A RESOLUTION OF THE CITY COUNCIL OF THE CITY AA'"
OF EDGEWATER, FLORIDA, ESTABLISHING VOLUNTARY -f
ANNEXATION PROCEDURES AND A THREE HUNDRED ($300.00)
DOLLAR NON-REFUNDABLE COST DEFRAYING ANNEXATION
FEE; REPEALING ALL RESOLUTIONS IN CONFLICT HERE-
WITH AND PROVIDING AN EFFECTIVE DATE. ?-�f/�f,
WHEREAS, the City Council of the City of Edgewater,
Florida, at a regular meeting on April 21, 1986, directed that
a Resolution be prepared on the subject based on the recommendation
received from the planning staff on April 7, 1986.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That a non-refundable annexation application
fee is hereby established in order to defray advertising costs,

drafting,legal review, and other appurtenant expenditures n�,n
incurred by the City as a result of an annexation request. K Tom'
SECTION 2. Said fee shall be in theramo nt of Three
Hundred ($300.00) Dollars to be submitted at Step 1 of the
Voluntary Annexation Procedure.
SECTION 3. A voluntary annexation procedure is
hereby adopted by the City Council, attached hereto as Appendix
A and incorporated herein with full force and effect as if
herein set forth.
SECTION 4. That all resolutions or parts of resolutions
in conflict herewith be and the same are repealed.
SECTION 5. That this resolution shall take effect
immediately upon its adoption by the City Council of the City
of Edgewater, Florida, at a regular meeting of said
Council held on the 5th day of May 1986, and
approved as provided by law.
This Resolution was introduced and sponsored by

VOLUNTARY ANNEXATION PROCEDURE
AS PER RESOLUTION NO. 86-R-26
STEP ONE:
A verified Petition for Voluntary Annexation is
submitted by the Owner(s) of the property. (For
contents see form attached hereto.)
STEP TWO:
The petition will be received by or referred to the
Secretary of the Planning Board of the City of
Edgewater. The Secretary will determine that
the Petition is in order, bears the signature of
all the owners of the property and is accompanied
by the required documents and required fees.
STEP THREE:
The Secretary will refer the Petition and all
pertinent documents to the Planning Department
for their review and comments.
STEP FOUR:
The Planning Board, at a regular scheduled meeting,
will hold a public hearing and review the
Petition as to the following:
a. Compatability with the Comprehensive Land
Use Plan.
b. Impact on the Zoning Ordinance.
C. Zoning classification to be ascribed to
the property.
d. Comparative density as between the Volusia
County Zoning wherein the property lies and
the zoning classification to be given by the
City;
e. That the area is contiguous to the City, reasonably
compact and that it will not result in the
creation of a municipal enclave of city
territory within the unincorporated territory
of Volusia County.
f. Any other aspect the Board feels is relevant to
the annexation, i.e., impact on services pro-
vided by the City as a result of the type of
development proposed by the owners.
STEP FIVE:
The Planning Board will submit written recommendations
and reasons therefor to the City Council.
STEP SIX:
The City Council will consider the Petition, all per-
tinent documents and the recommendations of the Board
and may instruct the City Attorney to prepare the
necessary legislation.
STEP SEVEN:
The Annexation Ordinance to be read for the first time
at a regular meeting. The ordinance will annex the
property and redefine the boundary lines of the
municipality to include said property.
STEP EIGHT:
If the property is to be rezoned, steps shall be
undertaken at this time for any necessary amend-
ments to the Comprehensive Land Use Plan of the
City of Edgewater and the future rezoning of the
property in accordance with Part II, Chapter 163,
Florida Statutes as amended.
APPENDIX A CONTINUED
STEP NINE: The City Clerk advertises the annexation ordinance
once a week for four consecutive weeks in a news-
paper of general circulation in the City, setting
a date for a public hearing and adoption.
STEP TEN: The City Council adopts the annexation ordinance.
STEP ELEVEN: The City Clerk files the ordinance with:
a. Clerk of the Circuit Court in and for
Volusia County;
b. The Department of State in Tallahassee;
c. Charter Revision Department of State
within 30 days.
