81-R-83RESOLUTION NO. rI R- 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA AUTHORIZING APPROPRIATE OFFI- CIALS OF THE CITY OF EDGEWATER, FLORIDA, TO EX- ECUTE A CERTAIN AGREEMENT WITH THE VOLUSIA COUNTY COUNCIL CONCERNING THE USE OF THE POPULATION OF THE CITY OF EDGEWATER TO BE INCLUDED WITH VOLUSIA COUNTY GENERALLY IN ORDER TO QUALIFY FOR URBAN COUNTY STATUS FOR A COMMUNITY DEVELOPMENT GRANT FOR THE PURPOSES OF FUNDING PROJECTS WITHIN THE ` CITY OF EDGEWATER, FLORIDA, AND VOLUSIA COUNTY GENERALLY: REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the population of Volusia County, Florida, less that of Daytona Beach creates an Urban County for the purpose of entitle- ment to certain community development block grants, and WHEREAS, the City of Edgewater, Florida, wishes the Volusia County Council to use its population to qualify the County for the receipt of millions of dollars of monies from the Department of Housing and Development, and WHEREAS, the City of Edgewater, Florida, is desirous to utilize some of these millions of dollars for which it can qualify, NOW THEREFORE BE IT RESOLVED BY THE CITY OF EDGEWATER, FLORIDA: .SECTION 1. The City Council does hereby authorize the appropriate officials of the City of Edgewater, Florida, to execute a certain agree- ment between the City of Edgewater and the Volusia County Council con- cerning the qualifications for an expenditure of community development block grant monies, said agreement being attached hereto and incorpor- ated by reference herein and marked "Exhibit A". SECTION 2. All Resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 3. That this Resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law. The first reading of the Resolution was read in full and passed by a vote of the City Council of the City of Edgewater, Florida, at a Regular meeting of said Council held on the 2 day of September, 1981, and approved asprovided by law yor. . nci ma 4 -),-.14- 9 / - .h. 93 A RESOLUTION OF THE CITY COUNCIL AUTHORI ZING THE CITY OF EDGEWATER , FLORIDA TO ENTER INTO A COOPERATION AGREEMENT WITH THE COUNTY OF VOLUSIA TO UNDERTAKE OR ASSIST IN UNDERTAKING ESSENTIAL ACTIVITY PURSUANT TO THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM WHEREAS. It is the desire of the City of EDGEWATER Florida that the County of Volusia obtain community development block grant funds to carry out community development and housing assistance activities; and WHEREAS. these activities should be carried out in coordination with the City of EDGEWATER , Florida. FLORI DA: NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF EDGEWATER SECTION l: That the Chief Executive Officer of the City of EDGEWATER , Florida is hereby authorized to enter into the cooperation agreement with the County of Volusia on behalf of the City. SECTION 2: That this resolution shall become effective immediately upon its adoption. ADOPTED AT A REGULAR MEETING OF THE EDGEWATER CITY COMMISSION on this day of DECEMBER A.D. 198 � O ATTEST: c COOPERATION AGREEMENT THIS AGREEMENT, entered Into this 2nd day of November by and between the City of Ed ewater Flo rt da ereln ca led the City'' and Volusia County, Florida (herein ca a the County , WITNESSETH: WHEREAS, the Housing and Community Development Act of 1974 makes provisions whereby urban counties may enter Into cooperation agreements with certain units of local govern- ment to undertake or assist in undertaking essential activities pursuant to Community Development Block Grants; and WHEREAS, the cooperation of the City of Edgewa r and the County is essential for the successful planning and carrying out of local Community Development programs; and WHEREAS, it Is the desire of the parties that the County undertake activities necessary to plan and carry out or assist in carrying our Community Development and housing assistance activities on behalf of and in coordination with the city under the urban county program, NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. The City hereby authorizes the County to make application for and receive Community Development Block Grant from the U. S. Department of Housing and Urban Development (HUD) on behalf of the City, and further shall authorize the County to include the City's population for the purpose of calculating and making Community Development Block Grants directly to the County. 2. The County shall, through the use of Community Development funds, provide the staff resources and other services necessary to planning and administering Community Development programs on behalf of the City. 3. The City will cooperate with the County to the fullest extent practical in the planning and carrying out of Community Development programs, and the County will ensure that the City's citizens and its local chief executive have direct and frequent access to and influence on the process by which decisions are made concerning Community Development programs which either directly or indirectly affect the City. The City agrees that the County shall have final responsibility for selecting projects and filing annual grant requests. 4. Pursuant to the use of the Community Development Block Grant funds, if any, to be received by the County, the County may carry out Community Development programs for the City. The City and County agree to cooperate to undertake, or assist in undertaking, community renewal and lower Income housing assistance activities, specifically urban renewal and publicly assisted housing. 5. The County is authorized to withhold a reasonable and customary portion of Community Development Block Grant funds for the purpose of planning and administration of Community Development programs. 6. The parties do hereby mutually commit to conform to all laws and regulations set by the Federal Government respecting the use of any monies granted pursuant to the Housing and Community Development Act of 1974. 7. The County and City shall comply with the provisions of the National Environ- mental Policy Act of 1969, Title VI of the Civil Rights Act of 1964, Title Vill of the Civil Rights Act of 1968, Executive Order 11988, Section 109 of the Housing and Community Development Act of 1974 and other applicable laws. 9.
