82-R-36ti RESOLUTION NO. 82-R-36 A RESOLUTION OF THE COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, APPROVING THE FINDINGS OF THE EQUALIZING BOARD OF THE CITY OF EDGE - WATER, FLORIDA, WHICH MET ON JULY 12, 1982, FOR PURPOSES OF CONSIDERING ANY AND ALL COM- PLAINTS AS TO THE SPECIAL ASSESSMENTS FOR ROAD PAVING AS CALLED FOR IN RESOLUTION 82-R 32, REPEALING ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH. WHEREAS, the Council of the City of Edgewater, Florida, has determined to make public improvements within the City of Edgewater by paving certain previously designated roads; and WHEREAS, the Council of the City of Edgewater has by Resolution No. 82-R-32 stated the nature of the proposed improvements and deter- mined that the properties benefited by this program shall be assessed for the improvements in proportion to the benefits to be derived there- from, said special benefits to be determined and prorated according to the foot frontage of the respective properties specially benefited by said improvement; and WHEREAS, an assessment roll has been completed and filed with the Council showing the lots and lands to be assessed, the amount of the benefit to and the assessment against each lot or parcel of land, and showing that the assessment may be paid in installments and show- ing the number of installments in which the assessment is divided; and WHEREAS, a public hearing was had on the 12th day of July, 1982, so that,owners of the properties to be assessed, or any other interest- ed person, could appear before the Council and be heard as to the propriety and advisability of making such improvements, as to the costs thereof, as to the manner of payment therefor and as to the amount thereof to be assessed against each property so improved; and WHEREAS at said public hearing, the Council also sat as an equal- izing board to hear and consider any and all complaints as to the special assessments and to adjust and equalize the assessment based on justice and right; and WHEREAS, there were no complaints made as to the application of the assessment of the foot frontage basis; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the method of applying the assessments on the foot frontage basis is hereby approved and confirmed and shall remain legal, valid and binding first liens upon the property against which the assessments are to be made, until paid, as per Florida Statutes Section 170.08. SECTION 2. That the assessment roll as completed and published is hereby confirmed and ratified. SECTION 3. That all resolutions or parts of resolutions in con- flict herewith be and the same are hereby repealed. SECTION 4. That this resolution shall take effect immediately upon its adoption by the City Council. The Resolution was read in full and passed by a vote of the City Council of the City of Edgewater, Florida at a regular meeting of said council held on the 19th day of July, 1982, and approved as provided by law.
