81-R-65o a RESOLUTION NO. ✓ ^dw A RESOLUTION AUTHORIZING THE APPOINTMENT OF JOHN R. GODBEE, JR., AS SPECIAL COUNSEL FOR THE CITY OF EDGEWATER, FLROIDA, AUTHORIZING A RETAINER AND HOURLY FEE FOR HIS SERVICES; FURTHER ESTABLISHING THE EDGEWATER LEGAL DEFENSE FUND FROM UNAPPROPRIATED RESERVES FOR FISCAL YEAR 1981-1982; REPEALING ALL RESOLUTIONS IN CONFLICT AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Mayor has brought a civil action against the City of Edgewater in the Circuit Court in and for Volusia County, Florida, entitled ROBERT H. CHRISTY vs. THE CITY OF EDGEWATER, which challanges the Charter and Government of the Municipality, and WHEREAS, the City Attorney of the City of Edgewater has withdrawn from representation in this cause pursuant to the Code of Professional Responsibility: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF EDGEWATER, FLORIDA: SECTION 1. That JOHN R. GODBEE, JR. of the Law Firm of Coble, McKinnon, Rothert, Bohner, Barkin P, Godbee, P.A., of Daytona Beach, Florida, is hereby appointed as special counsel for the City of Edgewater, Florida, and is specifically authorized to appear on behalf of the City of Edgewater, Florida, in the above referenced civil action and all legal proceedings related thereto. SECTION 2. That said Special Counsel shall be paid a retainer in the amount of Two Thousand Five Hundred Dollars ($2,500.00), and shall be compensated for his services in the amount of One Hundred Dollars ($100.00) per hour, the first twenty five hours to be paid from the retainer. SECTION 3. There is hereby created the Edgewater Legal Defense Fund to be established initially in the amount of Fifteen Thousand Dollars ($15,000.00), to be established from unappropriated reserves from Fiscal Year -1981-1982, The Office of Special Counsel for the City of Edgewater, Florida, shall be funded from this special appropriation. SECTION 4, That the Office of Special Counsel and funding therefor shall be under the direct supervision of the City Council of the City of Edgewater, Florida. SECTION S. That all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION -6. That this resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law.
