NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That the City Council of the City of Edgewater, Florida authorizes the appropriate officials of the City of Edgewater, Florida, to execute Amendment I to the Agreement for Consulting Engineering Services with Conklin, Porter and Holmes Engineers, Inc. SECTION 2: A copy of said Amendment I is attached to this Resolution and by reference incorporated herein as if fully set forth. SECTION 3: That all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed. AMENDMENT 1 TD AGREEMENT DATED MAY 21, 1984 FOR CONSULTING ENGINEERING SERVICES FOR PRELIMINARY ENGINEERING STUDY - WATER SUPPLY AND TREATMENT Between THE CITY OF EDGEWATER, FLORIDA And CONKLIN, PORTER AND HOLMES-ENGINEERS, INC. This Amendment dated this 28th day of June, 1984, in the year Nineteen Hundred and Eighty -Four by and between THE CITY OF EDGEWATER, FLORIDA (hereinafter called the OWNER) and CONKLIN, PORTER AND HOLMES-ENGINEERS, INC. (hereinafter called the ENGINEER), is mutually agreed upon and declared an authorized Amendment to an Agreement dated May 21, 1984, between the parties, herein setting forth the scope, terms and conditions of the work herein authorized. The appropriate provisions of the May 21, 1984 Agreement apply as fully as if written fully herein. GENERAL The purpose of this Amendment is to authorize proceeding with certain work generally specified in the May 21, 1984 Agreement and more specifically described herein, and to provide a Basis of Payment for said work. SERVICES HEREIN AUTHORIZED This Amendment will provide for immediate authorization to proceed with certain services under Section III, Additional Services, of the May 21, 1984 Agreement as follows: This Amendment is written to establish a scope of work and a plan of action for achieving the City's desired goal of an improved source of water supply and treated water in an efficient and timely manner. The scope of work defined herein will serve to establish the criteria and direction in which the City should proceed to achieve the above goal. This includes plant siting, sizing, water quality, construction methods, equipment and eventual operation of the facilities. Overall master planning of the City's water system and distribution system will be addressed at a later date and is not included herein. Long range planning as relates to the water supply and treatment under this proposal will be limited to population projections, planning period, and approximate areal extent of growth as would relate to the siting of the water treatment plant. Short term planning will be for the needs of the City for no less than a ten (10) year period. SCOPE OF PRELIMINARY STUDY WORK 1. We will meet with the City Utilities Director and obtain from him copies of plans, studies, reports, maps, correspondence, etc., as may be pertinent to the siting of the City's well field and water treatment plant. 2. Advise the City of the need for data or services to be provided by others in order to perform this study. 3. We will contact Volusia County, the U.S. Geological Survey, and the St. John's River Water Management District, to obtain any information and recommendations they have relative to well field siting, spacing, depth, yield, etc. 4. We will review population projections from various sources and summarize our findings in a letter report to the City of Edgewater. The ramifications of the population growth on the sizing of the plant will be discussed with the City. The sizing should include the ultimate development of the plant as well as the population to be served by the first phase of the plant. The City Council will be requested to give direction regarding the plant sizing and planning period. We will consider alternatives for treatment: a. Expansion of the existing plant. b. Abandonment of existing plant and replacement with a totally new plant. C. New plant which would supplement the supply of the existing plant. d. A water plant phasing system of building a new plant and directing the current well supply to the new plant and the existing plant. Then adding new wells and expanding the newer plant and converting the existing plant into a high service pumping station with clearwell storage. e. one other reasonable alternative or variation of the above that becomes evident during the course of the study. 5. Based on the existing and projected raw water quality and the desired finished water quality, perform a study of treatment processes. The existing and other alternative processes would be studied for reliability and effectiveness, operation and maintenance, and cost considerations. Also investigated will be the process by-products and disposal methods. 6. Consideration will be given to continuity of supply and treatment during construction and be given to the expandability for future needs of the recommended solution. 7. We will review the data gathered in items 1, 2, 3 and 4 above, and summarize in a status letter report to the City Council. 8. We will prepare rough sketch plans indicating sizes and components of the above alternatives. 9. Prepare rough preliminary opinions of cost to construct each of the alternatives identified. 10. Prepare a preliminary plan indicating a minimum of two rough financing plans to accomplish the proposed improvements and a rough estimate of the effect on water rates during the first five years. 11. Prepare a preliminary engineering report with necessary drawings discussing the items indicated above, plus the advantages and disadvantages of the alternative solutions and make a recommendation. 12. Report to the City Council the preliminary findings for further direction and furnish 15 copies of the final preliminary report. ASSISTANCE WITH SITE SELECTION We will assist City staff in evaluating proposed water treatment and well sites from the standpoint of accessibility, adequacy of size, drainage, soil conditions, hydroge0logical and water quality characteristics, location with respect to service area, power supply, proximity to the City, and will report our findings to the City Council for their final selection of sites. PAYMENTS TO THE ENGINEER For the scope of work described above, payment to the Engineers by the Owner shall be on the basis of payroll cost times a factor of 2.25, plus Reimbursable Expenses and Outside Consultants, up to a maximum of $22,300. This is in accordance with Section III entitled ADDITIONAL SERVICES and Section IV BILLING of the original Agreement dated May 21, 1984. Attachment A contains an estimate of the hours required for each task by each job classification. For purposes of this Agreement, "Payroll Costs" as used herein are those costs which are connected with the conditions of employment and pay of the employees and include such items as social security, workman s compensation, unemployment taxes, insurance, and similar items. Reimbursable expenses such as travel, long distance phone calls, prints, and copies will be paid for at the cost thereof without increase except where the Engineer directly employs an outside consultant. Services for outside consultants will be charged with a ten percent (10%) markup to cover administration and handling of the work. Subconsultants would be utilized for surveying, soils and geology, and electrical if required. Subconsultants, as needed, would be recommended to the City for approval and written notice to retain their services. As an alternate, the City could rretain the services of the subconsultants directly and provide the necessary information directly to the Engineer. The Engineer would not be liable for the information received from others in accordance with the May 21, 1984 Agreement. E. TIME OF COMPLETION The time of completion of this contract amendment will be 120 days after approval by the City of Edgewater and the Engineer.
