86-R-39RESOLUTION NO. 86-R-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING RESOLUTION 85-R-1 BY DELETING THE REQUIREMENT THAT VIOLATIONS OF FLORIDA CONTRABAND FORFEITURE ACT, F.S. 932.701, ET SEQ, OCCURRING WITHIN THE CORPORATE LIMITS OF THE CITY OF EDGEWATER BE APPLICABLE TO DRUG RELATED FELONIES ONLY; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Police Chief of the City of Edgewater, Florida, has recommended an amendment to Resolution 85-R-1 to the City Council of the City of Edgewater, Florida, and WHEREAS, the City Council at their regular meeting of August 18, 1986, accepted his recommendation and instructed the City Attorney to prepare a Resolution on the subject. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That Section 1. of Resolution 85-R-1 be amended to read as follows: The City of Edgewater, Florida, does hereby elect to proceed under the procedures of the Florida Contraband Forfeiture Act and hereby authorizes the Police Department and City Attorney to undertake forfeiture procedures when, in their discretion, a violation of F.S. 932.701 et seg occurs within the corporate limits of the City of Edgewater. SECTION 2: That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3: That this resolution shall take effect immedi- ately upon its adoption by the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 27th day of August , 198 6, and approved as provided by law.
