AN ORDINANCE ADOPTING BY REFERENCE
SECTIONS 1 to 7, INCLUSIVE, CHAPTER
69-324, LAWS OF FLORIDA, 1969, AND
FURTHER DESIGNATING THE CHIEF OF
POLICE OF THE CITY OF EDGEWATER,
FLORIDA, OR THE ACTING CHIEF OF
POLICE, AS THE CASE MAY BE, AS THE
"ENFORCEMENT OFFICER" AS PROVIDED
FOR IN SECTION (2) (d), OF CHAPTER
69-324; PROVIDING A METHOD AND
PROCEDURE FOR THE SALE AND DISPOSITION
OF ABANDONED AND/OR DERELICT PROPERTY;
AND PROVIDING AN EFFECTIVE DATE THEREFOR.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. Sections 1 to 7, inclusive, Chapter 69-324
Laws of Florida, 1969, be and the same are hereby specifically
adopted by reference by the City of Edgewater, Florida as
provided for in Section 7 thereof, and are hereby to be
included in the Code of Ordinances of the City of Edgewater,
Florida.
SECTION 2. The Chief of Police of the City of Edgewater
or the acting Chief of Police, as the case may be, is hereby
designated as the "Enforcement Officer" and, as the context
of this adopted section requires, the said term shall be
taken to mean the Chief of Police or the acting Chief of
Police, as the case may be.
SECTION 3. This Ordinance shall have no applicability
to confiscated or contraband personal property that has been
seized by the City of Edgewater incident of lawful arrest.
SECTION 4. When any abandoned or derelict property
within the City of Edgewater has not been claimed by the
rightful owner within the time provided in Section 2 of
Chapter 69-324, Laws of Florida, then and in that event
the City Clerk shall cause a notice to be published in
a newspaper of general circulation in the City of Edgewater,
Florida, stating that a public sale or auction will be
held for the purpose of selling abandoned and/or derelict
property, and said notice shall give the time and place of
said sale which shall be held within fourteen (14) days
from the publication of notice of sale. All sales shall
be conducted by the "Enforcement Officer" as defined
herein, and shall be held on the front steps of the
City Hall of the City of Edgewater, Florida at the
time specified in the publication of the notice. At
said time and place, said "Enforcement Officer" shall
auction off the articles of property that are to be sold
and the same are to be sold to the highest bidder for
cash; provided however, that the said "Enforcement Officer"
shall have the right to reject any and all bids or offers
received. All monies received from .the sale of said
articles of personal property shall be turned over to
the City Clerk and said money shall be placed in the
General Fund in the City of Edgewater, Florida. It shall
be the duty of the "Enforcement Officer" to keep an accurate
record of all articles sold and the amount of money received
for each article.
SECTION 5. All Ordinances or parts of Ordinances in
conflict herewith be and same are hereby repealed.
SECTION 6. This Ordinance shall take effect immediately
upon its adoption by the City Council and approval by the Mayor.
The above Ordinance was read in full and passed by vote
of the City Council of the City of Edgewater, Florida as
a regular meeting of said Council held on the 5th day of
July A.D., 1971.
Upon motion duly made, seconded and carried, the
requirement of read said Ordinance upon second reading
was waived and the Ordinance was ordered put upon final
passage.
Passed by vote of the City Council of the City of
Edgewater, Florida at a regular meeting of said Council
held on the 5th day of July A.D., 1971, and approved
as provided by law; the vote of said Council being as
follows:
