883ORDINANCE NO. 883 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, REGULATING THE CONSTRUCTION, MAINTENANCE, OPERATION, LOCATION AND SAFETY PRINCIPLES OF ALL SWIMMING POOLS IN SAID CITY; PRESCRIBING STANDARDS AND REQUIREMENTS FOR THE CONSTRUCTION, MAIN- TENANCE, OPERATION, LOCATION AND SAFETY -- OF SWIMMING POOLS AND SWIMMING POOL EQUIPMENT AND APPARATUS; AND PRESCRIBING THE DUTIES AND RESPONSIBILITIES OF THE BUILDING OFFICIAL WITH REFERENCE THERETO; PRESCRIBING PENALTIES FOR VIOLATION AND FURTHER PROVIDING AN EFFECTIVE DATE THEREFOR. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Definitions For the purpose of this ordinance the following, terms, phrases, words, and their derivations shall have the meaning given herein. When not consistent with the context, words used in the present tense include the future, words in the plural number include the singular number. The word "shall" as used herein is mandatory and not merely directory. A. "City" is the City of Edgewater, Florida B. "City Council" is the City Council of the City of Edgewater, Florida. C. "County Sanitarian" is the County Sanitarian of Volusia County. D. "State Health Department" is the Florida State Board of Health. E. "Person" is any person, firm, partnership, asso- ciation, corporation, company, or any organization of any kind. F. "Swimming Pool" is a body of water in an artificial or semi -artificial receptacle or other container whether located indoors or outdoors, used or intended to be used for public, semi-public, or private swim- ming by adults and/or children, whether or not any charge or fee is imposed upon such adults or children, operated and maintained by any person as here defined, shall include all structures, appurtances, equipment, appliances and other facilities appurtenant to and intended for the operation and maintenance of a swim- ming pool. (1) "Family Swimming Pool" shall be any swimming pool used or intended to be used solely by the owner, operator or lessee thereof and his family, and by guests invited to use it without charge or pay- ment of any fee. (2) "Wading Pools" shall be any swimming pool with a surface area of less than two hun- dred fifty (250) square feet and is less than twenty-four (24) inches in depth at any point. (EXCEPTION) Wading Pools shall not be required to comply with this ordinance, except that plans shall be submitted for approval and permits, and the requirements of Paragraph A, Section3, shall be complied with. SECTION 2. Permits. A. Application: Before the erection, construction or alterations of any swimming pool is begun, an application for a permit shall be submitted to the Building Official for approval. Plans and Specifications: The application shall be accompanied by two sets of full and complete plans and specifications of the pool, including plot plans of lot showing distance between buildings or structures and from all property lines. SECTION 3. Structural Requirements. All swimming pools whether constructed of reinforced concrete, pneumatic concrete, steel, plastic, or others, shall be designed and constructed in accordance with the requirements of the local building code (an adaption of the Southern Standard Building Code) and accepted engineering principles. B. Masonry Construction: (1) Footings shall be of a minimum 8" x 12" or in cross sec- tion or, an approved method by the Building Inspector with two 5/8" bars continuous and shall be 3000NPSI concrete, minimum. (2) Floors shall be reinforced concrete, a minimum of 4" thick with a minimum of 2" top and bottom cover for steel and shall be reinforced with 3/8 inch bars at 24 inch center to center each way, or an equivalent steel area with bar spacing not to exceed 24 inches and shall be a minimum 30008PSI concrete. (3) All voids of masonry units that contain reinforced steel shall be filled solid with "Pea Rock Concrete" which will attain a minimum compressive strength of 3000M PSI in 28 days and shall be reinforced with 3/8 inch bars, 14 inch on center vertically and every third course shall be lintel course reinforced with two 1/2 inch bars continuous. The top course shall be a reinforced lintel course or another cap course as approved by the Building Official. (4) All plans and specifications shall be submitted for above ground pools and shall be approved by the Con- sulting Engineer of the City. -2- SECTION 4. Special Requirements. A. Enclosures: All swimming pools constructed in rear or side yards shall be completely enclosed with a fence or wall, or acceptable screening at least four (4) feet high, and not more than six (6) feet high, and so constructed as to not be readily climable by small children. All gates or doors providing access to pool area shall be equipped with a self -closing and self -latching device installed on the pool side for keeping the gates or doors securely closed at all times when the pool area is not in actual use, except that the door of any dwelling which forms a part of the enclosure need not be so equipped. (1) Front Yard Pools: Prohibited. B. Filtration and Re -circulation System: All swimming pools shall be equipped with a filtering and re -circulation system and such systems shall be approved by the County Sanitarian. C. Yard Set Back: No swimming pool shall be constructed closer than five (5) feet from any property line or building. D. Overhead Electric Wiring: No overhead electric wiring shall be permitted within , fifteen (15) feet horizontal distance from the water's edge unless by special permission of the Building Official. E. Electrical Wiring: All wiring shall be in strict conformance with the National Electric Code and the local Electric Code. F. When plumbing is connected to City service for water supply, all plumbing shall be in strict accordance with local plumbing code. When water is supplied from other sources than City connected service to family pools, plastic pipe stamped and approved 1000 by ASTM Laboratory may be accepted if inspected and approved by Plumbing Inspector. G. Water Supply: Water used in filling swimming pools shall be from a sanitary source of supply only and shall be kept sani- tary by a method approved by the County Sanitarian. H. Dishcarge Water: Water being discharged from the pool or from the back flushing of the filtering system may be dis- charged to a storm sewer, dry well, seepage pit, or through an irrigation system or other approved method. by the Con- sulting Engineer of the City. Discharge water may NOT be discharged into a sanitary or combined sewer. I. Rim Height: The overflow rim of all swimming pools shall be a minimum grade above surrounding ground level and in all cases sufficiently high to prevent ground water from flowing into pool. J. Walk -way: A walk -way of concrete -or other approved materials shall completely surround all swimming pools from the over- flow rim outward a distance of at least three feet and shall be so designed that water can not drain from the walk -way into the pool. K. Water inlets should be spaced around the periphery of the pool to provide uniform distribution of water. About 75% of the re -circulated water should enter the shallow section. Outlets should be located in the deepest section of the bottom to facilitate good circulation through the pool. -3- L. A beam overflow skimmer shall be required and be designed so that debris caught in it will not be washed back into the pool by water movements. SECTION 5. State Sanitary Code. All requirements of Chapter XX of the State Sanitary Code adopted by the Florida State Board of Health are adopted as part of this Ordinance. SECTION 6. Violations and Penalties. Any person violating any of the provisions of this Ordinance or failing to comply with any order or notice properly given or issued by the Plumbing Inspector or Building Official as pro- vided herein shall be deemed guilty of a misdemeanor and shall be punished by a fine of not less than one nor more than five hundred dollars, or by imprisonment at the discretion of the judge trying the case. Each day any such violation shall con- tinue shall constitute a separate offense. SECTION 7. Schedule of Permit Fees. (1) For a valuation over $100.00 up to and including $15,000.00 the fee shall be $3.00 per thousand or fraction thereof. (2) For a valuation over $15,000.00 up to and including $100,000.00 the fee shall be $45.00 for the first fifteen thousand plus $2.00 for each additional thousand or fraction thereof - SECTION 8. Designation. This Ordinance shall be known and designated as the "Swimming Pool Code." SECTION 9. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed. SECTION 10. That this Ordinance shall take effect immediately upon its adoption by the City Council and approval by the Mayor at a second reading. -4- SECTION 11. The City Clerk is hereby directed to advertise this Ordinance as required by law. The first reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said council held on the 7sY day of duly A.D. 1974 and approved as provided y law.
