AN ORDINANCE APPROVING THE RECOMMENDATION
OF THE EDGEWATER ZONING BOARD IN
REFERENCE TO THE APPLICATION OF ROSS
KOTAKES TO REZONE CERTAIN PROPERTY IN
THE CITY OF EDGEWATER, FLORIDA FROM
RESIDENTIAL TO COMMERCIAL, FURTHER
PROVIDING THAT SAID PROPERTY BE
REZONED AND FURTHER PROVIDING THAT `
THE PROPERTY REZONED REVERT TO ITS
ORIGINAL ZONING IF NO CONSTRUCTION
HAS NOT BEEN STARTED WITHIN TWELVE
MONTHS FROM DATE, AND PROVIDING AN
EFFECTIVE DATE THEREFOR.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. That pursuant to that public hearing
held on December 9, 1970 and the report of the Chairman
of the Edgewater Zoning Board of December 10, 1970 to the
Mayor and City Councilmen, the City Council does hereby
approve said recommendation of the Edgewater Zoning Board
to rezone that portion of the following described real
property in Volusia County, Florida that is presently
zoned residential to commercial, to -wit:
The South 36 feet of Lot 22, except the East
535 feet; and Lot 23, except the North 34 feet
of the East 535 feet of the G. ALVAREZ GRANT
as recorded in Map Book 3, Page 137, Public
Records of Volusia County, Florida.
SECTION 2. That that portion of the above -described
real property that is presently zoned residential be and
the same is hereby rezoned commercial.
SECTION 3. That the above -described property rezoned
shall be used only as a mobile home site and if construction
of said mobile home site on the above -described property has
not begum within one (1) year from date, the said property
herein referred to shall automatically revert to its former
classification.
SECTION 4. That this rezoning is conditional upon the
owners or developers of the above -described property conforming
with all of those conditions and specifications attached hereto
and made a part hereof.
SECTION 5. That all Ordinances or parts of Ordinances

in conflict herewith be and the same are hereby
rescinded.
SECTION 6. That this Ordinance shall take
effect immediately upon its adoption by the City
Council and approval by the Mayor.
The above Ordinance was read in full and passed
by vote of the City Council of the City of Edgewater,
Florida at a regular meeting of said Council held on
the 4th day of January A.D., 1971.
Upon motion duly made, seconded and carried,
the requirement of reading said Ordinance upon second
reading was waived and the Ordinance was ordered put
upon final passage.
Passed by vote of the City Council of the City
of Edgewater, Florida at a regular meeting of said
Council held on the 4th day of January A.D., 1971,
and approved as provided by law; the vote of said
Council upon roll call being as follows:

CONDITIONS and SPECIFICATIONS:
(a) This is a proposed mobile home site
by the owner of the property, Ross Kotakes.
(b) Water and sewerage to be installed by
owner.
(c) Street of a 25 foot width to be shelled
to 15 foot width.
(d) Shell to be used for off street parking
at each trailer. This will be adequately
spaced.
(e) Electrical power tobe supplied by Florida
Power and Light Company.
(f) Concrete slab 6'xl6' to be installed at
each trailer entrance.
(g) Ample street lights to be installed by
owner.
(h) All installations to be approved by
State Department of Health.
(i) Engineering plat of the survey to be
drawn by an accredited engineer Florida
State licensed.
(j) All leases of home sites are for one (1)
year, lease to be paid month to month, so
that any undesirables can be removed from
the premises.
(k) All trailers to be fully enclosed by,
cement brick.
(1) Minimum size of trailers allowed on sites
are 121x45' or 10'x501.
(m) All sites to be sodded by owners.
(n) Public liability insurance to be carried
by owner in amounts:
PI $100,000 - $300,000.00
Physical damage $5,000.00.
