81-R-57$ RESOLUTION N0,gI-K-J 7 � A RESOLUTION CREATING A CHARTER REVIEW COMMISSION FOR THE CITY OF EDGEWATER, FLORIDA; PROVIDING FOR PURPOSE AND DUTIES OF SAID BOARD; APPOINTING MEMBERSHIP THEREOF, REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The Charter of the City of Edgewater, Florida has not fully reviewed and revised since the enactment of the Municipal Home Rule Powers Act, and WHEREAS, Many of the provisions of the Charter are void or inneffective as a result of the passage of said Act of the Legislature, and WHEREAS, The City Council is desirous to review the Charter that an appropriate proposal may be submitted to the electors of the City of Edgewater, that their form of government might be improved upon, and WHEREAS, The City Council recognizes the importance of citizen imput into the process of charter revision, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That there is hereby established within the City of Edgewater, Florida, a Charter Review Commission, for the express purpose of reviewing, studying, and analyzing the Charter of the City of Edgewater, to determine if changes, amendments, or revisions are necessary, and to report same to the City Council and the citizens of the City. SECTION 2. The Commission shall consist of twenty-six members who shall be appointed in the following manner: Each Council- man shall have the power to appoint five members of the Commission, and the Mayor shall appoint six members. Each Councilman and the Mayor shall file with the City Clerk his appointments within ten days of the effective date of this Resolution. Upon acceptance and taking of the oath of office, each member shall be entitled the duties and responsibilities of the position. Only such persons who are registered electors within the City of Edgewater on the effective date of this resolution, shall be entitled to membership on the Commission. SECTION 3. The Mayor and members of the City Council shall serve in an ex officio capacity with the Commission. The City Manager and City Attorney shall serve in an advisory capacity to the Commission. In addition, the Commission may summon such other employess of the City to assist them in the completion of their tasks. SECTION 4. The Commission shall meet at such regular times as they may agree, or at the call of the Chairman. It shall review the Charter of the City of Edgewater, and make such studies and analysis in order to determine if the Charter should be revised or amended in any way. If the Commission determines that amendments are necessary, or that a revision is required, then the Commission shall report its recommendations to the City Council. Prior to reporting its recommmendations as to specific amendments or revisions, the matter shall be referred to the legal department that same may be approved as to legality and form. The recommmendations shall be submitted to the City Council with sufficient time to review same with adequate public hearing prior to placing the matters before the electors of the City of Edgewater. SECTION 5. The Commission shall elect from its members a Chairman and a Vice Chairman to call and preside over meetings of the Commission. In addition thereto, the Commission may appoint a Secretary to record minutes thereof, or may request the City to provide a staff person for this position. The City shall provide adequate assistance to the Commission that it may perform its duties imposed by this Resolution. SECTION 6. All meetings of the Commission shall be public, and the records thereof shall be open to inspection as per Florida law. All members of the Commission shall be subject to the provisions of Florida's open meetings law (Chapter 286 Florida Statutes), and shall file with the clerk a disclosure of financial interests as re- quired by law. SECTION 7. All Resolutions or parts of Resolutions in con- flict herewith be and same are hereby repealed. SECTION 8. That this resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law.
