JONES AND HELEN W. JONES; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. im WHEREAS, it has come to the attention of the City Council of the City of Edgewater, Florida, that there is a certain quit -claim deed on the Public Records of Volusia County, Florida, purportedly con- veying property belonging to the City of Edgewater, Florida, which was previously dedicated to the City of Edgewater, Florida, as a Permanent Park on November 18, 1925, said deed being dated Novem- ber 14, 1951, and filed in the Public Records of Volusia County, Florida, on November 26, 1951, and WHEREAS, this deed was never authorized by the City Council of the City of Edgewater, Florida, and was executed by one Edwin P. Fuller, which said person was not the duly elected Mayor of the City of Edgewater, Florida, at the time of the execution of the deed, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. The City Council of the City of Edgewater, Florida, hereby denies the validity of that certain quit -claim deed, dated November 14, 1951, and filed November 26, 1951, in Deed Book 452, page 381, of the Public Records of Volusia County, Florida, which deed attempts to convey the following described property belonging to the City of Edgewater, Florida: All property lying Easterly of that certain road or street known as Riverside Drive or Strand Boulevard��} as now laid out and lying between the Southerly lot line of Lot 29 ex- ff// 4I [ended Easterly to the Halifax River, and the Northerly lot line of V 2083 1110 BOOK PAGE Lot 25 emended Easterly to the Halifax River, in Block "F", Highland Shores, Section 2, as per map in Map Book 9, page 64, of the Public Records of Volusia County, Florida, together with any and all riparian rights thereunto appertaining. SECTION 2. That it is the intent of this Resolution to protect the interests of the citizens of the City of Edgewater, Florida, in maintain- ing their right, title and interest in the Permanent Park dedicated to the City of Edgewater, Florida, by that dedication as set forth in the original dedication of Highland Shores Subdivision in the City of Edgewater, Florida. SECTION 3. That this Resolution shall be recorded in the Public Records of Volusia County, Florida, upon adoption by the City Council of this Resolution. SECTION 4. That all Resolutions and parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 5. That this Resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law. The first reading of the Resolution was read in full and passed by a vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the &�-aa­y of June, 1979, and approved as provided by law.
