A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, AUTHORIZING THE APPROPRIATE
OFFICIALS OF THE CITY OF EDGEWATER TO CONTINUE AN
AGREEMENT FOR PROFESSIONAL SERVICES WITH DYER, RIDDLE,
MILLS & PRECOURT, INC.; REPEALING ALL RESOLUTIONS IN
CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA:
SECTION 1. That the City Council of the City of
Edgewater, Florida, authorizes the appropriate officials of the
City of Edgewater, Florida to execute the amended Agreement with
Dyer, Riddle, Mills & Precourt, Inc.
SECTION 2. That a copy of said amended Agreement is
attached to this Resolution and by reference incorporated as if
fully set forth.
SECTION 3. That all Resolutions or parts of Resolutions
in conflict herewith be and the same are hereby repealed.
SECTION 4. That this Resolution shall take effect
immediately upon its adoption by the City Council of the City of
Edgewater, Florida, at a

COMMUNICATIONS
of Agreement between County and
Fire Chief Lamb stated they're trying to renegotiate with the County on the
contract because they feel the people running the Interstate are not getting
adequate service. He noted that Jim dillitts is coming to the Fire House
this Thursday to discuss it, and whether the $32,000 is enough is immaterial.
He added that people traveling the Interstate shouldn't have to wait the
additional amount of time for another station to get there, and this station
can cover them going south bound. Councilman Rotondo asked who covers it
now and Chief Lamb replied it's Oak Hill for anything south of 442. Councilman
Mitchum asked where we cover and Chief Lamb replied we atop at 95 and don't go
under the bridge. Councilman Mitchum asked if they want to extend the boundaries
and Chief Lamb replied yes. Vice Mayor Asting asked 1f he'd discussed this with
the County and if they're in agreement. Chief Lamb replied they'll be there
Thursday to talk to the Department, but he wanted Council to know where it is.
Councilman Rotundo moved to TABLE this for more information from the Fire
Chief. Councilman Prater seconded the motion. Motion CARRIED 4-0.
ORDINANCES AND RESOLUTIONS
R s 87-R-31 Intent to vacate alley between Hibiscus and India Palm - City
Attorney Alvarez read this Resolution. RE5. 87-R-31 - A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, DECLARING ITS INTENT TO VACATE
THE ALLEY BETWEEN HIBISCUS AND INDIA PALM, IN THE CITY OF EDGEWATER, REPEALING
ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING FOR
AN EFFECTIVE DATE. He stated that Council approved this previously and it's in
compliance with Section 112 of the Charter. Councilman Prater moved to adopt
Resolution 87-R-31. Councilman Mitchum seconded the motion. Motion CARRIED 4-0.
ORD. 87-0-14 Vacating alley between Hibiscus and India Palm - City Attorney
Alvarez read this Ordinance. ORD. 87-0-14 - AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF EDGEWATER, FLORIDA, VACATING THE ALLEY BETWEEN HIBISCUS AND INDIA
PALM, IN THE CITY OF EDGEWATER; CONTAINING A REPEALER PROVISION, A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. He read the legal description, and
stated this is first reading. Councilman Mitcbum moved to accept Ordinance
87-0-14. Councilman Rotondo seconded the motion. Motion CARRIED 4-0. City
Attorney Alvarez advised Attorney Jim Morris, who was in the audience, that be
can request copies from City Hall if he wants to review these.

