79-R-86RESOLUTION A RESOLUTION APPOINTING THE MAYOR AND CHIEF OF POLICE, OR THEIR SUCCESSORS IN OF FI Et Off' THEI CITY OF EDGEWATER, FLORIDA, AND �Q �'!, ., � w+wM AND Oc v f.Jat Kites , AS MEMBERS OF THE BOARD OF TRUSTEES OF THE MUNICIPAL POLICE OFFICERS RETIREMENT TRUST FUND; PROVIDING FOR THEIR DUTIES, RIGHTS AND RESPONSIBILITIES; RE- PEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Florida Statute 185.05 it is necessary for the City of Edgewater, Florida, to appoint a Board of Trustees for the Municipal Police Officers Retirement Trust Fund, and WHEREAS, the Mayor and the Chief of Police of the City of Edgewater, Florida, or their successors in office, are required to be permanent members of said Board pursuant to Florida Statute 185.05, and WHEREAS, it is necessary to appoint two regularly employed policemen of the City of Edgewater,. Florida, and a citizen of the City of Edgewater, Florida, and WHEREAS, the City Council desires to appoint W. A. N41'4kv�IvA@,,, LAf 0. L�_ti and I? CLr.i WO,Eki�S as the other required members of said Board, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the Mayor and Chief of Police of the City of Edgewater, Florida, or their successors in office, are hereby appointed as permanent members of the Board of Trustees of the Municipal Police Officers Retirement Trust Fund.. ' SECTION 2. That W 4. ���[.k�.�.,w.... , W. 0. L%� and RP CL�J are hereby appointed to said Board of Trustees, subject to replacement by the City Council of the City of Edgewater, Florida. SECTION 3. That the Board of Trustees shall have all the rights, powers and duties as set forth in Chapter 185 of the Florida Statutes pertaining to the Municipal Police,Officers Retirement Trust Fund. SECTION 4. That all resolutions or parts of resolutions and all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. That this Resolution shall take .effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. City Attorney Counci ma P December 14. 1979 (9itg of 09ewater POST OFFICE BOX 100 EDGEWATER, FLORIDA 02032 TO: Mayor and City Council FROM: City Clerk Resolution No. 79-R-86 set up the Board of Trustees of the Municipal Police Officers Retirement Trust Fund pursuant to Florida Statute 185.05 and Resolution No. 79-R-109 set up the Board of Trustees for the General Employees Retirement Trust Fund. Section 2 of Res. 79-R-86 states that two policeman and a civilian are hereby appointed to the Board subject to replacement by the City Council. Section 2 of Res. 79-R-109 states that three City employees are appointed to the Board subject to replacement by the City Council. Florida Statute 185.05 states that employees appointed to the Board of Trustees are chosen by the City Council upon recommendation of a majority of the regularly employed policeman. The general employees Board of Trustees was established under the same regulations. It is requested that the Council consider correcting these two resolutions to comply with State Statutes. Members can be replaced but their successors should be chosen upon recommendation of the majority of the employees.
