78-R-1440 RESOLUTION NO. 7 $- 1?-- DR 1'4 y ° A RESOLUTION OF INTENT OF THE CITY OF EDGEWATER, FLORIDA TO ENTER INTO A INTER - LOCAL AGREEMENT FOR SOLID WASTE DISPOSAL AND RESOURCE RECOVERY WITH THE COUNTY OF VOLUSIA; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 403, Florida Statutes, the Volusia County Council shall administer and be responsible for the disposal of all solid waste and resource recovery for the entire County unless aninter-local agreement is effectuated on or before December 1, 1978, and WHEREAS, It is hereby determined that it will be of mutual benefit to the City of Edgewater, Florida and the County of Volusia to cooperate with regard to solid waste management, and WHEREAS, it is the intent of the City of Edgewater, Florida to enter into winter -local agreement between the City of Edgewater and the County of Volusia. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That for and in consideration of the mutual benefits and in consideration of the mutual covenants, promises and representations herein, the parties will tentatively agree as follows: 1. Obligations and Responsibilities (a) The County shall pursuant to Section 403.706, Florida Statutes, administer and be responsible for the disposal of all solid waste and the local recovery program within the City of Edgewater as delegated by the Department of Environmental Regulation. (b) The City of Edgewater shall reserve the right to use any solid waste the City desires to utilize in resource recovery programs which the City may institute. (c) The City may, upon approval by the Department of En- vironmental Regulation, prepare and administer a solid waste disposal and recovery program at some future date and accept any or all responsibilities under Chapter 403, Florida Statutes, after reasonable written notice to the County. SECTION 2: That all Resolutions or parts of Resolutions in con- flict herewith be and the same are hereby rescinded. SECTION 3: That this Resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law. The first reading of the Resolution was read in full and passed by a vote of the City Council of the City of Edgewater, Florida at a regular meeting of said Council held on the 2L� day of November, 1978 and approved as nrovided bylaw.
