81-R-51RESOLUTION NO. 71- R -.9 A RESOLUTION DECLARING THE CITY OF EDGEWATER'S INTENT $, TO PROCEED TO APPOINT A CITY MANAGER, AUTHORIZING COMPENSATION TO BE PAID FROM MONIES APPROPRIATED TO FINANCE AND ADMINISTRATION,DIRECTING THE CITY CLERK TO RECOMMEND REVISING THE APPROPRIATION ORDINANCE, INVITING THE PROSPECTIVE CITY MANAGER TO APPEAR BEFORE THE COUNCIL, REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The § 9A City Charter of the City of Edgewater provides that the city council shall have the power to appoint a city manager, and WHEREAS, § 9A of the City Charter is a grant of power and not a limitation on power, hence it has full force and effect under Municipal Home Rule as per Article VIII of the Constitution of Florida, and Chapter 163 Florida Statutes,and WHEREAS, section 2-2 of the Edgewater Code of Ordinances provides for the powers and duties of a city manager upon appointment by the City Council, and WHEREAS, the City Council has determined that it is in the best interests of the citizens and government of the City of Edgewater, that a City Manager be appointed as soon as possible, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. The City Council declares its intent to proceed under Section 9A of the City Charter to select and appoint a city manager for the City of Edgewater. SECTION 2. Upon appointment of a city manager, he shall be compensated for his services from monies appropriated to Finance and Administration. SECTION 3: The city manager shall be compensated at a salary to be determined in the resolution appointing the city manager. SECTION 4. The city clerk shall report to the city council at the public hearing scheduled for May 18, 1981, recommending amendment of the appropriation ordinance, ordinance 80-0-78, to authorize sufficient revenues to fund the office of city manager. 9V- (2—S/ SECTION 5. The city council by appropriate motion may invite a prospective city manager to appear before the council to negotiate terms of appointment. SECTION 6. That all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 7. That this resolution shall take effect immediately upon its adoption by the city council and approval as provided by law.
