A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
OSPUBLIRESOLUTIONS ' IMPOSING CERTAIN
EQUIRRNSOONTHEREODTIONOF DOCUMENTS;
FLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the legislature of the State of Florida in the 1981
session has passed and the Governor of the State of Florida has signed
Senate bill number 406 being Fla. Stat. 81-245, to be codified at
section 119.07 (b) F. S. allowing municipalities to charge costs for
public documents based upon clerical and supervisory assistance,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That any person desiring a copy of any public record
on file with the City of Edgewater, Florida shall complete and sign
the Public Records Request Form, a copy of which is attached hereto
and made a part of this Resolution.
SECTION 2. That the requesting party shall pay a charge of
$ i%. zS` per copy at the time that the request form
is submitted to the City Clerk or Deputy City Clerk. Should the re-
questing party refuse to pay for the requested documents, the request
will not be honored by the City.
SECTION 3. When the nature or volume of the records requested is
such as to require extensive clerical or supervisory assistance by
city employees, the City Clerk shall assess an additional charge
which is based upon the actual time involved by the employee pro-
viding for the supervisory assistance. This rate shall be based
upon the hourly rate of the salary of this employee. The City Clerk
may waive this requirement if it involves a reasonable request from
a representative of the news media, civic organization (non -political),
or historical society.
SECTION 4. That the City Clerk, upon receipt of the properly
executed request form and required fees, shall, within at least three
(3) working days, provide the requested documents to the requesting
party if the documents are readily available. If the documents are
not readily available, then the City Clerk shall furnish the requested
documents within a reasonable time.
SECTION 5. That any request from any person for a typed verbatim
transcript of any City Council or City Board meeting must be approved
by the City Council. If said request be approved by the Council, then
the Council may, by motion, impose a reasonable fee for the preparation
of said verbatim transcript, which fee shall be collected by the City
Clerk or Deputy City Clerk from the requesting party prior to the pre-
paration of said transcript.
SECTION 6. That the reproduction of any tape recording of any
City Council or City Board meeting is hereby prohibited unless required
by order of court. Any person desiring to listen to the tapes of any
City Council or Board meeting may do so at a time to be designated by
the City Clerk or Deputy City Clerk and in the presence of the City
Clerk or Deputy City Clerk,ef�r
SECTION 7. That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby rescinded.
SECTION 8. That this resolution shall take effect immediately
upon its adoption by the City Council and approval as provided by law.
The first reading of the Resolution was read in full and passed
by a vote of the City Council of the City of Edgewater, Florida, at a
Regular meeting of said Council held on the IL day off , 1981,
and approved as provided by law.