Engineers (Tabled June 1, 1987) - City Attorney Alvarez requescee uouucra w
proceed to exercise the 30 day notification procedure with the agreement of
Dyer, Riddle, Mills and Precourt, with the exception of pending items, per the
contract, the 201 Study and the second one. Mr. Ron Ferland, of Dyer, Riddle,
Mills 6 Precourt, Inc., said it's the 201 Plan and grant application for waste-
water treatment plant and continue with the Technical Advisory Committee work
that's ongoing with the C.I.P. City Attorney Alvarez stated that pursuant to
the Agreement, those items would be continued. The Attorney for Dyer, Riddle,
Mills 6 Precourt, Inc., Nick Pope of the law firm of Lowndes, Drosdick, Duster,
Kantor 6 Reed in Orlando, came forward. City Attorney Alvarez asked 1f he needs
to add something and Attorney Pope replied no. City Attorney Alvarez asked if they
wish to waive the 30 day notification and Attorney Pope replied yes, and he under-
stands they will terminate the existing contract and re -advertise. City Attorney
Alvarez pointed out that the termination provision has a 30 day clause and they
can dispense with that. Attorney Pope stated he has no problem with that.

Code Enforcement Board - City Attorney Alvarez read this Kesolution. RES.87-R-29-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, REAPPOINTING
DELORES CUCANICH AND PAUL BIGGERSTAFF TO THE CITIZEN CODE ENFORCEMENT BOARD OF
THE CITY OF EDGEWATER; PROVIDING FOR TERMS OF OFFICE; PROVIDING FOR POWERS, DUTIES
AND RESPONSIBILITIES; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING
AN EFFECTIVE DATE. He read the terms are to expire May 8, 1990. Councilman
Rotundo moved to adopt Resolution 87-R-29. Councilman Mitchum seconded the
motion. Motion CARRIED 4-0.
Jtee. 87-R-30 Amending Agreement with Consulting Engineers - City Attorney Alvarez
suggested this be tabled so he can prepare some more documents with the other
attorney. Mayor Baugh suggested a motion to TABLE this until further notice.
Councilman Mitchum so moved. Councilman Prater seconded the motion. Motion CARRIED 4-0.
UNFINISHED BUSINESS
Vacating alley between Hibiscus and India Palm - Attorney Jim Morris represented
Huntley -Jiffy. He reviewed the previously agreed upon items. He stated they
researched the radius and it's as good as what's currently there. He noted that
landscaping will be provided along the front and concrete barrier poles will be
installed at the end of the landscaping. He said they'll grade the western lot
and place shell there to prevent water ponding. He expressed concern with the
term of paving to present City standards. He said it will be stabilized and it
will be a 4" slab such as is on the eastern end of the property. Councilman
Rotundo pointed out a 4" slab won't carry a truck if it's not stabilized and it
will crack and be of no use to the City or anyone else. Attorney Morris stated
the driveway at the east end is only that. There was a discussion about the pro-
cedures.used for driveways and for City streets. Councilman Rotundo suggested
this be graded and shelled and then a 5" slab. Attorney Morris said he doesn't
have a problem with that and the foundation and ground underneath will be graded
out, wire will be put down, and formed. Councilman Rotundo asked Mr. Austin if
that will be sufficient and Mr. Austin replied 5" will be more than sufficient
and wire won't hurt it. Councilman Mitchum explained his motion was "to present
City standards for parking lots and roads" ,and if traffic will be on it, it will
break up when something runs over it. Attorney Morris said the lime base put under
an asphalt roadway requires a lot of different materials but concrete is simpler
and will have wire to support it. Councilman Mitcbum asked what support we use for
roads and Mr. Austin replied it's a compacted base material such as shell.
Councilman Mitchum asked if will be compacted shell with a 5" base and Attorney
Morris replied yes. Councilman Prater pointed out the east end is concrete and
it wil be compatible. Councilman Mitchum moved to accept. Councilman Prater
seconded the motion. Attorney Morris called a point of order regarding the reso-
lution. City Attorney Alvarez replied that based on information supplied to his
office that day, the resolution and ordinance will be prepared and they'll be
together for first reading of the ordinance and one time reading of the resolution.
He noted the public hearing will be at the second reading. Councilman Rotundo
stipulated that when they install it, the City's Superintendent should be there to
supervise and see that it's done correctly. Attorney Morris stated they need a
building permit. Motion CARRIED 4-0.
