard MCKillop; and WHEREAS, pursuant to the mandate in Section 13 of the City Charter, Vice Mayor David C. Ledbetter succeeded to the office of Mayor; and WHEREAS, as a result of Vice Mayor, David C. Ledbetter's, succession to the office of Mayor, the office of Councilman for Zone One of the City of Edgewater, Florida is now vacant; and WHEREAS, Section 13 of the City Charter of the City of Edgewater mandates that a special election and a special primary election, if one is needed, be called within forty (40) days of creation of the vacancy. NOW THEREFORE. -BE IT RESOLVED AND PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That candidates for election to the office of Councilman for Zone One for the City of Edgewater shall reside in Zone One, as required by Section 13 of the City Charter and comply with the requirements of Sections 138 and 139, and all other applicable Char:ter,.Code and State election law requirements. Section 2. That the period for qualifying will begin on May 3, 1983, at 8 a.m., and will end on May 13, 1983, at 4:30 p.m. Section 3. That all petitions of candidates shall be filed with the City Clerk at the Edgewater City Hall. Section 4. That in case three (3) or more candi- dates qualify for the office of Councilman of Zone One, then and in that event only, a special primary election will be held on June 7, 1983, from 7 a.m. to 7 p.m, in Precincts 24 and 24A, respectively. The polling place for Precinct 24 will be located at 102 North Riverside Drive, Edgewater, Florida, and the polling place for Precinct 24A will be located at 2927 Lime Tree Drive, Edgewater, Florida. Section 5. That a special general election will be held on June 21, 1983, from 7 a.m. to 7 p.m. in Precincts 24 and 24A, respectively. The polling place for Precinct 24 will be located at 102 North Riverside Drive, Edgewater, Florida, and the polling place for Precinct 24A will be located at 2927 Lime Tree Drive, Edgewater, Florida. Section 6. That the City Clerk of the City of Edgewater is hereby authorized to make any and all necessary arrangements in compliance with the City Charter, the City Code of Ordinances and the State election laws for the above - mentioned special general election and a special primary election, if necessary, and furthermore, to comply forthwith with all necessary posting, advertising or publication require- ments and all other legal.requirements. Section 7. That all resolutions or parts of esolutions in conflict herewith be and the same are hereby repealed. Section 8. That this resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law.
