The Special Magistrate, after having heard testimony under oath and received evidence from Development Services Director Darren Lear and Interim Building Official Mike Knotek for Petitioner; Jack Hayman and Jim Ogram, with the Respondent not being present, thereupon issues the following Findings of Fact,Conclusions of Law and Order: I. FINDINGS OF FACT: Based on the evidence and testimony presented: 1. The Respondent, Nancee Michaux, Est., is the owner of the property located at: 3012 Travelers Palm Drive,Edgewater, Florida. 2. There exists on the subject property the following violation(s)of the Code of Ordinances - Sec. 10-138: (a) (1) it is a public nuisance; (a) (2) (a) it is vacant, unguarded and has open doors and windows; (b) there is an unwarranted accumulation of debris and combustible material.therein; (c)creates hazards with respect to means of egress and fire protection as provided for the particular occupancy; (d) there is a falling away, hanging loose or loosening of any siding,block, brick or other material; (e)there is a deterioration of the structure or structural parts; (f) the structure is partially destroyed; (g) there is an unusual sagging or leaning of out of plumb of the structure or any parts of the structure and such effective cause by deterioration of over-stressing; and (h) the electrical or mechanical installations or systems create a hazardous condition. H. CONCLUSION OF LAW The Special Magistrate finds the Respondent,Nancee Michaux,Est.,is in violation of City of Edgewater Code Sections as specified immediately above.
