87-R-17RESOLUTION NO. 87-R-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING THE CITY OF EDGEWATER VOLUNTARY ANNEXATION PROCEDURES IN COMPLIANCE WITH THE LATEST AMENDMENTS TO FLORIDA STATUTES 163, PART II; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the legislature of the State of Florida in 1985 and 1986 sessions made considerable amendments to Chapter 163, necessitating the updating of the City's annexation procedures. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That the City's voluntary annexation procedure as adopted by Resolution 86-R-26 is hereby amended, said amended procedure is attached hereto as Exhibit A and by reference incorporated herein with full force and effect as if fully set forth. SECTION 2: That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3: That this Resolution shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 16thday of March ,198 7 , and approved as provided by law. This Resolution was read and passed by a majority vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 16th day of March 1198 7 , and authenticated as provided by law. No. 87-R-17 O O EXHIBIT A VOLUNTARY ANNEXATION PROCEDURES AS PER RESOLUTIONS NO. 86-R-26 and NO. 87-R-17 STEP ONE: A verified Petition for Voluntary Annexation is submitted by the Owner(s) of the property. (For contents see form attached hereto.) STEP TWO: The petition will be received by or referred to the Secretary of the Planning and Zoning Board of the City of Edgewater. The Secretary will deter- mine that the Petition is in order, bears the signature of all of the owners of the property and is accompanied by the required documents and required fees. STEP THREE: The Secretary will refer the Petition and all pertinent documents to the Planning Department for their review and comments. STEP FOUR: The Planning and Zoning Board, at a regular scheduled meeting, will hold a public hearing and review the Petition as to the following: a. Compatibility with and required amend- ments to the Comprehensive Land Use Plan b. Impact on the Zoning Ordinance c. Zoning classification to be ascribed to the property d. Comparative density as between the Volusia County Zoning wherein the property lies and the zoning classification to be given by the City e. That the area is contiguous to the City, reasonably compact and that it will not result in the creation of a municipal enclave of city territory within the unincorporated territory of Volusia County f. Any other aspect the Board feels is relevant to the annexation, i.e., impact on services provided by the City as a result of the type of development proposed by the owners. STEP FIVE: The Planning and Zoning Board will submit written. recommendations. and reasons therefor to the City Council. STEP SIX: The City Council will consider the Petition, all pertinent documents, and the recommendations of the Board and may instruct the City Attorney to prepare the necessary legislation. STEP SEVEN: The Annexation Ordinance is to be read for the first time at a regular meeting. The Ordinance will annex the property and redefine the boundary lines of the municipality to include said property. STEP EIGHT: If the property is to be rezoned from County zoning, steps shall be undertaken at this time for any necessary amendments to the City of Edgewater Comprehensive Land Use Plan in accordance with Chapter 163, Part II, Florida Statutes, as amended. Amendments to the City's Comprehensive Land Use Plan and any corresponding rezonings shall be initiated only in the months of March and September of each year. Exhibit A Page two. STEP NINE: The City Clerk advertises the annexation ordinance once a week for four (4) consecutive weeks in a newspaper of general circulation in the City, setting a date for a public hearing and adoption. STEP TEN: The City Council adopts the annexation ordinance. STEP ELEVEN: The City Clerk files the ordinance with: 1) Clerk of the Circuit Court in and for Volusia County; 2) The Department of State in Tallahassee; 3) Charter Revision Department of State within thirty (30) days.
