Proclamation - Special Election - Charter - 08-17-1970 (2)PROCLAMATION A PROCLAMATION CALLING A SPECIAL ELECTION TO BE HELD IN CONJUNCTION WITH THE PRIMARY ELECTION CALLED FOR OCTOBER 20, 1970, FOR THE PURPOSE OF AMENDING THE CHARMER OF THE CITY OF EDGEWATER, FLORIDA, PURSUANT TO CHAPTER 69-242, FLORIDA STATUTES, SAID ELECTION TO BE HELD TO DECIDE THE QUESTION OF WHETHER TO AMEND SECTION 8, CHAPTER 27532, SPECIAL ACTS 1951, LAWS OF FLORIDA, AS AMENDED BY SECTION 1, CHAPTER 29049, SPECIAL ACTS 1953, LAWS OF FLORIDA, AS AMENDED BY SECTION 1, CHAPTER 1310, SPECIAL ACTS 1965, LAWS OF FLORIDA, AS AMENDED BY SECTION 1, CHAPTER 1505, SPECIAL ACTS 1965, LAWS OF FLORIDA, AS AMENDED BY SECTION 1, CHAPTER 1364, SPECIAL ACTS 1967, LAWS OF FLORIDA, AS AMENDED BY SECTION 1, CHAPTER 2228, SPECIAL ACTS 1967, LAWS OF FLORIDA, SO AS TO RAISE THE COMPENSATION OF THE MAYOR FROM FOUR HUNDRED DOLLARS ANNUALLY TO THE SUM OF ONE HUNDRED DOLLARS PER MONTH, PAYABLE MONTHLY, AND TO RAISE THE COMPENSATION OF MEMBERS OF THE CITY COUNCIL FROM THREE HUNDRED DOLLARS ANNUALLY TO THE SUM OF SEVENTY-FIVE DOLLARS PER MONTH, PAYABLE MONTHLY; PROVIDING THAT THIS PROCLAMATION SHALL BE POSTED IN TWO PUBLIC PLACES IN THE CITY OF EDGEWATER, FLORIDA AT LEAST THIRTY DAYS PRIOR TO SAID ELECTION, ONE OF WHICH SAID PUBLIC PLACES SHALL BE THE BULLETIN BOARD IN THE CITY HALL IN THE CITY OF EDGEWATER, FLORIDA; PROVIDING THAT SAID ELECTION SHALL BE HELD IN THE COMMUNITY CENTER IN THE CITY OF EDGEWATER, FLORIDA; PROVIDING THAT THE QUESTION CONTAINED IN THIS PROCLAMATION SHALL BE CONSIDERED SEPARATE FROM ANY OTHER QUESTION TO BE VOTED UPON AT SAID ELECTION; AUTHORIZING THE CITY CLERK TO TRANSMIT A COPY OF THIS PROCLAMATION TO THE SUPERVISOR OF ELECTIONS FOR VOLUSIA COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE THEREFOR. BE IT PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That a special election be and the same is hereby called for October 20, 1970, to be held in conjunction with the primary election called for that day, said election to be held in the Community Center in the City of Edgewater, Florida for the purpose of amending the Charter of the City of Edgewater, Florida by deciding whether to raise the compensation of the Mayor from Four Hundred ($400.00) Dollars per year to the sum of One Hundred ($100.00) Dollars per month, payable monthly, and to raise the compensation of each Council- man from Three Hundred ($300.00) Dollars per year to the sum of Seventy -Five ($75.00) Dollars per month, payable monthly, by deciding whether Section 8, Chapter 27532, Special Acts 1951, Laws of Florida, as amended by Section 1, Chapter 29049, Special Acts 1953, Laws of Florida, as amended by Section 1, Chapter 1310, Special Acts 1965, Laws of Florida, as amended by Section 1, Chapter 1505, Special Acts 1965, Laws of Florida, as amended by Section 1, Chapter 1364, Special Acts 1967, Laws of Florida, as amended by Section 1, Chapter 2228, Special Acts 1967, Laws of Florida, which reads as follows: SECTION 8. CREATION OF THE CITY COUNCIL- TEflU-O"FFICE-FIXING COMPENSATION - CREATING VOTING DISTRICTS. There is hereby created a City Council con- sisting of a mayor and four (4) councilmen who shall be electors of the city and who shall be elected and hold office in the manner hereinafter provided. There shall be held a general city election on the first Tuesday after the first Monday in November 1967 for the election of a mayor and four (4) councilmen. The mayor and the councilmen from Zones 1 and 3 shall, beginning with the general city election on the first Tuesday after the first Monday in November 1967, be elected for a two-year term, the term of each to begin on the first Wednesday after the first Monday in November of the year in which each is elected. Thereafter, there shall be an election every odd year to elect a mayor and a councilman from each of Zones 1 and 3. Councilmen from Zones 2 and 4, beginning with the general city election to be held on the first Tuesday after the first Monday in November 1967, shall be elected for a three-year term, the term of each beginning on the first Wednesday after the first Monday in November of 1967. Thereafter, an election shall be held every two (2) years to elect a councilman from each of Zones 2 and 4, and the said election shall be held on even years, and the said councilmen from each of Zones 2 and 4 shall hold office for a period of two (2) years beginning on the first Wednesday after the first Monday in November of the year in which each of the said councilmen is elected. The members of the city council shall receive as compensation the sum of Three Hundred ($300.00) Dollars annually, payable monthly. The mayor of the city shall receive as compensation the sum of Four Hundred ($400.00) Dollars annually, payable monthly. The city is hereby divided into four (4) voting districts as follows: Voting District One shall be the area described as: Beginning at the inter- section of the center line of the Gabardy Canal, or South Canal, and the westerly right-of-way line of the Intercoastal Waterway; thence Southerly along the westerly right-of-way line of -2- said Intercoastal Waterway to a point opposite the center line of Park Avenue extended and Park Avenue to the west corporate limits; thence northerly along the westerly corporate limits to the center line of the Gabardy, or South