86-R-49RESOLUTION 86-R-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, APPROVING AND CONFIRMING A FRONT FOOT ASSESSMENT ROLL PURSUANT TO A PUBLIC HEARING HELD ON OCTOBER 6, 1986, WHEREIN THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, MET AS AN EQUALIZING BOARD OF THE CITY OF EDGEWATER, FLORIDA, TO HEAR AND CONSIDER ANY AND ALL COMPLAINTS AS TO THE SPECIAL ASSESSMENTS AND TO GIVE AN OPPORTUNITY TO THE OWNERS OF THE PROPERTY TO BE ASSESSED, OR ANY OTHER PERSON INTERESTED THEREIN, TO APPEAR BEFORE COUNCIL AND BE HEARD AS TO THE PRO- PRIETY AND ADVISABILITY OF MAKING SUCH IMPROVEMENTS AS TO THE COSTS THEREOF; THE MANNER OF PAYMENT THEREFOR; AND AS TO THE AMOUNT THEREOF TO BE ASSESSED AGAINST EACH PROPERTY SO IMPROVED; REPEALING ALL RESO- LUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has determined to make public improvements within the City of Edgewater by paving certain previously designated roads; and WHEREAS, the City Council of the City of Edgewater has by Resolution No. 86-R-32 stated the nature of the proposed improvements and determined that the properties benefited by this program shall be assessed for the improvements in proportion to the benefits to be derived therefrom, said special benefits to be determined and prorated according to the foot frontage of the respective properties specially benefited by said improvement; and WHEREAS, an assessment roll has been completed and filed with the City Council showing the lots and lands to be assessed, the amount of the benefit to and the assessment against each lot or parcel of land, and showing that the assessment may be paid in installments and showing the number of installments in which the assessment is divided; and WHEREAS, a public hearing was held on the 6th day of October, 1986, so that owners of the properties to be assessed, or any other interested person, could appear before the City Council and be heard as to the propriety and advisa- bility of making such improvements, as to the costs thereof, as to the manner of payment therefor, and as to the amount thereof to be assessed against each property so improved; and WHEREAS, at said public hearing, the City Council also sat as an equalizing board to hear and consider any and all complaints as to the special assessments and to adjust and equalize the assessment based on justice and right. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That the method of applying the assessments on the front footage basis is hereby approved and confirmed and shall remain legal, valid and binding first liens upon the property against which the assessments are to be made, until paid, as per Florida Statutes, Section 170.08. SECTION 2: That the assessment roll as completed and published is hereby confirmed and ratified. SECTION 3: That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4: That this resolution shall take effect immediately upon its adoption by the City Council. SECTION 5: The assessments shall be recorded by the City Clerk in a special book, to be known as the "Improvement Lien Book". -2- Res. No. 86-R-49 SECTION 6: The record of the lien in the "Improvement Lien Book" shall constitute prima facie evidence of its validity. The Resolution was read and passed by a vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 20th day of October 1198 6 , and approved as provided by law.
