William Hartzel, 2517 Tamarind Drive, stated he purchased the property in February and found he was in need of additional storage. Mr. Tyree stated there was a typo in the staff report motion, it stated to allow the shed to be 20 feet from the rear property line. Chairman Card closed the public hearing. Mr. Lear provided background information and staffs recommendation. Mr. Lear stated the proposed shed is 192-square feet, not 120-square feet as indicated on the staff report. Chairman Card opened the public hearing. Richard Petronzi, 3022 Juniper Drive, stated he believed in doing the right thing and that was why he was here. Mr. Andrejkovics thanked Mr. Petronzi for the detailed pictures of the request. Chairman Card asked what type of building it was going to be. Mr. Petronzi stated it was a prefab shed and would match the house. Chairman Card closed the public hearing. A motion was made by Mr. Wright, second by Mr. Andrejkovics, to approve the variance request allowing a shed to be constructed eight -feet (8') from the rear property line for property located at 3022 Juniper Drive. The MOTION was APPROVED by the following vote: Yes: 7 - George Kennedy, Robert McIntosh, Pat Card, Robert Andrejkovics, David Tyree, Paul Wright, and Michael Eichhorn C. AN-1611 - Glenn D. Storch, applicant, requesting annexation of 285.113± acres of land located west of I-95 and south of the Indian River Boulevard Extension and the proposed Deering Park development. Mr. Lear provided background information and staffs recommendation. Mr. Lear provided further information regarding the Farmton Local Plan and the Gateway District associated with the Plan. Chairman Card opened the public hearing. Glenn Storch, representing the applicant, stated he was very proud of what has been accomplished for the Farmton project. He detailed the progress and where the project was going. He stated the property will be mixed use, which will allow residential and commercial uses. Mr. Storch stated this property was being annexed now to allow the Ford tract to be annexed. He stated that this is what happens when everybody works together. Chairman Card stated that it has been great to see this develop over the last five (5) years. Chairman Card spoke about the black bear population in this area. Mr. Storch stated he appreciated the City of Edgewater's willingness to work together to solve problems. Storch, applicant, requesting an amendment to the Comprehensive Plan Future Land Use Map to include 670.276t acres of land located west of I-95 and south of the Indian River Boulevard Extension and the proposed Deering Park development as Mixed Use with Conservation Overlay Mr. Lear provided background information and staffs recommendation. Mr. Lear pointed out the hatched areas on the map and stated those were the areas of Conservation Overlay, which indicated to staff that there may be environmental concerns in those areas and an environmental study would be needed. If the study indicated no environmental issues the underlying Mixed Use designation would take over. Chairman Card opened the public hearing. Glenn Storch, representative for the applicant, clarified that the application was for Mixed Use and Mixed Use with Conservation Overlay, that there were areas that did not have Conservation Overlay. Mr. Lear stated the whole property would be Mixed Use and the Conservation Overlay areas are established on the map. Mr. Storch asked to clarify if the owner wanted to develop part of the property that did not have Conservation Overlay there would be no environmenatl study needed. Mr. Lear stated that was correct. Mr. Lear stated the Agreement is flexible, therefore it would be required to be amended prior to any develoment of the property. He added that the Agreement does give the property some entitlements as Mixed Use. Mr. Lear requested the board include in the motion to approve the a accompanying Agreement. Chairman Card opened the public hearing. Glenn Storch, representative of the applicant, stated the MUPUD Agreement also allows for the continuation of the existing agricultural use of the property. He then described the easements that have been obtained for the property and the extension of Indian River Boulevard. Mr. Eichhorn asked if there was intent to take S.R. 442 to S.R. 415. Mr. Storch stated it was proposed to go midway through the Deering Park property. Chairman Card closed the public hearing. A motion was made by Mr. Wright, second by Mr. Tyree, to send a favorable recommendation to City Council for the amendment to the Official Zoning Map to inlcude 670.276t acres of land located west of I-95 and south of the Indian River Boulevard extension and the proposed Deering Park development as MUPUD (Mixed Use Planned Unit Development) and the associated MUPUD Agreement. TA-1602: Amending the Land Development Code (LDC) and Articles II (Definitions); III (Permitted, Conditional, Accessory, and Prohibited Uses) to include regulations related to Medical Cannabis Dispensing Facilities. Mr. Lear stated it did, Article III will allow dispensing facilities in the B-3 zoning district as a conditonal use. There would be one allowed north of S.R. 442 and one south of S.R. 442. Mr. Tyree asked about businesses that would like to grow. Mr. Lear stated it would be an agriculture use. Mr. Eichhorn asked if would inlcude indoor growing facilities. Mr. Kennedy added that the state controls the number of growers and the people who received licenses were already farmers and growing other things. Mr. Wright indicated a typo on page H-23, that "sale" should be "salt". After reivew Mr. Lear stated that sale was correct and the definition for Low-THC should be corrected to state "sale" rather than "salt". He added that would be corrected. A motion was made by Mr. Wright, second by Mr. Andrejkovics, to send a favorable recommendation to City Council for the amendment to the Land Development Code to include regulations related to Medical