879ORDINANCE NO. 879 AN ORDINANCE BY THE CITY OF EDGEWATER TO IMPLEMENT CHAPTER 22 OF FLORIDA STATUTES TO PROVIDE, IN THE EVENT OF AN EMERGENCY, MAJOR DISASTER, AND OR AN ENEMY ATTACK UPON THE CITY OF EDGEWATER, COUNTY OF VOLUSIA, STATE OF FLORIDA, AND OR THE UNITED STATES,FOR CONTINUITY OF THE OFFICIAL FUNCTIONS OF THE GOVERNMENT OF THE CITY OF EDGEWATER, AND -FOR INTERIM SUCCESSION TO THE OFFICES OF THE. CITY WHEN SUCH ELECTED OR APPOINTED OFFICIALS ARE UNAVAILABLE, AND PROVIDING AN EFFECTIVE. DATE THEREFOR. BE IT ENACTED BY THE CITY COUNCIL OF THE. CITY OF EDGEWATER, FLORTDA: WHEREAS, as a result of such an emergency, disaster, and or attack, the duly elected or appointed officials of the city may be unavail- able to discharge the authority, responsibility, and leadership of the office to which elected or appointed, and WHEREAS, due to the almost certain disruption of communications and other services of government it may be impracticable because of the urgency of the situation to initiate and pursue the existing legal procedures for the election or appointment of successors to those officials unavailable 6y reason of Emergency, Disaster, and or Enemy attack, and WHEREAS, it is considered imperative to provide for the effective operation of civil government under emergency conditions to supply the necessary social services to survivors of the attack, to sus- tain morale, restore economic functions, resume essential produc- tion and facilitate the earliest possible resumption of functions temporarily suspended through necessity, and WHEREAS, Chapter 22, Florida Statutes, encables political entities, local departments and agencies of such political entities gfithe State of Florida to provide through appropriate public office to assure the continuation of essential functions of the government of the City of Edgewater, Governing body. The Mayor, and the four (4) Councilmen, (hereafter known as the city government), under conditions ofeemergency, disaster, and or enemy attack. NOW, THEREFORE, BE IT PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: - SECTION 1. That each duly elected or appointed official of City Government shall designate, by title, if feasible, of by named person, not less than one (1) nor more than three (3) emergency interim successors to his office and specify their order of suc- cession. SECTION 2. That it shall be incumbent upon each elected of ap- pointed official of the City of Edgewater, and City Government to review and revise as necessary, the designations of emergency interim successors made pursuant to this resolution. SECTION 3. That the City Clerk, or other designated official, shall maintain in current status the list of designees for emergency interim succession of the elective and appointive offices of Mayor, four (4) Councilmen and all appointies, and the order of their succession. SECTION 4. That the emergency interim successor shall exercise the powers and discharge the duties of the office to which designated until such time as the vacancy created by the unavailability of the regularly elected official shall be filled in accordance with the Constitution or applicable Statutes or until the elected official ( or a preceding designated emergency interim successor) again becomes available to exercise the powers and discharge the duties of his office. SECTION S. That designated emergency interim successors are empowered to exercise the powers and discharge the duties of the office to which designated ONLY AFTER A DISASTER, AND OR AN ATTACK ON THE UNITED STATES HAS OCCURED and then ONLY by reason of the unavailability of the regular incumbent or the immediately preceding designated successor. Designated emergency interim successors are retained on the official roster of successors and in the established order of their succession at the pleasure of the designating authority, who may amend or revise such roster with or without cause. SECTION 6. That designated emergency interim successors shall upon designation, (if required) take the oath of office prescribed for the duly elected official with further stipula- tion that the designee shall be empowered to exercise the powers and duties of such office only in the event of the unavailability of the duly elected or appointed incumbent, or the immediately preceding successor, following an emergency, disaster, and or enemy attack. No other oath of office shall be required for succession tothe _office under the conditions stated herein. SECTION 7. That terms used in this resolution shall have the same meaning as in Section 22.03, Florida Statutes. SECTION 8. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby rescinded. SECTION 9. That this Ordinance shall take effect immediately upon its passage and approval by the Mayor. The first reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida at a regular meeting of said Council held on the 3rd day of June .1974 and approved as provided by law.
