A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA; REPEALING THE CODE
ENFORCEMENT BOARD BY-LAWS IN ITS ENTIRETY;
REPEALING RESOLUTIONS IN CONFLICT HEREWITH
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS,the City of Edgewater has made the following determinations:
1. During the August 10, 2017 Code Enforcement Board meeting, the Board voted to
recommend a repeal and restatement to their existing by-laws in its entirety.
2. During the September 25,2017 City Council Meeting, Council made the determination to
sunset/abolish the Citizen Code Enforcement Board and delegate all matters to the Special
Magistrate.
3. On October 2, 2017, Council considered and approved at first reading, Ordinance No.
2017-0-45 which will abolish the Citizen Code Enforcement Board. Council will
consider/approve during second reading/public hearing on November 13, 2017 to abolish the
Board.
4. Pursuant to Council action during the November 13, 2017 Council meeting
sunsetting/abolishing the Citizen Code Enforcement Board, Council further determines since the
Board is no longer in existence at this time, there is no need for By-Laws.
5. Resolution No. 2017-R-31 hereby repeals the Citizen Code Enforcement By-Laws
(Exhibit"A")in their entirety.
NOW, THEREFORE,be it resolved by the City Council of Edgewater, Florida:
Section 1. The City of Edgewater hereby repeals the Citizen Code Enforcement Board
By-Laws which are attached hereto and incorporated herein as Exhibit"A".
Section 2. All resolutions or parts of resolutions in conflict herewith are hereby repealed.
Section 3. This resolution shall take effect upon adoption.

This resolution was scheduled for the Council Meeting on September 11, 2017 however,
due to Hurricane Irma the Council Meeting was re-scheduled to September 18, 2017 with the
appropriate notices done.
During the September 18, 2017 City Council meeting, a motion was made by
Councilwoman Power with second by Councilman Blazi to continue/move this item to the
November Council meeting. The motion for continuance was approved with the following vote:

Edgewater,Florida.hereinafter referred to as"CEB".
The purpose and intent of these By Laws is to set forth a uniform set of procedures
whereby the City of Edgewater Citizen Code Enforcement Board may regulate the
manner in which it elects officers, conducts meetings, and otherwise carries out it:,

1. The CEB shall have seven (7) voting members. ach member shall be
appointed by City Council for a term of three (3) years and shall be subject to
removal as set forth by Council. The terms of the appointment shall be
staggered.

3. Prior to appointment, prospective members shall submit a City application,
stating herein a brief synopsis of their education, experience and reason for
their interest in serving on the CEB.
/1. To be eligible for appointment, a prospective member shall be a resident of
the City of Edgewater.
5. No member of the CEB shall receive compensation for their service,
provided, however, that members may be reimbursed for out of pocket