Cannabis Despensing Facilites as amended. Ridgewood Avenue is being re -developed as granite/marble business, they will be updating the landscaping and parking as well as adding fencing; and the Northwest Linemans College is open for business, their first class has started. b. The Land Development Code requires all fences located within the front -yard setback to be no greater than four -feet (4') in height and non -opaque (50% visibility). The applicant is requesting to allow a six-foot privacy (100% opaque) fence to be located 18-feet from the front property line to allow visitors with RV's to park behind the fence. A permit was issued for the fence on November 14, 2016; which included notes stating the six-foot fence could not be located in the front setback, however the fence was not installed in accordance with the issued permit. Adjacent property owners were notified of the request on December 30, 2016. Staff has not received any objection. After review, the Technical Review Committee (TRC) has recommended denial of the variance request. The maximum allowable height of all fences located in the front yard setbacks and river front lots of residential property not subject to site plan review shall be four feet (4'). Fences located in these areas must be non -opaque (50% visibility). The maximum allowable height of all other fences in residential areas shall be six feet (6') including side corner yards and meet the site triangle requirements. Six (6') foot fences on side corner lots shall be setback ten feet (10') from the property line. In commercial and industrial areas no fence shall exceed ten feet (10') feet in height unless otherwise approved as part of a development plan and meet the site triangle requirements. The filling or berming of property solely for the purpose of creating a barrier that exceeds the height requirements contained herein is prohibited. e. Concrete block walls shall be constructed with appropriate reinforcement as determined by the Building Official. Block walls shall be stucco and painted to compliment the surrounding character of the area. f. All fences shall be erected with the finished side facing outward or away from the enclosed screened area. The "good -side" (side without posts) of fence shall be facing public view. g. Approval to exceed maximum height limitations may be granted by the Development Services Director/Planning Director subject to either of the following; 1. The enclosed or screened area is sufficiently lower than adjoining lands to render a fence of the maximum allowable height inadequate for its intended purpose. 2. The area to be enclosed or screened contains a nuisance or a hazard that cannot adequately be encompassed or obscured by a fence of the maximum allowable height. h. Fences with barbed wire shall be prohibited in conjunction with residential development. In nonresidential development, up to three (3) strands of barbed wire may be installed at the top of a fence. For regulatory purposes, barbed wire shall not be included in the measurement of the fence height. In no case shall barbed wire be allowed to overhang or extend outside of the property lines of the site on which the fence is installed, nor shall any barbed wire be installed at a height of less than six -feet (6') with the exception of agriculturally zoned property. i. Electric or electrified fences shall be prohibited except in agriculturally zoned districts for the containment of livestock. j. Customary fencing around public recreational amenities shall be exempt from height restrictions. k. Opaque fencing shall not be permitted on lots fronting on large lakes, rivers, golf courses or other common areas deemed as an aesthetic amenity. Rev. 6/6/16 (Land Development Code) 1I1-34 21-37.07 — Inspections to Ensure Compliance The City shall provide scheduled and unscheduled inspections prior to and/or during the special activity by police, fire, code enforcement, building and/or City administration representatives to monitor and ensure compliance with all applicable City, County and State codes. Special activity permits that include outdoor entertainment may require a code enforcement officer to remain on site during the activity. The cost of said officer shall be reimbursed to the City by the sponsor/promoter. Appropriate State agencies are responsible for the inspection of amusement rides and public food preparation facilities. 21-37.08 — Penalties Any person or entity who shall conduct, operate or maintain a special activity and fails to obtain a special activity permit shall be ordered to cease and desist and be punished by a fine of three times the cost of the application fee as well as all associated City fees. No further special activities shall be authorized until all penalties are current. A repeat offender shall not be eligible for a special activity permit for a one-year period. A repeat offender is defined as a sponsor/promoter who violates any of the conditions of the special activity permit more than one time in a six-month period. 21-37.09 — Exceptions Any special activity sponsored/promoted by a civic group or non-profit organization or co- sponsored by the City of Edgewater may be exempt from any and all fee requirements. This decision shall be rendered by the City Council and any waiver granted regarding these requirements is only binding and applicable upon that one activity or portion thereof and shall not mean that the sponsor/promoter has any rights to future waivers. SECTION 21-38 — FENCES, WALLS and HEDGES 21-38.01— Purpose The purpose of this Section is to set forth the standards necessary to regulate the use of fences. 21-38.02 — General Requirements The following regulations shall apply to the erection of fences, walls and hedges. a. All fencing materials must comply with the definition in Article Il. b. All fences shall comply with the provisions of the applicable building codes and are required to obtain a building permit. c.
