A RESOLUTION OF INTENT TO VACATE THAT CERTAIN FIFTY FOOT RIGHT-OF-WAY LOCATED AT THE END OF EVERGREEN DRIVE, EDGEWATER, FLORIDA, BETWEEN BLOCK 10, LOTS 254 AND 255, AND BLOCK 13, LOTS 315 AND 318, FLORIDA SHORES, UNIT NO. 1, MAP BOOK 19, PAGE 209 AND MAP BOOK 23, PAGE 57, OF THE PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA; PROVIDING FOR NOTIFICATION OF THE PROPOSED VACATION TO ALL AFFECTED PROPERTY OWNERS; PROVIDING FOR A TIME AND PLACE AT WHICH OBJECTIONS TO SAID VACATION CAN BE HEARD BEFORE THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, representatives of Magnuson Corporation have requested that the Edgewater City Council vacate that certain fifty foot right- of-way located at the end of Evergreen Drive, Edgewater, Florida, be- tween Block.10, Lots 254 and 255, and Block 13, Lots 315 and 318, Florida Shores, Unit No. 1, Map Book 19, page 209 and Map Book 23, page 57, of the Public Records of Volusia County, Florida, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That it is the intent of the City Council of the City of Edgewater, Florida, to adopt an ordinance vacating that certain fifty foot right-of-way located at the end of Evergreen Drive, Edgewater, Florida, between Block 10, Lots 254 and 255, and Block 13, Lots 315 and 318, Florida Shores, Unit No. 1, Map Book 19, page 209 and Map Book 23, page 57, of the Public Records of Volusia County, Florida. SECTION 2. That all adjacent property owners who will be affected by said vacation shall be personally or constructively served with a copy of this Resolution. SECTION 3. That the proposed vacation shall appear for appro- priate action on the Agenda of the Edgewater City Council on May.19, 1980, and all persons affected by the vacation of this alleyway shall be heard regarding any objections to the proposed vacation on June 2, 1980, at 7:00 p.m., at the Edgewater Community Center. SECTION 4. That all resolutions or parts of resolutions in con- flict herewith be and the same are hereby rescinded. SECTION 5. That this Resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law. The first reading of the Resolution was read in full and passed by a vote of the City Council of the City of Edgewater, Florida, at -.a Regular meeting of said Council held on the 19th day of May, 1980, and Approved this !9>b day of May, A.D. 1980.