Canal; thence easterly along the center line of said Gabardy, or South Canal to the point of beginning. Voting District Two shall be the area described as: Beginning at the point of intersection of the westerly right-of-way line of the Intercoastal Waterway and the center line of Park Avenue extended; thence southerly along the westerly right-of-way line of said Intercoastal Waterway to the point of intersection of the center line of New Hampshire Street extended; thence westerly along the center line of New Hampshire Street extended and New Hampshire Street to the center line of U.S. Highway No. l; thence westerly in a straight line to the point of intersection at the center line of the Florida East Coast Railroad and Alice Street; thence westerly along the center line of Alice Street and Alice Street extended to the west corporate limits; thence northerly and westerly along the west corporate limits to the center line of Park Avenue; thence easterly along the center line of Park Avenue and Park Avenue extended to the point of beginning. Voting District Three shall be the area described as: Beginning at the point of intersection of the Westerly right-of-way line of the Intercoastal Waterway and the center line of New Hampshire Street ex- tended; thence southerly along the westerly right-of-way line of the Intercoastal Waterway to the center line of Indian River Boulevard extended; thence westerly along the center line of Indian River Boulevard extended and Indian River Boulevard to the west corporate limits; thence northerly and easterly along the west corporate limits to the center line of Alice Street extended; thence easterly along the center line of Alice Street extended and Alice Street to the center line of the Florida East Coast Railroad; thence easterly in a straight line to the point of intersection of the center line of U.S. Highway No. 1 and New Hampshire Street; thence easterly along the center line of New Hampshire Street and New Hampshire Street extended to the point of beginning. Voting District Four shall be the area described as: All that area within the corporate limits, lying south of the following described line: Beginning at the point of intersection of the westerly right-of-way line of the Intercoastal Waterway and Indian River Boulevard -3- extended; thence westerly along the center line of Indian River Boulevard extended and Indian River Boulevard to the westerly corporate limits, shall be changed to read as follows: SECTION S. CREATION OF THE CITY COUNCIL - TERM OF OFFICE -FIXING COMPENSATION - CREATING VOTING DISTRICTS. Highway No. 1; thence westerly in a straight line to the point of intersection at the center line of the Florida East Coast Railroad and Alice Street; thence westerly along the center line of Alice Street and Alice Street extended to the west corporate limits; thence northerly and westerly along the west corporate limits to the center line of Park Avenue; thence easterly along the center line of Park Avenue and Park Avenue extended to the point of beginning. Voting District Three shall be the area described as: Beginning at the point of intersection of the Westerly right-of-way line of the Intercoastal Waterway and the center line of New Hampshire Street extended; thence southerly along the westerly right-of-way line of the Intercoastal Waterway to the center line of Indian River Boulevard extended; thence westerly along the center line of Indian River Boulevard extended and Indian River Boulevard to the west corporate limits; thence northerly and easterly along the west corporate limits to the center line of Alice Street extended; thence easterly along the center line of Alice Street extended and Alice Street to the center line of the Florida East Coast Railroad; thence easterly in a straight line to the point of intersection of the center line of U. S. Highway No. 1 and New Hampshire Street; thence easterly along the center line of New Hampshire Street and New Hampshire Street extended to the point of beginning. Voting District Four shall be the area described as: All that area within the corporate limits, lying south of the following described line: Beginning at the point of intersection of the westerly right-of-way line of the Intercoastal Waterway and Indian River Boulevard extended; thence westerly along the center line of Indian River Boulevard extended and Indian River Boulevard to the westerly corporate limits. dcfl O 101 SECTION 2. That this Proclamation shall be posted in two public places in the City of Edgewater, Florida, one of which said places shall be the bulletin board at the Edgewater City Hall, not less than thirty (30) days prior to October 20, 1970. SECTION 3. That the question contained in this Proclamation shall be considered separate from any other questions to be voted upon at said election. SECTION 4. That the City Clerk be and she is hereby authorized to transmit a copy of this Proclamation to the Supervisor of Elections for Volusia County, Florida. SECTION 5. That this Proclamation shall take effect immediately upon its adoption by the City Council and approval by the Mayor. That the amendment to the Charter contemplated herein, if approved by a majority of qualified electors voting at said election, shall become effective immediately upon filing the Revised Charter with the Secretary of State, State of Florida.
