A RESOLUTION GRANTING A SPECIAL EXCEPTION
TO HAROLD BROWN FOR THE PURPOSE OF SETTING
UP A USED CAR LOT ON LOT 2, UNSER SUBDIVISION,
AS PER MAP BOOK 19, PAGE 295, PUBLIC RECORDS
OF VOLUSIA COUNTY, FLORIDA; PROVIDING FOR
CERTAIN CONDITIONS FOR THE GRANTING OF THE
SPECIAL EXCEPTION, REPEALING ALL RESOLUTIONS
IN CONFLICT HEREWITH AND PROVIDING AN EFFECT-
IVE DATE.
WHEREAS, the Edgewater Board of Adjustments voted to grant
a Special Exception to Harold Brown for the purpose of estab-
lishing a used car lot on certain real property that he owns
in the City of Edgewater, Florida, and
WHEREAS, the City Council of the City of Edgewater, Florida,
accepted the recommendation of the Edgewater Board of Adjustments
in granting said Special Exception.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA:
SECTION 1. That Harold Brown is hereby granted a Special
Exception for the purpose of establishing a used car lot on
Lot 2, Unser Subdivision, as per Map Book 19, Page 295 of the
Public Records of Volusia County, Florida.
SECTION 2. That said Special Exception is granted with the
following conditions imposed:
a. Side yard setbacks will be 20 feet from property
boundary lines for any proposed building to be erected on the
property.
b. A new access driveway shall be built from U.S. 1
onto the subject property.
c. The east side of the property shall be screened
either by an opaque fence or plant materials, as required, and
shall also have a 10 foot grass strip buffer.
d. The operating hours of the business will be from
9:00 a.m. to 9:00 p.m. six days a week.
e. All outside lights except those lights necessary
for police protection will be turned out by 9:00 p.m. each
evening.
f. Adequate drainage shall be provided so that the
drainage of said property will not cause any drainage problems
for any adjacent property owner.
g. There will be no outside display of parts, junk
cars, tires, etc. All storage of these items will be enclosed
and kept out of sight.
h. The business to be conducted on the premises shall
be in operation within one year of the granting of the Special
Exception.
SECTION 3. That a failure to comply with any of the above -
stated conditions shall result in a revocation of the Special
Exception and immediate revocation of the grantees license to
conduct business.
SECTION 9. That all resolutions or parts of resolutions
and all ordinances or parts of ordinances in conflict herewith
be and the same are hereby repealed.
SECTION 5. That this Resolution shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.
The first reading of the Resolution was read in full and
passed by a vote of the City Council of the City of Edgewater,
Florida, at a regular meeting of said Council held on the 1r—
day of /?A� , 1979, and approved as provided bylaw.
