81-R-84RESOLUTION NO. 81-R-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, GRATEFULLY ACKNOWLEDGING THE GENEROSITY AND: BENEVOLENCE OF LYMAN W. MENARD, CORNELIA MENARD WEPPLER, KENNETH G. MAY, AND PHYLLIS E. MAY, FOR DONATING MENARD BEACH TO THE CITY OF EDGEWATER; FORMALLY ACCEPTING MENARD BEACH ON BEHALF OF THE CITIZENS OF EDGEWATER; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. W-H-E-R-A-S, Menard Beach has a rich and colorful history which long predates the establishment of the City of Edgewater, and has long been used as a waterfront park by all of our, citizens, and W-H-E-R-E-A-S, The City of Edgewater gratefully acknowledges that the public useage of this beautiful land along the Indian River was through the benevolence and permission of Mrs. Merriel W. Menard, who departed this life on December 1, 1977, and W-H-E-R-E-A-S, the heirs of Mrs. Merriel W. Menard have volunteered to make a generous gift of the south portion of Menard Beach to the City of Edgewater for its perpetual use by the public, and W-H-E-R-E-A-S, Lyman W. Menard of Daytona Beach, and Cornelia Menard Weppler of Tequesta, Florida, have tendered Quit Claim Deeds conveying the south portion of Menard Beach to the City of Edgewater, Florida, and W-H-E-R-E-A-S, Kenneth G. May and Phyllis E. May, his wife, are the owners of the north portion of Menard Beach, and W-H-E-R-E-A-S, The Mays, in consideration of their love and affection for the City of Edgewater, are desirous of conveying all of Menard Beach to the City for its use as a public waterfront park, and W-H-E-R-E-A-S, The Mays have made a generous gift to the City of Edgewater by tendering a Deed of Gift to the City for the north portion of Menard Beach, and W-H-E-R-E-A-S, The City of Edgewater, on behalf of its citizens, gratefully acknowledges the unsolicited benevolence of the Menard Family and the May Family for their gift of this precious natural resource for the perpetual use of the public. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the City of Edgewater, Florida, does formally acknowledge and accept the Quit Claim Deeds of Lyman W. Menard and Cornelia Menard Weppler, dated December, 1981, conveying to the City of Edgewater the south portion of certain realty commonly known as Menard Beach. SECTION 2. That the City of Edgewater, Florida, does formally acknowledge and accept the Deed of Gift by Kenneth G. May and Phyllis E. May, husband and wife, dated December 21, 1981, conveying to the City of Edgewater the north portion of certain realty commonly known as Menard Beach. TED SECTION 3. That the City of Edgewater does hereby covenant to use the Menard Beach Park solelyfor public purposes asa. waterfront park subject to restrictions of record. SECTION 4. That the City of Edgewater does gratefully acknowledge the unsolicited benevolence of this generous giftby the Menard Family and the May Family, and the City Council does hereby call upon the citizens of our community to outwardly express its gratitude for these generous contributions to the benefit of our city. SECTION. 5. That all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 6.
