702ORDINANCE N0,702 AN ORDINANCE DISCLAIMING ANY LIABILITY FOR LOSS OR DAMAGE TO ANY BOAT OR BOATING EQUIPMENT OR ANY CONTENTS OF ANY BOATS THAT ARE MOORED TO OR TIED TO OR LEFT UPON THE CITY PARK AND PIER AND RECREATION AREA ACROSS FROM CITY HALL OR UPON OR ADJACENT TO ANY OTHER PROPERTY OWNED BY THE CITY OF EDGEWATER, FLORIDA OR DEDICATED TO THE PUBLIC; PROVIDING THAT NO BOATS OR FLOATING VESSELS OF ANY TYPE SHALL BE MOORED OR TIED TO OR IN ANY WAY MADE FAST TO THE BULKHEAD OR SEAWALL IN THE PARK AND PIER AND RECREATION AREA ACROSS FROM CITY HALL; PROVIDING PENALTIES FOR VIOLATIONS OF THIS ORDINANCE, AND SETTING FORTH AN EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the city hereby disclaims any responsibility or liability for the loss or damage to any boat or floating vessel or any equipment contained therein, including motors, or any trailers that are left upon or moored at the Park and Pier and Recreation area across from City Hall or any other property owned by the city. SECTION 2. That it shall be unlawful for any person, firm or corporation to moor or tie any boat or floating vessel of any type to the bulkhead or seawall surrounding the Park and Pier and Recreation area directly across from City Hall. It shall also be unlawful for any person, firm or corporation to allow a boat or any other vessel to remain in a sunken condition next to or adjacent to the Park and Pier and Recreation area across from City Hall. SECTION 3. That any person, firm or corporation found guilty of violating Section 2, hereof, shall, upon conviction thereof, be subject to the penalties provided in Section 1-8 of the Code of Ordinances of the City of Edgewater, Florida. SECTION 4. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. That this Ordinance shall take effect immediately upon its adoption by the City Council and approval by the Mayor. now The above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida at a Regular Meeting of said Council held on the let day of October A.D., 1971. Upon motion duly made, seconded and carried, the require- ment of reading said Ordinance upon second reading was waived and the Ordinance was ordered put upon final passage. Passed by vote of the City Council of the City of Edge- water, Florida at a Regular Meeting of said Council held on the 1st day of October A.D., 1971, and approved as provided by law; the vote of said Council upon roll call being as follows: Approved this let day of October A.D., 1971.
